On 02-01-88, authorization was given to proceed with the proposed vacation,
and Plan No. 7422 was approved.
All of the interested City Departments and Utility Companies were
notified of the proposal on 03-28-88, with a reply due by 04-14-88. The
responses are attached for your information. A reservation of an easement
for sanitary sewer and appurtenant facilities, an easement for water lines
and appurtenant facilities and an easement for public utility purposes was
requested, which will have to be reserved, as set forth in the attached
Resolution of Intention.
On 08-01-88, a finding of need for health and safety reason for the proposed
vacation was made, a Negative Declaration was adopted and a finding of
consistency with the Interim Policy Document was made.
Since the proposal was initiated by the City, the filing fee of $400 was
waived. It is recommended that favorable consideration be given to the
requested vacation. The Resolution of Intention, which sets a protest date
of 10-17-88 has been attached hereto for your action also.
Upon the approval of said Resolution, all adjacent property owners will be
notified by mail of the hearing date.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF PORTIONS OF MAIN STREET AND BROADWAY STREET BETWEEN
3 "I" AND "J" STREETS AND RESERVING AN EASEMENT FOR SANITARY SEWER AND
APPURTENANT FACILITIES, AN EASEMENT FOR WATER LINES AND AN EASEMENT FOR
4 PUBLIC UTILITIES THERON.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:

SECTION I.
That the Mayor and Common Council of the City of San
Bernardino
hereby
declares
its intention to order the vacation
of
described as follows:

Those portions of Broadway Street and Main Street in

of California, described as follows:

PARCEL ONE: That portion of Broadway Street, delineated
as that certain unnamed EastfWest Street on the map of
Carter's Subdivision, as per plat recorded in Book 3 of
Maps, page 79, records of said County, described as
follows:

Commencing at the Northeast Corner of Lot 11 of said
subdivision, said point also being on the South line of
said Broadway Street; thence East, along said South line
to the West line of the A.T. & S.L Railroad Right of
Way, and the True Point of Beginning; thence East, along
the South line of said Broadway Street, to the East line
of said Railroad Right of Way; thence Northwesterly,
along a straight line, to the intersection of the North
line of said Broadway Street and the East line of said
Railroad Right of Way, said point also being on the South
line of Lot 6 of said subdivision; thence West along said
North line of Broadway Street, to the West line of said
Railroad Right of Way; thence Southeasterly, along a
straight line, to the True Point of Beginning.

SECTION 2.
That the Mayor and Common Council of the City of San
7 Bernardino, in vacating the above described portion of said street ,elects
8 to proceed under and in accordance with the provisions of the "Public
9 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
10 the Streets dnd Highways Code of the State of California.

SECTION 3.
That
the hour of 10:00 A.M. on the 17th day of
12 October, 1988, in the Council Chamber of the City Hall, San Bernardino,
13 California, be, and the same hereby is fixed as the time and place when and
14 where all persons interested in or objecting to the proposed vacation may
15 appear before the said Mayor and Common Council and offer evidence in
16 relation thereto.
For further particulars as to the proposed vacation of
17 the hereinbefore described portion of said street, reference is made to that
18 map marked "Plan No. 7422", approved February 1, 1988, on file in the
19 office of the City Clerk of said City.

SECTION
4. Nothing in this Resolution shall in any way affect
21 or disturb any existing easements for sanitary sewer and appurtenant
22 facilities, water lines and appurtenant facilities, and
for
pub I ic
23 utility
purposes belonging either to the City of San Bernardino or to
24 any public utility and there is hereby reserved tor future general
public
25 utility purposes and for this City an easement reasonably necessary to
26
locate such sanitary sewer and public utility facilities over, in,
under
27
or
across the real property hereinabove described and to use, maintain,

o repair, replace or renew such facilities.

SECTION 5. That the City Engineer of the City of San Bernardino

5 this Resolution of Intention and shall cause the same to be published once a
