Backl!round: Elections Code Division 15, Chapter 4 (Official Canvass), Section 15372, requires that a certified statement of the results of an election must be submitted to the governing body within 28 days of an election. The County Registrar of Voters conducted a Special Municipal Election July 12, 2011, to fill the vacant Second Ward Council seat. The Registrar of Voters issued the certified Certificate of Registrar of Voters on July 15,2011. San Bernardino City Charter, Section 11, and San Bernardino Municipal Code Section 2.56.130B provide that the next regular or adjourned regular Council meeting following the completion of the canvass, the Mayor and Common Council shall declare the results of the election as official. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL 3 MUNICIPAL ELECTION HELD ON THE 12TH DAY OF JULY 2011, DECLARING 4 THE RESULTS THEREOF AND SETTING FORTH SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. 5 6 7 8 9 10 11 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: WHEREAS, a Special Municipal Election was held and conducted in the Second Ward in the City of San Bernardino on the 12th day of July 2011; and WHEREAS, notice of said election was duly and regularly given in the time, form and 12 manner as provided by law; voting precincts were properly established; election officers were 13 appointed and in all respects said election was held and the returns made and declared in the 14 time, form, and manner as required by the provisions of the Charter of the City of San 15 Bernardino and the Elections Code of the State of California for the holding of public 16 17 18 elections in the City of San Bernardino; and WHEREAS, pursuant to Resolution No. 2011-62, adopted on March 7, 2011, the 19 Registrar of Voters of the County of San Bernardino canvassed the returns of said election and 20 21 has certified the results to this City Council and said results are received, attached and made a part hereof as Exhibit A. 22 23 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Common Council of the 24 City of San Bernardino as follows: 25 26 27 III 28 That pursuant to Resolution No. 2011-62, the Special Municipal Election was Section I: conducted by all mail ballot. 1 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL 3 MUNICIPAL ELECTION HELD ON THE 12TH DAY OF JULY 2011, DECLARING 4 THE RESULTS THEREOF AND SETTING FORTH SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. 5 6 Section 2: That said Special Municipal Election was held for the purpose of filling 7 the vacant Second Ward Council Seat. 8 9 10 11 12 Section 3: That the grand total of all votes cast in said election was 1,582.
