The board of health ghall nominate a suitable person as heal th ot'ficer and 'the board of city t..'Y11stee:3 may in itM dincretion , either reject Buch nomination or declare such person duly elected as health officer of the city of San Bernardino. Sec. 2. The healtl1 officer shall be the execu'tive officer of the board 0 f health. It 8hall be tho duty of the leal th officer, under the direction of and contrel of the board of health, to enforce all laws, ordinances, and regulations relath1ts to caUl.lea ot sickneiis, nuisances and sourcesof filth existing within :.laid city. f'I 3 ,:>9C. . The heal'th officer shall receive $35.00 per month as full compensation for all his services as such officer9 (' ... c,>eo. "3:'. 'rhe health officer shall keep a record of all birth:;, deaths and interments eccuring in the city. He must keop in hi- office a book in which he must make an entry 0 f' all fosa c.llected by him, the amount thereof, by whom, for what paid, paid all :eees collected by him inte the city treasury te the credit 0 r the r;eneral fund. Sec. o. The health atficer shall, on or before the first Monday in each month, file with the city clerk a monthly s'ta'tement of all services performed by him in his official capacity during the preceding month 01' time; all fees collected by him , the amount thtreef, l)y whom and for what purpose pand, and an account af all money paid out by him in h:ts official capacity. Said report shall be accompanied by a re- ceipt of the treasuror of all fee~ collected by him. Sec. 6. Whenevor it shall be ccrltified to the board of health by the health 0 fficer that any building or part there. f il unfit for hu- man habitation by reallon of its being so infected with disease us likely to caUlSe sickness among the occupants, and by reason of its want er re- pair has become dangerou:3 to life, said health officer may issue an 01'- Ei4HElRe@ der, with the approval 0 f the board 0 f health, and cause the same to be fixed or posted oonspieuously upon the building or part there- of, and to be served personally on the owner, a.gent, lessee or 0ccupant, if he can be found in this State, requiring all persens therein te vacate such building within ten day~ from th~ posting of Buch notice or ::ser- :~ vie" thereof. ~)uBh building or part thereof within ten days thereafter shall be vacated, or within such ahorter time not leas than twenty-feur hours as in said netice may be specified. Sec. 7. TI1e health officer may under tl1e direction of tile Board or Health, remove any person who is not a resident ot the city, and whe il known te be infected with any dangerous, contaigoue or infectious di- sease, to the peat heuse, when shall action 6hall be deJlmed necessary t& prevent the spread of ffilCh disease, and when such removal can be made without danger to the life of suoh persen. Sec. 8. Whenever a nuisance endangering, in the opiniel1 of the health officer, the public kealth may l)e ascertained to exist an any premisee, or in any h@use, or other place, in said oity, he ahall llojify in writing any person or persons owning or having c6ntrol of or a.cting or agent 0 f such premises h0110e or other place, te abate or remove suoh nuisances wi thin a reasonable time, to be stated in such native. Upon the neglect 0 f any owner or occupant or any agent e1' other persona having control of such houae, 01'" orther place witoihin said city, te c,mply with such notive, the health officer may abate such rruisance , and the owner agent or occupan) or other person having con- trel of such house or place, in addition to the penalty provided by thia ordinance, shall be liable to said city for 'the oeBts of such abatement to be recovered in a civil action in any court of compet811t jurisdiction in said city. Sec. II. No person or persons, except the physician, cler€,.,ymSJl or undertaker, and those having a written pnrmit from the health efficer shall enter or depart !'rem any houae where smallpex or cholera exists, or while the corpse of any person who shall have died af Huch disease remains within the house 1'l1rr within ten days thereafter, or until said building and its contents shall have been disinfected or otherwiBe dil- posed of to the satisfaction of the health t)fficer. Sec. I2. 1!vben the cause of death of any decaased person iu of a contagiOlw, infec't,i0us or pestilential diaease , the body 0 r' such de- ceased person ~ll be placed in charee of an undertaker, or other com- petent per13on, who f3ha11 thoroughly disinfect the same before it shall be placed in the ceffin, casket or other receptacle for burial, and the :Jame shall not be taken to any church or other public place for any pur- c~ 'v..t7 pose be fore burial. nor shall said hCO t'fin or receptacle be opened at aJJy time or for any purpose prIor to such burial, nor shall any person under the age of twenty years act a8 a pall-bearer at the runeral ef such de- ceased peraon. Sec. I3. ~Vhenever the death of any person shall be caused by small- pox, varioloid, cholera, or other disease cevered by seotion IO of this ordinance, the undertaker, 01" persen acting al slich shall net allowed the body 0 f GUch deceased persen to be taken to any building, public or private . other than that upon the premises where such death eccured, but shall privately convey the same the tile place of burial in some proper cemetery, between the hours of five o'clock in the evenil~ and Gaven o' clock in the ft>llowinr; morning, and bury the sarne therein wi theut any public funeral services whatever, unless it shall be otherwise directed by the haalth officers. Sec. I4. No privy, vault, cesspool or water closet shall be allowed by the owner or other person in charge 0 f the premises upon which the same may be situated, to become foul or offensive, and when, in the epin- ion of the health offioer, any $ueh privy, vault or closot or cesspool shall need cleaning or disinfecting, it shall be his duty t. notify eriloh twnsr or aUler person having control, to abate the same, by disinfecting or cleaning, a.s in the judgement of said officer may be prudent. Sec. I5. Sec. I6. It shall be the duty of every physician in the city to re- PQrt to ti1e health 0 fficer overy patient he may have laboring under Asia"tic cholera, dytheria, scarlet fever, smallpox or other dangerous contagious or infecitous di3ease, as 800n ala he shall become satisfied of the m ture at the disease, and to report to the 9atle orr-icer every case of death from $heb disease immediately after it shall have 6cGurred. Sec. I8. In cases of contagious or infectious disHase8 the fol1n- flags i3hall he hung in some conspicuous place on the residence;- Yel10w t~ag - Smallpox, cholera and yellow fever. The board of health are hereby ulltherized by and with the cenaent of the board of trustees, to establish a pest house or hospital whenever such action shall be deemed necessary, and previde the necessat 3Upplies 'therefor. Sec. 20. Any physician or other person neglecting or failing te COlI ply with the prQvhdonn 0r requirements of this ordianoe, and fmy phy- aician, undertaker, or other person, interferring with or ob3tructing the board 0f health or health officer in the discharge of the duties im- posed herein, or any persen whe shall violate any of the previBions of' this ordinance shall be punishable by fine not exceeding one hundred and eighty d()11ars, a.'1d costs of pDesecution, or by imprisonment in the city jail of San Bernardino city fer a period of net less than ten daYB nor mere than ninety days, or by both such fine and impriaonmont in the dis- cretion of the cGurt, Sec. 2I.
