DESCRIPTION) Finance: Council Notes: Agenda Item No. ~=3 7 CIl l OF SAN BERNARDI :) - REQUE' T FOR COUNCIL ACT ~N STAFF REPORT In reviewing the ordinance establishing the Office of the City Administrator (San Bernardino Municipal Code Chapter 2.02) in reference to another Municipal Code amendment, it became clear that portions of the ordinance are inconsistent with the Charter and current law. The City Attorney's Office has therefore proposed the attached ordinance to bring Chapter 2.02 into conformity. The changes to Sections 2.02.020 and 2.02.030 are shown on the attached sheet. ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS 2.02.020 AND 2.02.030 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE ADMINISTRATIVE OFFICE. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 2.02.020 of the San Bernardino Municipal Code is amended to read as follows: "2.02.020 Selection - Experience requirements. The Administrative Officer shall be chosen on the basis of administrative and executive ability. He or she shall have at least five years of experience in responsible executive or administrative positions and shall possess the ability to plan and execute the policies and programs of the Mayor and Common Council, including budgeting, budgetary control and the coordination of various City activities. He or she shall devote his or her entire time to the duties of his or her office and shall not engage in any other business or occupation." SECTION 2. Section 2.02.030 of the San Bernardino Municipal Code is hereby amended to read as follows: "2.02.030 Appointment - Discharge - Notice of resignation. The Administrative Officer shall be appointed by the Mayor wi th the consent and approval of the Common Council and shall serve at the pleasure of the Mayor. His or her appointment shall terminate upon written notice of such termination. The Administrative Officer shall give the Mayor and Common Council not less than thirty days' written notice of his or her intent 28 8-10-88 DAB:cm 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 to resign." He or she shall have at least five years of experience in responsible executive or administrative positions and shall possess the ability to plan and execute the policies and programs of the Mayor and Common Council, including budgeting, budgetary control and the coordination of various City activities. [He shall become and remain a resident of the City during his tenure of office.] He or she shall devote his or her entire time to the duties of his or her office and shall not engage in any other business or occupation." "2.02.030 Appointment - Discharge - Notice of resignation. The Administrative Officer shall be appointed by the Mayor with the consent and approval of the Common Council and shall serve at the pleasure of the Mayor [and Common Council. He may be discharged by a vote of five-sevenths of the Common Council and] '- His or her appointment shall terminate[s] upon written notice [to him] of such [discharge and] termination.
