STAFF REPORT
Tbe Public Buildings Division, Parking Control Section
proposed increased bail scbedule for certain type parking
offences in San Bernardino, .ucb as blocking of sidewa~ks and
driveways, parking at red curb., and semi-trucks parking in
residential areas.
Detail justification back-up was submitted to tbe Legislative
Review Committee on Sept. 8, 1988, and the committee directed
the City Attorney to prepare the ordinance and amendments to
the Municipal Code. for adoption of the.e new propo.ed bail
schedule. a. a deterrent to these serious type offenders. *
Legislative Review Committee also recommended the elimination
of a volunteer HandicapPed Blue Crew concept since statistics
did not support this concept. It could subject the City to
excessive unjustified potential liabilities. The staff and
Legislative Review Committee recommend the adoption of the
changes to the Municipal Code and attached resolution.

and provide greater deterrence for viOlator.. These proposed

COde regarding this topic until after you review the City's
abandoned vehicle abatement program.
Because your personnel only have the power to cite parked or
stopped vehicle., they cannot stop .otorists and issue citations
for "operating" a motor vehicle. That power is reserved for law
enforcement officials.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
SUPERINTENDENT OF PUBLIC BULDINGS TO RECOMMEND TO THE SAN
3 BERNARDINO MUNICIPAL COURT INCREASES IN THE BAIL FORFEITURE
PENALTIES FOR CERTAIN PARKING VIOLATIONS LISTED IN THE MUNICIPAL

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor and Common Council authorize the
Superintendent of Public Buildings to recommend to the San

Bernardino Municipal Court increases in the bail forfeiture
penalties for the following parking violations listed in the
Municipal Code:
A. San Bernardino Municipal Code Section
10.16.020(A) prohibited parking in red
curbs, from $15.00 to $25.00.
B. San Bernardino Municipal Code Section

10.16.120 prohibited parking of trucks and
trailers in residential districts, from
$15.00 to $50.00.
