STAFF REPORT
SUBJECT:
Resolution of the Mayor and Common Council of the City of San Bernardino Ratifying
the proclamation of a local emergency.
BACKGROUND:
On October 13, at approximately 10:22 a.m. a wildland fire named as the 215 Fire
started north of Baseline Street along the Interstate 215 corridor, and burned
approximately 20 acres of vegetation on both sides of the freeway. On October 13, at
approximately 5:13 p.m., City fire and police resources responded to the 215 II Fire that
started just south of the 215 Fire earlier in the day. This fire burned approximately 90
acres between Baseline Street and Mill Street, a distance of about two miles. A number
of commercial and private building were either destroyed or damaged by the fire.
The City expended resources (personnel time, equipment usage, and materials/supplies)
to meet the response, and mobilization needs of the two incidents. During the early
morning hours of October 14, two additional fires were suppressed on Little Mt.
In accordance with the City of San Bernardino Municipal Code Section 2.46.060.A.I,
the Mayor, as Chairman of the San Bernardino Disaster Council and Executive Director
of Emergency Services, is empowered to request the Common Council to proclaim the
existence or threatened existence of a local emergency if the Common Council is in
session, or to issue such proclamation if the Common Council is not in session.
A local emergency proclamation must be issued to allow billing and collection of costs
incurred by the City at this incident. It is necessary for the Mayor to proclaim the
existence of a local emergency within ten (10) days of the incident and for the Common
Council to ratify the Proclamation within seven (7) days of the issuance of the
Proclamation.
The Mayor signed a local emergency proclamation on October 13, at 7:20 p.m.,
attached as Exhibit A. The Chairman of the County Board of Supervisors also
proclaimed a local emergency on October 14. On October 15, Governor
Schwarzenegger declared a state of emergency for the County of San Bernardino,
referencing the fires that burned along the Interstate 215 corridor in the City.
Staff is in the process of estimating costs incurred. Once that information is available it
will be forwarded to the Mayor and Council.

FINANCIAL IMPACT:
Fiscal impacts are unknown at this time, although the City may be able to affect cost
recovery through the State Office of Emergency Services.
RECOMMENDATION:
Adopt resolution.

CITY OF SAN BERNARDINO, CALIFORNIA
WHEREAS, on October 13, 2008 at 7:20 p.m., there are several fires burning
along the 1-215 corridor through the City of San Bernardino;
WHEREAS, such fires have resulted in damage to public and private property,
and necessitated the deployment and expenditure of extraordinary fire fighting and public
safety resources;
NOW THEREFORE, 1, Mayor Patrick J. Morris, do hereby declare a state of
emergency in the City of San Bernardino pursuant to Section 2.46 of the San Bernardino
Municipal Code.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO RATIFYING THE PROCLAMATION OF A LOCAL
EMERGENCY
WHEREAS, Chapter 2.46 of the Municipal Code of the City of San
Bernardino empowers the Mayor as Chairman of the San Bernardino Disaster Council
and Executive Director of Emergency Services to proclaim the existence of a local
emergency when the Common Council is not in session, subject to ratification within
seven days; and
WHEREAS, conditions of extreme peril to the safety of persons or property
have arisen within the City of San Bernardino by wildfires burning and extreme fire
danger due to adverse weather conditions of high wind and low relative humidity, and
have burned private property and infrastructure along the Interstate 2 15 corridor and
have threatened the same in other areas of the City; and
WHEREAS, on October 13, 2008, at 7:20 p.m., the Mayor did proclaim the
existence of a local state of emergency within said City; and
WHEREAS, the Mayor and Common Council do hereby tind that the
aforesaid conditions of extreme peril did warrant and necessitate the proclamation of
the existence of a local emergency; and
IT IS FURTHER PROCLAIMED AND ORDERED that the local
emergency proclamation of the Mayor of San Bernardino is hereby ratified, and that
said local emergency shall be deemed to continue to exist until its termination is
proclaimed by the Common Council of San Bernardino.
