Staff Report
SUBJECT:
Resolution establishing right of way boundaries for Orange Show Road between the Gage Canal
and Tippecanoe Avenue.
BACKGROUND:
On April 8, 1993, Resolution No. 93-97 was adopted authorizing the execution of an Agreement
with David Evans and Associates for right of way acquisition relative to the extension of Orange
Show Road, between Arrowhead Avenue and Tippecanoe Avenue. Some of the properties
acquired were in the form of an easement only for right of way purposes, and some of the
properties were acquired in fee. Specifically, the portion of Orange Show Road between the
Gage Canal and Tippecanoe Avenue was acquired in fee.
Southern California Edison recently contacted the City and requested an easement across this
portion of Orange Show Road to provide service for the industrial development north of this
area. As a result, it was noted that this portion of Orange Show Road, although owned by the
City, had never been established as public right of way. The attached resolution establishes the
two parcels acquired for this portion of Orange Show Road as public right of way, and will allow
utilities to locate within the right of way without the need for separate easements, subject to the
normal permit process.
FINANCIAL IMPACT:
None.
RECOMMENDATION:
Adopt Resolution.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING RIGHT
OF WAY BOUNDARIES FOR PUBLIC RIGHT OF WAY PURPOSES FOR ORANGE
SHOW ROAD ACROSS CITY OWNED PROPERTY LOCATED BETWEEN THE GAGE
CANAL AND TIPPECANOE AVENUE.
WHEREAS, the City of San Bernardino is the owner of that certain real property generally
located between the Gage Canal and Tippecanoe Avenue, and more fully described in Exhibit "A",
attached hereto and made a part hereof, and as depicted on a plat attached hereto as Exhibit "B"
and made a part hereof; and
WHEREAS, portions of said real property were acquired through Grant Deed recorded
on March 27,1997 as Document No. 19970106431 and by a Judgement in Condemnation, recorded
on April 10, 1998 as Document No. 19980136114, records of the County Recorder of San
Bernardino County, State of California; and
WHEREAS, said real property was acquired for the purpose of establishing and
constructing a public right of way, known as Orange Show Road.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the right of way boundaries for Orange Show Road across City owned
property, between the Gage Canal and Tippecanoe Avenue are hereby established as described in
said Exhibit "A", and as shown on said Exhibit '~B", and that the same is set aside for public right
of way purposes.
SECTION 2. That the City Clerk is hereby authorized and directed to cause a certified
copy of this Resolution to be filed with the County Recorder's office of San Bernardino County.

recorded on March 27, 1997, as Document No. 19970106431, and in a Judgement in
Condemnation in the Superior Court of the State of California, County of San Bernardino, Case
No. SCV -35996, recorded on April 10, 1998 as Document No. 19980\36114, all in the Official
Records of San Bernardino County, State of California, described as follows:
Those portions of Parcel 3 and Parcel 4 of Parcel Map No. 5481, as per plat thereofrecorded in
Book 58 of Parcel Maps, Pages 93 and 94, in the Office of the County Recorder of said County,
described as follows:
Beginning at the northeast corn~r of said Parcel 4; thence southwesterly, along the northerly
line of said Parcel 4, the following courses and distances:
South 620 20' 31" West (recorded as South 61048" 17" West), a distance of 36.40 feet
