ON STAFF REPORT On 09-06-88, the Director of Public Works/City Engineer and the City Clerk were authorized to proceed with the creation of Underground Utility District No. 17, University Parkway between the 1-215 Freeway and Cajon Blvd. At that same meeting, Resolution No. 88-341 was adopted, noticing a public hearing for 10-03- 88 , relative to the proposed Underground Utility District. The proposed creation of Underground Utility District No. 17 was approved by the City's Underground Utility District Committee at their meeting of 06-09-88 00. Utility companies are required by Rule 20 of the Public Utilities Commission to set aside a certain portion of their revenues to finance the cost of undergrounding overhead facilities within districts created by local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead services within the agency's boundaries. The Underground Utility Committee of that agency reviews and designates areas proposed for the creation of a district. No City funds will be required and there are no properties within this proposed district that will require conversation. Underground Utilities improve the appearance of a street by removing visual clutter. Improving the streetscape promotes the mental well-being of persons driving or walking along such a street. Undergrounding eliminates the hazard from broken wires which result from violent windstorms or earthquakes, both of which are frequent occurrences in the area. WHEREAS, a public hearing was held on October 3, 1988, at the hour of 10:00 a.m., at the Council Chambers, 300 North liD" Street, San Bernardino, California, to determine whether the public necessity, health, safety or welfare required the formation of Underground Utility District No. 17, located between the East and West lines of University Parkway, South of the Southerly line of the 1-215 Freeway and North of the Northerly line of Cajon Boulevard ,San Bernardino, California; and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and to all utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San Bernardino Municipal Code of the City of San Bernardino, and to definitions contained therein that the public necessity, health, safety and welfare require the creation of an Underground Utility District, for those public streets which are extensively used by the general public and carry a heavy volume of vehicular traffic, in order to remove utility poles, overhead wires and associated structures and to underground utilities along said streets. SECTION 2. UTILITY DISTRIC"" 'lO. 17 located between the East and West lines of University Parkway, South of the Southerly line of the 1-215 Freeway and North of the Northerly line of Cajon Boulevard, more particularly shown on Plan No. 7524 , on file in the office of City Clerk of the City of San Bernardino. SECTION 3. All poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times: a. Underground installation by utility companies and property owners and reconnections not later than November 30, 1989. b. Removal of poles, overhead wires and other associated structures not later than December 31, 1989. SECTION 4.
