This had previously been approved by the Legislative Review Committee. At the time this was presented to the Mayor and Council at the public hearing, an ordinance had not been prepared. The changes were incorp- orated in the cat licensing proposal that was~approved by Mayor and Council on August 15, 1988. BIGGS {/ Director of Animal Control 75-0264 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS 6.24.010 THROUGH 6.24.060; AND 6.24.170 THROUGH 6.24.180 AND 3 HEPEALING SECTION 6.24.080 OF THE SAN BERNARDINO MUNICIPAL CODE ES'J'AI\LISHING YF.AR TO DATE AND MULTI-YEAR DOG LICENSING. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Section 6.24.020 of the San Bernardino 7 Municipal Code is amended to read as follows: 8 9 "6.24.020 License required. It is unlawful for any person, firm or corporation to own 10 or harbor any dog within the City, except as provided in this 11 chapter, without securing a license therefor, and maintaining a 12 tag thereon, as specif ied in this chapter." 13 SECTION 2. Section 6.24.030 of the San Pernardino 14 Municipal Code is amended to read as follows: 15 16 "6.24.030 License and tag required - Fees A. Each person, firm or corporation owning, harboring or 17 having custody or control of a dog of the age of four months or 18 more, within the City shall obtain at least annually a license 19 and tag for the dog. License and tag fees are payable in 20 advance. If the appropriate fee is not paid when due, a 21 delinquency penalty shall be added to the fee. A fee shall be 22 charged for any edditional tag issued to replace a lost, stolen, 23 misplaced or damaged tag and shall be charged for the transfer of 24 ownership of a licensed dog to a new owner in lieu of a fee for a 25 new license for the remainder of the licensing period in which 26 the transfer occurs. If a dog has a current license from another 27 licensing jurisdiction and has a current rabies vaccination, said 28 1 1 license shall be recognized by the City upon a payment of a 2 transfer fee. 3 B. If any person, firm or corporation acquires the 4 ownership, custody or control of a dog the new owner shall obtain 5 the license required by this title within one month after 6 acquiring the ownership, custody or control of such dog, if the 7 dog is then of the age of four months, or within one month after 8 such dog attains the age of four months. The license shall 9 expire the same month as the month the rabies vaccination was 10 issued. The first license fee for a dog may be pro-rated so to 11 expire at the same time as the rabies vaccination expires. 12 C. Moneys received during the current year for a license 13 shall be first applied to the payment of delinquent fees, sums 14 and penalties due during the preceding year, and any balance 15 remaining thereafter shall be applied to the payment of the 16 current license fees and penalties. A license issued during any 17 prior fiscal year to the same owner for license shall be prima 18 facie evidence in any court or administrative proceeding that the 19 dog was continuously owned by the same owner from the prior year 20 to the current fiscal year." 21 SECTION 3. Section 6.24.060 of the San Bernardino 22 Municipal Code is amended to read as follows: 23 24 25 26 27 28 "6.24.060 Running at large without license or tag - Illipoundment. Every dog found running at large for which a license has not been issued, or which does not bear a tag as provided in this chapter, shall be impounded by authorized employees of the city for a period of seventy-two hours, and in the event the owner or 2 1 possessor of the dog does not, on or before the expiration of the 2 seventy-two hour period, call for and claim the dog, and pay the 3 required license fee, obtain a tag, and pay the suw required by 4 Council Resolution, the dog shall be disposed of by authorized 5 employees of the city. 6 Section 4. Section 6.24.080 of the San Bernardino 7 Municipal Code is hereby repealed in its entirety. 8 Section 5. Section 6.24.170 of the San Bernardino 9 Municipal COC0 is amended to read as follows: 10 "6.24.170 Vaccination requirement - Certificate 11 A. Each person, firm or corporation who owns or harbors 12 any dog over the age of four months in the City shall have such 13 dog vaccinated against rabies by a duly licensed veterinarian of 14 his choice or at a vaccination clinic approved by the health 15 officer. Such vaccination shall be by an injection which has 16 been approved by the health officer and given at intervals 17 specified by California State Law. 18 B. Upon vaccinating any dog pursuant to this chapter, the 19 veterinarian shall issue a certificate of vaccination, which 20 shall show the expiration date of the vaccination." 21 Section 6.
