Description: Santa Depot Parking Structure (GB04-19) Finance: 200;>- 36'1 Agenda Item No. UJ '1,/'i ,()S CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution approving Amendment No. 2 to the Agreement for Professional Services with Transtech Engineers, Inc. to provide Program Management Services for the Santa Fe Depot Structure Project (GB04-19) formerly referred to as the Santa Fe Depot Parking Structure. Background: On November 7, 2005, the Mayor and Common Council adopted Resolution No. 2005-370 approving an Agreement for Professional Services with Transtech Engineers, Inc. in the amount of $586,000 to provide program management services for the Santa Fe Depot Structure Project (GB04-19). The term of the Agreement was for a period of 36 months, but it can be extended upon written agreement with both parties. On December 17, 2007 the Mayor and Common Council adopted Resolution No. 2007-477 approving amendment No. I to the Agreement for Professional Services with Transtech Engineers, Inc. increasing the contract amount by $10,225 for the purpose of designing the relocation of a waterline for the Santa Fe Depot Structure Project. Caltrans recently imposed a requirement on the environmental process to provide an Air Quality Analysis and Report. Staff protested the requirement because the project will obviously contribute to improvements in air quality and the report would be an unnecessary expense. However, Caltrans has refused to process the project further until the air quality analysis and report is approved by their environmental section. Transtech has provided a proposal to obtain the Air Quality Analysis and Report and coordinate submittal to Caltrans for a fee of $14,200.20. The specialty firm of Mestre Greve Associates will perform the work under subconsultant contract with Transtech Engineers. Transtech Engineers will be responsible for managing and coordinating the work of Mestre Greve Associates. The original agreement with Transtech Engineers, Inc. expires on November 7, 2008. Transtech's services will continue to be needed through the design and bidding process that is planned to be completed by June 30, 2009. Therefore, staff recommends that the Agreement with Transtech Engineers, Inc. be extended to June 30, 2009. Additionally, Transtech's contract calls for them to perform Program Management duties during the construction phase of the project. An additional extension of time to Transtech's Agreement will be considered at the time of Contract award. Based on the current schedule, construction is anticipated to commence by July 1,2009 and be completed by June 30, 2010. 2 08/21/08 . CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT (CONTINUED) Financial Impact: Funding for the parking structure is allocated in Account No. 242-362-5504-7576 in the FY 2007/08 Budget in the total amount of $11,563,800 of which $7,138,900 is from Congestion Management and Air Quality (CMAQ) funds reimbursable from the Federal Highway Administration (FHW A) and $4,424,900 in Local Transportation Funds (L TF) from SANBAG. Transtech's contract to provide program management services is currently $596,225. This amendment would increase the contract by $14,200.20 for a total not-to-exceed cost of $610,425.20. Adequate funding is available in Account No. 242-362-5504-7576 to cover the cost of this Amendment. The project proposes a five- level parking structure to serve the Metrolink Station at the Santa Fe Depot location, which will include construction of reinforced concrete, 11,354 square foot parking structure accommodating approximately 350 vehicles. The project includes lighting, fire safety, elevators, and ADA access facilities, on-site landscaping, concrete sidewalks; and driveway access to and from Metrolink Station at 1170 West 3" Street. Mestre Greve Associates, a professional engineering firm incorporated in 1981, is committed to improving quality of life by providing its clients with the means to ensure that air quality levels and noise are within acceptable community limits. We have completed several air quality assessments for Caltrans. The air quality assessment requirements have changed substantially in the last few years. A firm that is not up to date with the Caltrans requirements will waste time and money in preparing the necessary documents. Mestre Greve Associates has 'been very active in recent years preparing air quality studies for Caltrans projects. Recent projects include the 1-405 HOV Lane Addition through the Sepulveda Pass, the 1-405/SR-IOl Interchange Modification, and the 1-215/SR-74lnterchange. The project will be utilizing Federal Aid funds, and therefore, are subject to the Transportation Conformity Requirements of the Federal Clean Air Act as weH as NEP A and CEQA. The Air Quality Technical Report will be prepared to satisfy these requirements per Caltrans and FHW A guidance. In addition to the Air Quality Technical Report, we will prepare and submit the documentation required to obtain a determination that the project is not a Project of Air Quality Concern (POAQC) from the SCAG Transportation Working Group (TCWG) and the documentation required for the Project Level Conformity Determination as described below. Fax (949) 349-0679 Metrolink Parking Structure Page 2 Scope of Work Task 1 - SCAG TCWG POAQC Determination Based on FHWAlEPA guidance on Particulate Matter (PMIO and PM2.s) hot-spot impacts, it appears that the project is not considered a POAQC and will not require an analysis of potential PM hot-spot impacts. This determination must be confirmed by SeAG's TCWa. The TeWa has developed a form that must be completed with applicable project data. Projects are considered at their monthly meeting (fourth Tuesday of each month) and determinations are made. We will prepare and submit the required form to the TCWa and be available via telephone during their meeting to respond to any questions. Our costs, presented below assume that the project will be found to not be a POAQC. If this is not confirmed by the Tcwa we will discuss with you the best way to proceed. Task 2 - Air Quality Technical Report An air quality technical report will be prepared with the following content. The existing air environment will be described in terms of meteorology, local topography affecting pollutant dispersion, and ambient air monitoring data. A summary of current air management efforts and regulations. which may be related to the proposed project. will be identifIed. Sensitive receptor areas within the project vicinity will be identified. As a signalization project, the project is exempt from the Regional Transportation Conformity Requirements but is still subject to the analysis of local "hot-spot" impacts. The potential for the project to result in a local CO hot-spot impact will be addressed per the Caltrans eo Protocol. The fact that the project is not a POAQC and will not result in a local PM hot-spot impact will be discussed. Mobile Source Air Toxic (MSAT) impacts will be discussed based on the guidance published by the FHWA at http://www.fhwa.dot.gov/environmentlairtoxic/020306guidmem.htm. Potential impacts due to Diesel Particulate Matter and Naturally Occurring Asbestos will be discussed as well. Task 3 - Air Quality Conformity Documentation As part of the SAFETY -LV NEPA delegation, Caltrans must request an air quality conformity determination from the FHW A separate from the environmental review process. The FHW A has prepared a checklist for Section 6004 projects that will be completed and submitted with the air quality technical report. We will complete the checklist and provide the necessary supporting documentation. #-~ . Metrolink Parking Structure Page 3 Costs - We propose to prepare air quality technical study and conformity documentation for the Metrolink Parking Structure project on a time and materials basis with a cost not to exceed $12,348 _ Our costs are broken out by task in the table below. Our hourly rates are $180 for Principals, $160 for Associates, $90 for Staff Engineers, and $65 for Technicians. Once we receive the necessary materials and authorization to proceed we will turnaround the report in 2 to 3 weeks. The timing of the report will be slightly dependent on the meeting date of the TCWG. Our cost assumes three revision cycles (Le. submittal of three drafts and one final) for the technical report and conformity documentation. The project proposes a five- level parking structure to serve the Metrolink Station at the Santa Fe Depot location, which will include construction of reinforced concrete, 11,354 square foot parking structure accommodating approximately 350 vehicles. The project includes lighting, fire safety. elevators, and ADA access facilities, on-site landscaping, concrete sidewalks; and driveway access to and from Metrolink Station at 1170 West 3'" Street. We have completed several air quality assessments for Caltrans. The air quality assessment requirements have changed substantially in the last few years. A fIrm that is not up to date with the Caltrans requirements will waste time and money in preparing the necessary documents. Mestre Greve Associates has been very active in recent years preparing air quality studies for Caltrans projects. Recent projects include the 1-405 HOV Lane Addition through the Sepulveda Pass. the 1-405/SR-IOI Interchange Modification, and the 1-215/SR-74 Interchange. The project will be utilizing Federal Aid funds, and therefore, are subject to the Transportation Conformity Requirements of the Federal Clean Air Act as well as NEPA and CEQA. The Air Quality Technical Report will be prepared to satisfy these requirements per Caltrans and FHW A guidance. In addition to the Air Quality Technical Report, we will prepare and submit the documentation required to obtain a determination that the project is not a Project of Air Quality Concern (POAQC) from the SCAG Transportation Working Group (TCWG) and the documentation required for the Project Level Conformity Determination as described below. Fax (949) 349-0679 Metrolink Parking Structure Page 2 Scope of Work Task 1 - SCAG TCWG POAQC Determination Based on FHWAlEPA guidance on Particulate Matter (PM,. and PM2.5) hot-spot impacts, it appears that the project is not considered a POAQC and will not require an analysis of potential PM hot-spot impacts. This determination must be confirmed by SCAG's TCWG. The TCWG has developed a form that must be completed with applicable project data. Projects are considered at their monthly meeting (fourth Tuesday of each month) and determinations are made. We will prepare and submit the required form to the TCWG and be available via telephone during their meeting to respond to any questions. Our costs, presented below assume that the project will be found to not be a POAQC. If this is not confumed by the TCWG we will discuss with you the best way to proceed. Task 2 - Air Quality Technical Report An air quality technical report will be prepared with the following content. The existing air environment will be described in terms of meteorology. local topography affecting pollutant dispersion, and ambient air monitoring data. A summary of current air management efforts and regulations. which may be related to the proposed project. will be identified. Sensitive receptor areas within the project vicinity will be identified. As a signalization project. the project is exempt from the Regional Transportation Conformity Requirements but is still subject to the analysis of local "hot-spot" impacts. The potential for the project to result in a local CO hot-spot impact will be addressed per the Caltrans CO Protocol. The fact that the project is not a POAQC and will not result in a local PM hot-spot impact will be discussed. Mobile Source Air Toxic (MSA T) impacts will be discussed based on the guidance published by the FHWA at http://www.fhwa.dot.gov/environmentlairtoxic/020306guidmem.htm. Potential impacts due to Diesel Particulate Matter and Naturally Occurring Asbestos will be discussed as well. Task 3 - Air Quality Conformity Documentation As part of the SAFETY -LV NEP A delegation. Caltrans must request an air quality conformity determination from the FHW A separate from the environmental review process. The FHW A has prepared a checklist for Section 6004 projects that will be completed and submitted with the air quality technical report. We will complete the checklist and provide the necessary supporting documentation. Metrolink Parking Structure Page 3 Costs We propose to prepare air quality technical study and conformity documentation for the Metrolink Parking Structure project on a time and materials basis with a cost not to exceed $12,348. Our costs are broken out by task in the table below. Our hourly rates are $180 for Principals, $160 for Associates, $90 for Staff Engineers, and $65 for Technicians. Once we receive the necessary materials and authorization to proceed we wi\1 turnaround the report in 2 to 3 weeks. The timing of the report will be slightly dependent on the meeting date of the TCWG. Our cost assumes three revision cycles (i.e. submittal of three drafts and one final) for the technical report and conformity documentation.
