HomeMy WebLinkAbout23-Purchasing RESOLUTION NO. 1 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE 2 EXECUTION OF THE AGREEMENT WITH THE SAN BERNARDINO COMMUNITY ~GAINST DRUGS RELATING TO FUNDING FOR THE FISCAL YEAR 1988-1989. 3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 4 OF SAN BERNARDINO AS FOLLOWS: 5 6 7 8 9 10 11 12 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said city an Agreement with the San Bernardino Community Against Drugs relating to funding for the fiscal year 1988-1989, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of San 13 Bernardino at a meeting thereof, held on the 14 15 16 17 18 19 20 21 day of , 1988, by the following vote, to wit: AYES: Council Members NAYS: ABSENT: City Clerk The foregoing resolution is hereby approved this 22 day of , 1988. 23 24 Mayor of the City of San Bernardino 25 26 Approved as to form and legal content: 27, 28, ~-~ J,~ .~y Attorney ~_3 AQB~lU1~H.~ (San Bernardino Community Against Drugs) THIS AGREEMENT is made and entered into this day of , 1988, between the CITY OF SAN BERNARDINO, a unicipal corporation, referred to as "City," and THE SAN ERNARDINO COMMUNITY AGAINST DRUGS, a nonprofit organization, eferred to as "organization." THOUSAND SEVEN HUNDRED EIGHT DOLLARS AND THIRTY-THREE CENTS 21 ($3,708.33), and one final installment of THREE THOUSAND SEVEN 22 HUNDRED EIGHT DOLLARS AND THIRTY-SEVEN CENTS ($3,708.37). The ~~ payments shall be made by the tenth of each month. 24 3. Term. This agreement shall commence July 1, 1988, and 25 terminate June 30, 1989. 26 4. Use of Funds. The funds paid to organization shall be 27 used by it soley for the purpose set forth in Paragraph lB of 28 his agreement. At the end of the term, all unexpended city 1 funds shall be returned to City by Organization. 2 5. Accountina. Prior to the final payment under this 3 greement, and at such other times as may be requested by the 4 City Administrator or Director of Finance of City, Organization 5 shall submit to the City Administrator, with a copy to the 6 Director of Finance, an accounting of the proposed and actual 7 expenditures of all revenues accruing to the organization for the 8 fiscal year ending June 30, 1989. Financial records shall be 9 maintained by Organization in accordance with generally accepted 19 accounting principles, in a manner which permits City to trace 1~ the expenditures of the funds. All books and records of Organi- 12 zation are to be kept open for inspection at any time during the 13 business day by the City or its officers or agents. 14 6. Reoorts. Quarterly, and at such other times as may be 15 requested by the City Administrator, organization shall submit to 16 the City Administrator an activity report. This report shall 17 indicate what programs and/or activities have been supported by 18 City funds. Where possible, the number of individuals impacted 19 or using the services should be appropriately noted. Equipment 20 or materials purchased with City funds should have justifications 21 for the expenditures. The summary of these reports should be 22 submitted on an annual basis in concurrence with the financial 23 accounting report for the fiscal year. 24 7. Temoorarv Withholdina. The City Administrator, with the 25 .concurrence of the Mayor and Common Council, is authorized to 26. temporarily withhold or terminate the payment of funds to Organi- 27 zation when the City Administrator determines that any violation 28 of the agreement has occurred. Funds shall be withheld until the . 1 not less than $500,000.00 for injuries, including, but not limited to, death, to anyone person and, subject to the same .2 limit for each person, in an amount not less than $500,000.00 on 3 4: account of anyone occurrence; (b) Property Damage Insurance. In an amount of not less than $50,000 for damage to the property of each person 5 6 7 8 9 on account of anyone occurrence. 11. Termination for Cause. City reserves the right to terminate this agreement and any and all grants and future pay- that Organization has failed to comply with the conditions of 12 this agreement. In the event City seeks to terminate this agree- 13 , ment for cause, City shall promptly notify Organization in writ- 14 ing of the proposed termination and the reasons therefor, to- 15 gether with the proposed effective date. 16 17 Organization shall be given an opportunity to appear before the Mayor and Common Council at the time at which the Mayor and Common Council are to 18 consider such recommended termination, and shall be given a 19 reasonable opportunity to show cause why, if any exits, the 20 I' agreement should not be terminated for cause. Upon determination ~. i '. 'by the Mayor and Common Counc 1 that the contract should be 22 terminated for cause, notice thereof, including reasons for the 23 , determination, shall promptly be given to Organization, together 24 with information as to the effective date of the termination. In such event, the parties shall agree upon the termina- ion conditions, including the effective date and, in the case of artial terminations, the portion to be terminated. Organization hall not incur new obligations for the terminated portion after he effective date and shall cancel as many outstanding bligations as possible. City shall allow Organization full redit for the City's share of the non-cancellable obligations roperly incurred by Organization prior to termination. 13. Assianment. Included in the Mayor's Drug Task Force: Mayor Evlyn Wilcox - Sheriff - San Bernardino Police Department - California Youth Authority - Councilman District Attorney - Fire Chief - YMCA - Probation City Schools - City Attorney - Housing - City Clerk Norton Air Force Base - Building & Safety - Realtor University - Parents ~ Child Protective Services - County Drug and Alcohol Program and Treatment Agencies. We wanted to find out the needs and problems of our community relating to drug and alcohol abuse. We formed sub-committees to determine the problem areas and soon realized we needed to form a nonprofit organization in order to raise funds and assist the Drug Task Force in organizing and networking with the different agencies involved with the community drug abuse problems. San Bernardino Community Against Drugs, Ino. was officially incorporated on July 10, 1986. ..' WHAT WE WANT TO 00 - Aid in eduoation of community members. Assist and cooperate with the schools to provide more teacher training seminars in the substance abuse programs. . Assist by co-sponsoring with the San Bernardino City Unified School District to provide different monthly programs for the Parent,. Awareness Nights. This will include advertising these programs to the community. Will be constantly providing pertinent drug and alcohol information to the local community access channel/cable TV as well as working on new PSA's with the media. WHO SUPPORTS US - We obtain funding from the City of San Bernardino to pay operational costs, including a director and secretary, so all monies raised can go for programs. We do fund raising to obtain the monies needed to assist the community in on-gOing educational programs and community awareness events and needs. ACCOMPLISHMENTS TO DATE - Assist individuals in need by providing personalized informatin on resources and places to get help. Established a communications link between agencies involved with the drug problem -.law enforcement, courts, schools, treatment centers, government and community. Responsible for writing an ordinance to improve the business environment of the City by reducing the occurrence of acts of sexual misconduct, illicit drug transactions, and "fencing" acti vi ties on business premises in the City. This Ordinance No. MC-502 adding Chapter 5.82 was duly adopted by the Mayor and Common Council of the City of San Bernardino on March 3, 1986. This Ordinance has been successful to date. Successfully worked with the San Bernardino County Board of Supervisors to inc~ase funding allocations for the Sheriff's Crime and Drug testing lab. Applied for nonprofit status in May, 1986 and received our exemption under section 501(c)(3) of the Internal Revenue Code on July 10, 1986. 2 Received $6000 from General Telephone Company in June 1986 for the purchase of a Communicator / Student Awareness System - a telephone answering machine which provides taped messages on drug related questions, which is in constant use at this time. "The Communicator/Student Awareness System has 63 taped messages: 27 Drug; 17 Alcohol; 13 Emotional and 6 Community. Phone number 24 hours per day is 381-5888. We're averaging about 56 phone calls per day. This Communicator is located in the San Bernardino City Unified School District office. The menus are distributed on a constant basis throughout the local area to schools, businesses, libraries, service clubs, and anyone who requests them. These tapes have been revised and new tapes have been added to include Aids. The total number of tapes that are now. available are 65. The new tapes will be in effect on March 8, 1988. . September 13, 1986 - Held our first fundraiser "The Heat Is On", where approximately 290 people attended. $25,000 was raised from this event. Received the support of the local Judges in October of 1986 to take a hard line on street sales of illegal drugs and establish new guidelines that give convicted dealers a minimum one-year jail sentence to first time offenders. November, 1986 - Organized Drug Awareness Fair in Central City Mallon Mayors' D-Day in the War on Drugs. Over 500 people attended that day to receive information and pamphlets and talk to recovering addicts. Videos were available for all ages on drug and alcohol abuse. Participants included local high school peer counselors, San Bernardino Police Department, County Mental Health, County Drug and Alcohol Program, treatment facilities, Kids Against Crime, KCKC broadcasting live and a high school band played as well. Helped obtain funding for a security system for Agape House (Center of Community Counseling & Education) in January, 1987. February, 1987 - Donated $8,700.00 to the San Bernardino Police Department to purchase a body transmitter to assist in arrests ($7000)an~ a drug sniffing device. which pinpoints areas of chemicals (1200) and sponsored a drug-free event for D.A.R.E. graduates ($500). Wrote our first newsletter in February, 1987 and mailed to 320 people. Mailed our second newsletter in April, 1987 to 480 people. We hope to be able to do these every three 3 months, and to increase our distribution. Sponsored 12 students from local high schools to attend Californian's For Drug Free Youth conference in Irvine - March 13-14, 1987.' D.A.R.E. (Drug Abuse Resistance Education) started with one full time DARE officer and through the assistance and information provided by the Drug Task Force/SBCAD to the San Bernardino Police Department, an increase of two full time DARE officers and one school security officer has resulted. Have made 10 different drug announcements on the KCKC radio station regarding the signs and symptoms that. parents should be looking for. April 6, 1987 - Donated $2,555 to the San Bernardino City Unified School District, for the purchase of (2) Here's Looking at You 2,000 Kits @ $940.00 oach; (15) Elementary Group Facilitators Handbooks @ $35.00 each; and (5) Secondary Group Facilitators Handbooks @ $30.00 each. Sponsored a team of nine participants from the Community to attend the Attorney General's Challenge Seminar in April, 1987, and was asked to speak at the program about the networking of San Bernardino Community Against Drugs, Inc. There were over 700 people from the Southern California area in attendance. May 1, 1987 - Sponsored a Parent Awareness program in conjunction with the local Elks Lodge titled " Drugsl It Can't Happen - Not In Our Family". May 17, 1987 - Held our first .CYCLE AGAINST DRUGS" 25 & 50 mile ride for bicyclers. 521 participants were registered for this event. Music, entertainment, T-shirts and a buffet were provided for all.. the entrants and volunteers, as well as updated drug and alcohol information was available to all those who attended. Over $3,000 was raised from this event. June 28, 1987 - Held the first annual celebrity exhibition game with San Bernardino's "SPIRIT. baseball team in honor of .SAY NO TO DRUGS" lIeek. Actor Mark Harmon participated in this event along with other celebrity athletes and the local celebrity baseball players. Drug information was made available to over 500 participants of this event. July 30, 1987 - The San Bernardino Community Against Drugs, Inc. Board approved the donation of $3000 to the San 4 Bernardino Public Library to start updating library materials on drug related issues. This money will start out purchasing 36 book titles representing 172 individual items as well as 8 titles (12 items) in video format. All titles will cater to . both juvenile and adult audiences. This material will be placed in all five branches in this community. August 12, 1987 - Participated in the Ronald McDonald Safety Show held at the Norman Feldheym Library and distributed drug and alcohol related information to the approximate 350 children in attendance. September 8, 1987 - Attorney General John K. Van De Kamp's office requested 100 copies of our August, 1987 Newsletter in order to assist the Northern California area with drug related problems. October 17, 1987 - Participated in the Annual Crime Prevention Day at the local perris Hill Park where drug information was distributed to over 350 people who attended. October 17, 1987 - Held our 2nd annual fundraiser - "The Beat Goes On". Over 400 people attended this fundraiser. Poster information was made available providing pictures and brochures about the involvment of San Bernardino Community Against Drugs, Inc. Jeri Simpson was presented with a letter and a Certificate of Appreciation signed by John K. Van de Kamp, Attorney General for the State of California for her outstanding and dedicated work in the prevention of drug and alcohol abuse, and the commitment to the community of San Bernardino. This was presented by Marty Mercado, Chief, Officer of Community and Consumers Affairs, Office of the Attorney General. October 19, 1987 - Organized the kick-off for Red Ribbon Week "Say No To Drugs" in the City with the Mayor and Common Council at City Hall where the Mayor presented to San Bernardino Community Against Drugs, Inc. a Proclamation to the City of San Bernardino. Over 75 high school peer counselors attended as well as San Bernardino High School Band played in City Hall to start the efforts of this community in saying no to dr~gs. Local drug agencies and the community were invited. October 23, 1987 - Participated in the County School Intervention/Prevention Training Workshop where over 170 people were in training for a week-long seminar. October 25-31, 1987 - RED RIBBON WEEK .SAY NO TO 5' DRUGS" - Through the efforts of the San Bernardino Community Against Drugs, Inc. and the County Office of Drug and Alcohol Programs, many events were organized during the entire Red Ribbon Week. Included in these events were the elementary, junior high and high school~, colleges, libraries, businesses, government, churches and many citizens. Over 10,000 red ribbons, 5000 "Say No To Drugs" buttons, posters, bumper stickers and information were distributed from the office of San Bernardino Community Against Drugs, Inc. to the local communi ty. - October 27, 1987 - Donated $300 to Aquinas High School for a national anti-drug speaker (Joseph Jennings) during Red Ribbon Week. The speaker was available to the entire high school student body. October 29, 1987 - Jerilyn Simpson received an award on behalf of San Bernardino Community Against Drugs, Inc. at the Teen Theatre Rally held at San Bernardino High School, from the San Bernardino City Unified School District and Peer Leadership Program for the dedication and commitment in the Prevention and Intervention of Substance Abuse in our schools (public and private) and community. November 8-10, 1987 - Was invited to participate in the White House Conference for a Drug Free America in Los Angeles and to attend the wrap-up conference in Washington, D. C. February 28-March 3, 1988.. November 14, 1987 - Provided drug information to the Homespun Bazaar at the Village Auditorium - Arrowhead Springs (International Headquarters of Campus Crusade for Christ) . January 19, 1988 - Co-sponsored a Drug Awareness Clinic with the Elks Lodge #836 from 7:00 to 9:00 p.m. where different drug paraphernelia was on display. Speakers were present from the Sheriff's Department and the San Bernardino Community Hospital Care. Unit. February 13, 1988 - Co-sponsored a Special Women's Conference on "Substance Abuse" at San Bernardino Valley College from 8:00 a.m. to 5:00 p.m. with the San Bernardino County Office of Alcohol and Drug Program and the Riverside County Drug Team/Riverside County Alcohol Control Program. February 23, 1988 - Donated $1,000 to the San Bernardino City Unified School District to help sponsor 150 students to the Peer Counselors Training-to be held in San Francisco in April of this year. (This donation was made possible with the money 6 given to our organization from the proceeds of the Homespun Bazaar at the International Headquarters of Campus Crusade for Christ. ) March 8, 1988 - ~rganized with the Matrix Center an "Amphetamine Awareness" press conference at the San Bernardino City Hall which included information on the "Impact of Illicit Methamphetamine on the City of San Bernardino"; "Amphetamine Production - Target San Bernardino County"; "The Challenge to City and County Law Enforcement"; and "Recognition and.Treatment of the Typical Amphetamine User in San Bernardino County". This panel included government and law enforcement from the City and County, as well as community and medical input. March 8, 1988 - The revised Communicator/Student Awareness System MENU was released to the public. This Communicator offers taped information concerning drugs, alcohol, aids and emotional concerns. This is a 24 hour a day service from any touch tone telephone. This new list consists of 65 computer taped messages. The new menus are available by calling the office of SBCAD at 885-0509 or 889- 3565 or the San Bernardino City Unified School District office at 381-1167. February 22 and March 12, 1988 - Taped a 30 minute interview with KMEN/KGGI radio station regarding San Bernardino Community Against Drugs, Inc. and the "Spring Training Program" scheduled for March 21-23rd. These programs were aired on their" Viewpoint" program. March 13, 1988 - Mailed out 2,220 copies of the March Newsletter which included a flyr with the information about the "Spring Training Program" for parents scheduled for March 21-23rd. The newsletter printing was donated by Victory Press and the binding and mailing was donated by Roger's Binding 8< Mailing. March 17, 1988 - Co-sponsored with the San Bernardino City Unified School District a parent meeting regarding Eating Disorders. This was presented by the San Bernardino Community Hospital. March 21, 22 and 23, 1988 - Sponsored and . organized a "Spring Training for Parents" - How to Prevent Drug Abuse! This was held at the Feldheym Library Lecture Hall from 6 to 9 p.m. all three nights. This was a free seminar to the publiC along with free baby sitting by the peer counselors. The presentation was given by Loretta Middleton who also used students (former drug users) to give their testimonies. 7 March 30, 1988 - Donated $1,000 to the Elks Lodge #836 to provide more LISTEN TO MEt coloring books that are being distributed in all elementary grade schools in the community to provide drug information to the kindergarten through 5th grade students. This book was approved by the school board. March 30, 1988 - Board approval was given to authorize a donation in the amount of $1,180 to send four students from Shandin Hills School to the Youth to Youth 1988 Western States Conference for Drug Free Youth, (My Choice...A Drug Free Celebrationl") August 1-5 at the Claremont McKenna College in Claremont, CA. This conference will celebrate a renewed future and commitment toward a Drug Free lifestyle. The five day conference trains teens and adults to work together in designing positive prevention programs that really work. It is an action packed, fun filled yet informative week that will equip all participants with specific skills to start and support drug free youth groups. April 5, 1988 ~ Mayor Evlyn Wilcox and Jeri Simpson were interviewed by Chuck Palmer for the "Dialogue" show regarding the program and accomplishments of San Bernardino Community Against Drugs, Inc. This will be aired May 25th and May 31st on the local KVCR-TV station. April 15, 1988 - Board approval was given to make a donation to five local high schools in the amount of $100 each to be awarded as a scholarship to the top peer counselor for their commitment to remain drug-free and to show them our appreciation of their efforts to work towards positive self-development and to help others individually, in groups and in crisis. These will be awarded on May 31, 1988 at the Peer Counselor Awards Banquet to be held at the Elks Lodge. April 15, 1988 - Arranged for a drug and alcohol message and advertisement for our County Resource Center to be printed in all San Bernardino County Sample Ballots for the election of June 7, 1988. May 17, 1988 - Coordinated and sponsored a "Safe . At Home - Not Out On Drugs" mini-drug clinic with the Spirit Baseball Club and the San Bernardino City Unified School District for 2,300 sixth (6th) grade students. The teachers were in attendance from the respective classes as well as volunteers. Presentations were given by the Sheriff's Color Guard, K-9 Dogs, treatment physician, former drug users, baseball players, Mayor, Superintendent of Schools, Spirit 8 Manager, Counselor and DARE Officers. Lunch was served as well as each student received a Spirit Baseball team picture and a Pledge card to remain drug and alcohol free. . May 18, 1988 - Organized a Parent Coalition Meeting to start a support group for concerned parents. May 24, 1988 - A team of nine participants from the community attended the California Attorney General's Challenge to Prevent .Youth Drug Abuse - "A Continuing Commitment to Action" seminar in Burbank, CA. May 25, 1988 - Sponsored a Peer Counselor to the 2nd Annual Peer Helpers Association Conference in Ft. Collins, Colorado, by donating $210.00 to cover the registration fee. May 31, 1988 - Supplied all San Bernardino Police Department substations with Communicator/Student Awareness System menus. June 13, 1988 - Received a special recognition award from the United States Conference of Mayors as one of the communities recognized for Partnerships for Drug Control of our city's effort to control drugs through public/private partnerships and activities involving volunteers. June 15, 1988 - Started coordinating local communities to be involved with promoting the National Campaign for RED RIBBON WEEK, October 23-30, 1988, by wearing and displaying red ribbons as a symbol of commitment to healthy drug-free lifestyles as well as developing programs and activities throughout the week. The theme this year is "The Choice For Me - Drug Free." June 28, 1988 - Organized a group to co-sponsor monthly (P.A.W.S.) Parent Awareness Workshop Seminars starting in October, 1988 through March, 1989. These will be held on the first and third Thursday of each month and are free to the communi ty. July 17, 1988 - Held the second annual "Mark Harmon Celebrities" vs. "San Bernar~ino Notables" exhibition game with the San Bernardino "SPIRIT" baseball team in promoting "Say No To Drugs" week. Drug information was made available to the community in attendance. Over $2,000 was raised from this event. August 10, 1988 - Participated in the second annual Ronald McDonald Safety Show held at the Norman Feldheym 9 Library and distributed drug andaloohol information to over 250 ohildren, as well as teaohers and parents. August 18, 1988 - Purohased "The Prevention Projeot" program to be implemented ~y the looal YMCA organization for their youth. August 18, 1988 - Co-sponsored with the Spirit Base- ball Club the Premiere of "Stealing Home" movie as a thank you to the community for their support of San Bernardino Community Against Drugs, Inc. . September 24, 1988 - Organized and sponsoring a F. A. D. (Families Against Drugs) conference at San Bernardino Valley College. Drug informational awareness workshops will be available for all ages of the family. Peer counselors will provide child care as well.. The cost of this is free to all those who want to learn. Since March, 1988, over 18,700 Communicator/Student Awareness System menus have been distributed throughout the community from the office of San Bernardino Community Against Drugs, Inc. Over 2,000 calls have been received to date which is approximately an average of 660 calls per month. Throughout this past year, presantations regarding San Bernardino Community Against Drugs, Inc. have been made to service clubs and local organizations, as well as meetings with the San Bernardino Common Council to update them on the work that is being done by this organization for the community. Those presentations reach the community in the form of special programs aired by the local cable access television station.
