STAFF REPORT
The County of San Bernardino Environmental Health Department
has requested the Water Department to agree to act as a court
appointed receiver for the Cardiff Farms Mutual Water Company
(Cardiff), Superior Court Case No. 244293.
Cardiff's service area is located south of Third Street
between Lena Road and Tippecanoe Avenue and is outside the
corporate limits of the City of San Bernardino. According to
County records, Cardiff has approximately 190 unmetered
service connections. The County is bringing action against
Cardiff for failure to meet the requirements of California
Health and Safety Code Subsection 4017, failure to comply
with primary and secondary drinking water standards, and
failure to provide a reliable and adequate supply of pure,
wholesome, healthful and potable water.
The County would like to appoint a receiver who has adequate
knowledge, experience and capability of properly operating
the water system. Two agencies are adjacent to Cardiff's
service area; the Water Department and East Valley Water
District. The Water Department has water distribution mains
on three sides of Cardiff's service area, while East Valley's
closest facilities are north of Third Street. For East
Valley Water District to be appointed as receiver, the City
of San Bernardino would have to approve and give written
consent since Cardiff's service area is within our sphere for
water and sewer service, as set forth in Joint Powers
Agreements between East Valley Water District, the City of
San Bernardino and the Board of Water Commissioners.
The Board of Water Commissioners has agreed in principle to
act as receiver for Cardiff, as long as mutually satisfactory
terms and conditions can be agreed to with the County and the
Superior Court. The Water Department would install an
intertie to Cardiff's distribution system and supply water
from our system, rather than trying to operate their wells
and boosters. The Water Department would deliver water at
rates which would have to cover all of our costs to provide
service.
The case was scheduled to be heard on August 25, 1988 in San
Bernardino County Superior Court. Since Cardiff's service
area is outside the corporate limits of the City of San
Bernardino, the Mayor and Common Council must approve the
Board of Water Commissioners serving water to said area
(S.B. MC Subsection 2.28.030).
The County is appearing in Superior Court on August 25, 1988
requesting a two week continuance in order for one of the
public agencies to confirm that they will agree to act as
receiver.
It is recommended that the Board of Water Commissioners be
authorized to act as the court appointed receiver for Cardiff
Farms Mutual Water Company.
