and fixing the penalty of its violation.
The Mayor and Common COlli~cil of the City of
San Bernardino do Ordain as follows:

vinoBs, malt or otnAr intoxicatin~ liquors, or engage
in the business of keeping a saloon, bar, bar -room, dram~
shop, tippling house J restaurant, ea.ting house, hotel..
store or other lace where a..'1.y such spirituous} vinous} mar t
or other intoxicatine; liquors, a.re manufactured, sold,
furnished) or given away, without first having obtained
a license therefor as provided in this Ordinance; provid-
ine that this Ordinance shall not apply to the sule of
liquor by tho owners and proprietors of Drug storesj
or by their registered assistants, ~pon the presoription
of a regular practicing physician, Cr for medical or mech i-
cal purposes,

executed by the applicant with two or more sufficient
sureties, residents, and house~holders, or free~holdersJ
of the County of ~an Bernardino, State of California, pay.
able to the City of S~n Bernardino, approved by the 1~yorJ
eonditioned, if a license be granted, the applicant will
pay all lic~nEe tax, that ist or may ~hereafter be imposed
by law orOrdinanc,e of the said C'ity upon the business
proposed to be engaged in, so long as he shall con-
t inue the sa-rne; that he will keep a 'lU16t and orderly
place of business J a.nd upon any indicatio~l of any dis-
turbance of the ~ace therein, he will take immediate
action to prevent the same, and secure the arrest of all

Upon the filing of an applica.tion for a. license,.,
as herein IT ovided, the Common Council shall investigate
the question as to whether the person ~~king such appli-
cation ia a proper, sober and suitable person to carry
on ~nd conduct the place for which he requests a license,
and whtther the place described in such application is a
proper and suit9.ae;.place for such business; and unless it
shall appear to the satisfaction of said Common Council
that t.he appl i cant for said license is a suitable} sober
~~d proper person to carryon an1 conduct sucb business,

It is hereby made the duty of the license
collector of the City of San Bernardino, to collect all
licenses provided by this Ordinance; he shall re~eipt
for all moneys received for each license on the back there-
e~al'ld shall return.) on the first day of each and every
month, the amount call ected by him for the proceeding
month, and shall pajr the salue to the :~ity Treasurer and
receive his receipt therefor.
SECTION XIII-
It sball be unlawful for any person or persons
claimine to be a physioian to give a prescription for
intoxicatmr~ liquors to any pe?son except for~m~_ical
purposes} or to give any such pfescription for the purpose
of ev~aing, or assisting to evade any of the provisions 0 f
thia Ordinance.
