PROVIDING FOR A CHARGE TO BE MADE FOR 7HE REMOVAL
ATM DISPOSAL OF SAH GARBAGE AND WASTE MATTER
DEFINING THE KEEPING OF GARBAGE, MA= AIM WASTE
1ATTER IN VIOLATION OF THIS ORDIYANCE TO BE A NUISANCE
AITD FIXINIG THE PENALTY FOR 111E VIOLATION OF SUCH
ORDINANCE
That Mayor and Conmon Council of the City of ,San
Bernardino, do ordain as folllows:
Section I. The City of San Bernardino, its duly
authorized agents, servants and employees, shall have
the exclusive right to gather and collect garbage with-
in said City , and it shall be unlawful for any person,
firm or corporation, excepting as herein other -arise ^
provided in this ordinance , to collect or gather
garbage within said City
Section 2: For the purpose.of this ordinance the
word' garbage' shall be held to include and mean
kitchen and table refuse and offal, swill and every
imiu��t<i1� of animal, vegetable and other matter' that
attends the preperation, consumption, decay or $^1in
or storage of. meats, fish, fowl, birds, fruit or vegetables
( excepting that dead animals are not to be construed
.as being included within said term
The term t waste matter' 9 shall include and be held
to mean broken crockery , broken bottles , broken. bricks

tin vessels , trimming S, from lawn and flower gardens,
ashes , pasteboard boxes , berry boxes , paper, straw,
sawduwt , packing material , shavings, boxes, street
.sweepings, tins , wire and all other combustible and non-
combustible waste matter, providing that the term ' waste
matter' an herein used shall not include or extend to
street sweepings or combustible or non-combustible waste
matter under public control and removed by other agents of
said City .
C Section
The term ' manure' shall include all stable clear -
the excrement of horses , mules , burro, cows
and cattle .
Section III. All ' garbage' accumulated or that
shall hereafter accumulate at any store, store room,
place of business , private dwelling house or residence,
or other place within the City of San Bernardino shall
be removed by the City of San Bernardino, its agents,
servants or employees at regular intervals of twice aack
week ( or oftener, at the request of the tenant , occupant,,
or lessee of such place ) and must be taken to the City
garbage ground, or other place hereafter legally establish4
and must be forthwith consumed and incinerated thereat to
an odorless ash, or otherwise disposed of to the datis-
fact ion of the Board of Health of said City ,
Section Ili. All ' waste matter' ,accumulated or that
shall hereafter accumulate at any store, store room,
place of business , private house or residence, or other
place in said City shall be removed by the City of San
Bernardino , its agents , servants, or employees at regular
untervals of twice each month ( or oftener , at the request

of the tenant , occupant or lesse of such place,, )
and must be taken to the City garbage ground or other
place hereafter legally established ; and all' combustible
matter must forthwith be consumed and incinerated to an
odorless ash, and all non- combustible matter must be
immediately deposited upon said dumping ground in such
manner that the same shall not constitute or become a
nuisance
Section V. All garbage accumulated shall be kept upon
the premises in =x receptacles , which receptacles shall
be of galvanized iron or metal with a closed fitting
cover, and shall be of sufficient size to hold all garbage
that shall accumulate at such place between he times when
the same shall be removed I
Section �: Each person, firm or corporation engaged in
business or residing in the City of San Bernardino shall
pay the following sums to said City its agents, servants
or employees for removal of ' garbage' and waste matter,
to wit: ^
For removal of all garbage from
each hotel having twenty rooms or more
permonth......................................1.50
IWJ*each hotel, having mpre than ten, and
less than twenty rooms , per month............. .1.00
From each hotel, having less than ten rooms
per month., .. .................................. .75
From each butcher shop, fruit market , fish
market , or other place or business where
garbage accumulates , per month , .............. .75
From each apartment house containing ten or
families , ( providing the garbage in such
apartment house us placed in one receptacle)
. Per month . 81.00

For the removal of 'waste matter'- the following
sums shall be paid , to wit:
From each store or place of business within the
City :of San Bernardino , per month, 01.00
From each other place , per month, .50
provided , however ij that no charge shall be made
for the removal of'waste matter' from any re-
sidence or place rer._uird.d to pay for the re-
moval of garbage hereunder .
Section V11. No person , firm or corporation shall
allow or permit any manure to accumulate, be or
remain for a longer period than two days , in or
about any or stables , except the same be kept A
in a tight box with4 cover, so constructed that flies
and insects cannot get or have access thereto ; nor
allow or permit m3t.nure to accumulate , be or remain
in piles, at any other place , within ;n, hundred
feet of any house or structure occupied by human
beings
Section VIIL. No person , firm or corporation ,
shall haul, remove or carry away any garbage through,
over or upon any public street or alley in the City of
San Bernardino unless the same be contained in a water
tight or matallic wagon, having a tight fitting wood-
en or metallic covers and being so constructed
as to prevent any garbage falling , leaking or spilling
therefrom , and to prevent , as far as possible,
the escaping of odor. Each wagon shall be thoroughly
cleaned at least once each day , immediately after its
being used ; and no garbage shall be Hauled or conveyed
through ) over or upon any of the public streets or

alleys in said City between the hours of 8:00 A.M*
and 6:00 P. 11. of the same day
Section VI.XI. Each and every wagon used for the
removal of garbage or waste matter shall have
printed thereon in large letters the wvlds
CITY GARBAGE". and each person employed in driving or
collecting garbage shall wear a badge with the
words " GARBAGE COLLECTOR" thereon .
Section ;'�. The mayor and Common Council of the
City of San Bernardino do Yee reby find declare and
determine that the accumulation of garbage and waste
matter in and about places. of business storest
dwellings , and residences in said City and the accu-
mulation of manure has become and now is a public
nuisance ; and has become and is dangerous to the
inhabitants of said City ; and has become and is an.
obstruction to the free use of property in said City.,
so as to interfere with and prevent the comfortable
enjoyment of life and property Jm of a considerable
number of persons , residents of said City .
Section IL The City of San Bernardino shall provide
a suitable place to be known as the City garbage Ground,
to ka which place xkz11 all garbage and waste matter
herein provided to be removed shall be taken and
disposed of in the manner herein provided .
Section XIS. The Board of p'ealth shall provide all
necessary rules and regulations for tlie carrying into
effect and force this ordinance
Section XIII. The llayor and Common Council of the
City of San Bernardino shall awmal y advertise f o r bids
for the removal and disposal of garbage in the City of

San Bernardino, which contract shall be let to -h e
person who will make the best bid or offer for
such privileges and no other person other than the
person to whom suhh contract is awarded shall
cdllect gather or remove garbage for hire within
the City of San Bernardino, during the time such
contract is in force, and the person to whom such
contract is awarded ^shall be required tp enter
into a good and sufficient bond , in the sum of
One Thousand ( '�11000.00 ) Dollars payable to
the City of San Bernardino for the faithful perform-
ance of tk his contract .
Section XI-Y,. The amounts herein fixed for the
removal of garbage and waste utter shall become
due and owing to the person removing such garbage and
waste matter at the end of each calander month, and
may be collected by suit or otherwise
Section XV* It shall be unlawful for any person ,
firm or corporation to allow to accumulate in or upon
his or its premises any garbage a unless the same
be kept in receptacles and removed as herein provided
Section XVL Any person firm . or corporation
allowing or permitting. any gt rbag a o` waste matter
to accumulate or be upon his or its premises or
upon premises occupied or controlled by him or it
in violation of this Ordinance , after receiving notice
to remove the same from the T;eaith O:.Pficer y shall be
guilty of maintaining a public nuisance ,and each day
that such garbagJ^o waste matter is allowed or per-
mitted to remain upon said rrem.ises after such notice
shall constitute and be a separate offense.

Section XV71. Any person , firm or corporation violat-
ing any of the terms of conditions of this Ordinance
shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be punished by a fine not
exceeding One Hundred ( $100.00) Dollars , or by
pubishment not exceeding ninety (90) days or by both
such fine and imprisonment , in the discretion of
the Court
Section XVIII. This ordinance shall take effect afid
b e in f o rc e f r om and of t er thi rty day s of t er i is
adoption and aaproval .
Section Xf)(:� . The City Clerk shall certify to the
adoption of this ordinance and cause the same to be
published for three days in The Evening Index .
I hereby.certify that the foregoing ordinance was
adopted by the Mayor and Connon Council of the C ' ty
of San Bernardino at its meeting held on the
day of _ 1 19101 by the following vote ,
