Recommended motion: That authorization be granted to "nil" assess the Ria1toUnified School District for maintenance of landscaping adjacent to the new school, south of Mill Street and located between Pepper Avenue. and Eucalyptus Avenue, with the stipulation that the City reserve the right to assume maintenance of landscaping through the assess- ment district whenever the Director of Public Works/City Engineer finds the landscaping is not being maintained in a manner mparab1e Ji:; ::b:::Srema i nder of the di stri ct. /h ..K ,,~''--. STAFF REPORT Assessment District No. 975 was formed to provide for maintenance of landscaping within parkways of major streets. Tentative Tract Map No. 12313 was filed for this area. However, the Ria1to Unified School District acquired the parcel for construction of a new high school. The District has submitted a letter, dated 9-14-88, re- questing that they be a11owe~ to maintain the landscaping adjacent to their property. Also, that they not be assessed under the District, since they would be incurring the costs for maintaining the landscaping. A copy of this letter is attached for reference. This property would still be in the Assessment District, and the City could assume maintenance at any time the District fails to maintain the landscaping in a manner comparable to that of the adjoining areas. If this occurs, the School District will be assessed for their proportionate share of the costs for maintenance of landscaping. RE: RIALTO HIGH SCHOOL Project No. 87-111 Dear Mr. Hardgrove: On September 9, 1988, representatives from the Rialto Unified School District and from Wolff/Lang/Christopher Architects met with Verne Nedeau and Steve Kupsak to discuss off-site plans for Rialto High School. It is our understanding that Rialto High School property lies within the Mill and Pepper Landscape Assessment District, No. 975. This school district currently maintains all parkways adjacent to existing schools with its own Grounds Department crew. It is the intent of the school district to plant and maintain landscaped parkway areas on the perimeter of the new Rialto High School. The Rialto Unified School District is, therefore, requesting that the City of San Bernardino grant to the school district the status of "nil assessed" concerning perimeter right of way property to be landscaped, and also other relevant properties within l-!ill and Pepper Landscape Assessment District No.. 975. In requesting the above, the District agrees to the following: 1) All landscaped right of ways will be maintained on a continuous basis by the Grounds Department of the school district. 2) The school district further agrees that if the school district fails to maintain right of way property, adjacent to Rialto High School, that the Landscape Assessment District No. 975 retains the authority to assume right of way maintenance respon- sibilities and to assess the district for such services. 9/20/88 .
