STAFF REPORT
Bids for this project were opened on August 23, 1988, at 2:00 p.m.
A total of seven bids were received ranging from a low bid of
$434,091.00 to a high of $661,335.00. The low bid was 25% under the
Engineer's Estimate of $542,365.00.
Listed below is the total estimated project cost, based upon the actual
low bid price:

An amount of $266,000.00 was alocated in Account No. 245-365-57724 in
1986. In July of 1988, additional funds from the Sewer Line
Construction Fund were allocated to bring the total available in this
account to $626,200.00.
Staff feel s the low bi d pri ce represents the lowest reasonabl e cost
for the project. Therefore, we recommend that the contract be awarded
to the low bidder, Bonadiman-McCain, Inc., and that the resolution be
adopted.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BONADIMAN-MCCAIN, INC. FOR CONSTRUCTION OF A RELIEF
3 SEWER IN MILL STREET, EAST OF LYTLE CREEK TO MT. VERNON.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
Bonadiman-McCain, Inc.
is the lowest

responsible bidder for construction of a relief sewer in Mill

Street, East of Lytle Creek to Mt. Vernon, in accordance with
Plan No. 7305, for the total amount of $434,091.00, and a
contract is awarded to said bidder accordingly, but such award
shall be effective only upon the contract being fully executed
by the parties; all other bids therefor are hereby rejected; and
the Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is
attached hereto, marked Exhi bi t "A" and incorporated herei n by
reference as fully as though set forth at length.
SECTION 2.
This contract and any amendments or modi-
fications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party
shall be obligated hereunder until the time of such full execu-
tion. No oral agreements, amendments, modifications or waivers
are intended or authorized and shall not be implied from any act
or course of conduct of any party.
