OF SAN BERNARDI' , - REQUE T FOR COUNCIL ACl )N STAFF REPORT On 09-06-88, the Director of Public Works/City Engineer and the City Clerk were authorized to proceed with the creation of Underground Utility District No.18. At that same meeting, Resolution No. 88-342 was adopted, noticing a public hearing for 10-03-88, relative to the proposed Underground Utility District. The proposed creation of Underground Utility District No. 18 was approved by the City's Underground utility District Committee at their meeting of 06-09-88. Utility companies are required by Rule 20 of the Public Utilities Commission to set aside a certain portion of their revenues to finance the cost of undergrounding overhead facilities within districts created by local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead services within the agency's boundaries. The Underground utility Committee of that agency reviews and designates areas proposed for the creation of a district. No City funds will be required. There are no properties within the proposed district, that will require conversion. Underground Utilities improve the appearance of a street by removing visual clutter. Improving the streetscape promotes the mental well-being of persons driving or walking along such a street. Undergrounding eliminates the hazard from broken wires which result from violent windstorms or earthquakes, both of which are frequent occurrences in the area. 'ij.~ .fii ~ , , , ~ ~ 0::: ! ~ ',"Y' I I 1 Of/-IS" 8~ .... 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 18, GENERALLY LOCATED 3 ALONG 7TH STREET BETWEEN SIERRA WAY AND WATERMAN ~VENUE. 4 WHEREAS, a public hearing was held on the October 3, 1988, at the 5 hour of 10:00 a.m., at the Council Chambers, 300 North "D" Street, San 6 Bernardino, California, to determine whether the public necessity, health, 7 safety or welfare required the formation of Underground Utility District No. 8 18, located between the North lines and South lines of 7th Street, and 9 between the East line of Sierra Way and a line that is 340 feet, more or 10 less, West of the West line of Waterman Avenue ,San Bernardino, California; 11 and 12 WHEREAS, notice of such hearing has been given to all affected 13 property owners as shown on the last equalized assessment roll and to all 14 utilities concerned in the manner and for the time required by law; and 15 WHEREAS, such hearing has been duly and regularly held and all 16 persons interested have been given an opportunity to be heard; 17 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF 18 THE CITY OF SAN BERNARDINO, AS FOLLOWS: 19 SECTION 1. It is hereby found and determined pursuant to Chapter 20 13.36 of the San Bernardino Municipal Code of the City of San Bernardino. 21 and to definitions contained therein that the public necessity, health, 22 safety and welfare require the creation of an Underground Utility District, 23 for those public streets which are extensively used by the general public 24 and carry a heavy volume of vehicular traffic, in order to remove utility 25 poles, overhead wires and associated structures and to underground utilities 26 along said streets. 27 SECTION 2. SECTION 3. All poles, overhead wires and associated structures shall be removed and underground installations made underground utility district within the following times: a. Underground installation by utility companies and property owners and reconnections not later than November 30, 1969. b. Removal of poles, overhead wires and other associated structures not later than December 31, 1969. SECTION 4.
