FOR COUNCIL ACT~ IN STAFF REPORT Bids for this project were opened at 2:00 p.m. on Tuesday, 8-02-88. A total of 3 bids were received, ranging from $122,780.00 to $196,683.00. The low bid of $122,780.00 is 12.9% under the Engineer's Estimate of $141,000. The special provisions stipulate that a goal of 2% has been established for Disadvantaged Business Enterprises (DBE) participa- tion. A DBE is a business with majority ownership by a minority or a female. As required by the special provisions, the two low 'bidders submitted data on the DBE's they would use to meet the i ndi cated goal. The data submitted by the low bidder, Signal Maintenance, Inc., listed only one firm. However, this firm is not on Caltrans' list of certified DBE's, or had they applied for certification prior to the bid opening. Based upon this fact, we made a deter- mination that the low bidder had not met the goal and was, there- fore, not responsible. Caltrans has concurred with this determina- tion. Therefore, it will be necessary to reject the low bid as being not responsible, and award a contract to the second low bidder. The second low bid by the Paul Gardner Corp., in the amount of $145,983, is 3.5% over the Engineer's Estimate of $141,000. Listed below is an estimate of the total project cost, based upon the actual bid price of the lowest responsible bidder: Construction Contract - Preliminary Engineering (W.O. #1476) Construction Engineering (W.O. #1819) Sub-Total Contingencies (5%)i TOTAL ESTIMATED PROJECT COST $ 145,983 7,250 17,750 $ 170,983 8,017 $ 179,000 An amount of $150,000 has been allocated from Federal-Aid Urban Funds, under Account No. 242-362-57659, to finance the costs that will be incurred for this project. Supplemental Federal-Aid Urban Funds can be used to cover the actual total project cost. At their meeting of 12-10-87, the Environmental Review Com- mittee made a finding that this project is categorically exempt from provisions of the California Environmental Quality Act. I Z 0 a: ~ C) u (j) I- Z U C en I LLI <r: co is w oJ I&. o iii 8/15/88 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO PAUL GARDNER CORPORATION FOR MODERNIZATION OF TRAFFIC 3 SIGNALS ON BASELINE STREET FROM "H" STREET TO SIERRA WAY. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1. Paul Gardner Corporation is the lowest responsible bidder for modernization of traffic signals on Baseline Street, from "H" Street to Sierra Way, in accordance with Plan No. 7433, for the total amount of $145,983.00, and a contract is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bids therefore are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obl igated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party.
