A total of four bids were received, ranging between $94,157.00 and $109,190.00. The low bid of $94,157.00 is 4.3% over the Engineer1s Estimate of $90,300.00. The contract documents were prepared to solicit prices for the Basic Bid and Additive Alternate. The four new poles for the infield were included in the Basic Bid, with the four poles in the outfield as the Additive Alternate. This method was selected, since it appeared the budget funds were not sufficient to finance the installation of all poles. Listed below is an estimate of the total project cost, based upon the actual low bid price for the Basic Bid. TOTAL ESTIMATED PROJECT COST $ 94,157 11,700 105,857 5,143 111,000 An amount of $117,090 has been allocated, under Account No. 121-544-57596, from the 1987/88 CDBG Program to finance the costs incurred for this project. There will be an estimated balance of $6,090 in this account. The low bidder submitted a price of $62,328.00 for the Additive Alternate. Therefore, supplemental funds in the amount of $56,238 will be needed to include the Additive Alternate in the contract. A recommendation has been made by the Department of Parks and Recreation that 4 of the 8 poles at the Colony Village Baseball Field (northeast corner of Barton Road and Hunts Lane) be removed and furnished to the Contractor at Fiscalini Field. The 4 re- maining poles will be sufficient to light the field, since there are no organized leagues using this facility. These poles are 80 feet in height, the same as those specified in the contract docu- ments. New lighting fixtures would be furnished and installed by the Contractor. We have met with the low bidder to negotiate a price re- duction for the Additive Alternate, due to the City furnishing the 4 poles at Fiscalini Field. The low bidder has agreed to a reduction in the bid price for the Additive Alternate of $20,000. We feel this is a fair and reasonable credit. Reduction of the bid price by $20,000 will decrease the required supplemental funds from $56,238 to $36,238. There is an available balance of about $25,000 in Account No. 121-544-57597, after construction of the handicapped ramps has been completed. Item No. 43, on the Council Agenda of 9-06-88, was authorization to close out the FY 1987/88 CDBG funded Hispanic Chamber of Commerce IIEmployment Preparedness II project, and the funds in the amount of $22,285.50 transferred to the CDBG Appropri- ated Reserve Account. This item was continued to 9-19-88. If this project is closed out, these amounts could be used to finance the necessary supplemental funds. We recommend that a contract be awarded to the low bidder for the Basic Bid. George Jugovic Construction Company is the lowest responsible bi~der for installation of ballfield lighting 7 improvements to Fiscalini Baseball Field, in accordance with 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Plan No. 7332, for the total amount of $94~157.00, .and a contract for the Basic Bid is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bids therefor are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party.
