CIT~ OF SAN BERNARDINO - REQUEIt t FOR COUNCIL ACTION STAFF REPORT Subject: Appeal of Planning commission's Conditional Use Permit No. 88-2 Denial of Reauest The applicant, Patrick Chiu & Associates, is appealing the denial of Conditional Use Permit No. 88-2 by the Planning Commission. The applicant is requesting that the Mayor and Council uphold the appeal and approve of Conditional Use Permit No. 88-2 for the establishment of a 64 unit motel in the CG - General Commercial land use designation. Backqround The site of the proposed 64 unit motel is a 1.03 acre site, with 150 feet frontage on the south side of 23rd Street and 150 feet frontage on the north side of Highland Avenue, 100 feet west of Mountain view. A Negative Declaration was recommended by the Environmental Review Committee on March 24, 1988. The motel site plan was recommended for approval by the Development Review Committee on April 21, 1988. Change of Zone Application No. 88-1 was submitted in conjunction with the Conditional Use Permit application. The northern half of the site, adjacent to 23rd Street, was zoned T, Transitional and was approved for C-3, General Commercial zoning by the Council on June 20, 1988. The proposed Travelodge Motel was designed in a Spanish architectural style and met all City Codes with regard to parking, landscaping and circulation. The surrounding land uses are commercial on the south, east and west, with residential to the north along 23rd Street. No access was proposed from 23rd Street. The project was considered at the October 4, 1988 Planning commission meeting, after being originally scheduled for July 19, 1988. At that earlier meeting the project was continued so that the developer could meet with the surrounding property owners. Such a meeting was held on September 27, 1988 in the Feldheym Library. The issues raised at that meeting were: Access to 23rd Street. Crime in the area. Distance from the freeway. These same issues were raised at the Planning Commission public hearing of October 4, 1988. A petition and protest letters of about 200 persons were received. A side issue of the City-Lites "teen night club" was raised. This "club" caused a lot of concerns over the increase of crime incidents in the neighborhood. The closure of this facility helped to reduce the number of crime incidents and a concern was expressed that the potential re-opening in combination with a motel would reverse the present lower crime situation. The police report reflected the history of the area and recommended certain conditions of approval which were incorporated into the Planning Department's recommendation of conditional approval. The issue of land use compatibility is largely a subjective issue in this case. The neighbors, including some commercial neighbors, do not want a motel to be in this area. The developers feel by expanding into this local neighborhood, they would be serving the needs of residents with visiting family and friends, and would, more specifically, be serving several local hospitals, advance business travel and mountain traffic. Highway 18 is about eight blocks to the east of the proposed motel site. The Planning Commission's decision was 6-0 for denial, due to the neighborhood' strong concerns of inappropriate land use at this particular site. In particular, the Planning Commission denied the application for Conditional Use Permit 88-2 for the construction and operation of a Travelodge Motel facility to be located at 220 W. Highland Avenue. The reasons for the appeal are as follows: 1. The Planning Commission closed the public hearir.g before the applicant had the opportunity to respond to issues raised by the City Attorney. 2. Testimony offered to and received by the Planning Commission from local residents on matters related to prostitution, drugs, ands crime was vague, undocumented and is not sup- pcrted by information available from the Police Department. Local residents indicate that the neighborhood has the worst crime in the City. However, the San Bernardino Police Department testified that this area does not have "below average" incidents of crime. 3. The staff report to the Planning Commission documented all of the relevant facts surrounding the developmenc of the site, the characteristics of the neighborhood, traffic con- ditions and other issues. The recommendation to the Planning Commission from staff was to approve the request because the facts supporting the necessary findings for the issuance ot a Conditional Use Permit are evident and included in the record. 4. In early 1988, the City of San Bernardino approved Change of Zone 88-1 which provided the necessary zoning for the proposed motel use. At the time of the zone change the ap- plicant clearly stated the purpose of the zone change was for the motel project. This was presented at public hearings before the Planning Commission and the City Council - and approved. 1867 Fern Hollow Drive. Diamond Bar. CA 91765 5. At the Planning Commission hearing, the Police Department indicated that they did not initially realize that the proposed motel would be a national name brand facility. However, when the Police Department learned that the facility will be a Travelodge, the representative suggested that the Police Department felt more comfortable with the use. 6. The Planning Commission considered the potential opening of a "teen night club" as a negative factor that, coupled with a motel, would breed crime. It is my contention that the motel will be a secured facility properly managed well within the provisions of the law. Our proposal should not be denied on the basis of another speculative use. In summary: the site is properly zoned for a motel; the neigh- borhood is subject to high volume commercial traffic; the development proposal complies with every aspect of the zoning and development code; vehicular and pedestrian access to 23rd Street is shown on the plans to be precluded and if approved will be built accordingly; the site is not adequate for more commercial retail businesses as evidenced by the many vacant (and deteriorating) storefronts now located in the neighborhood. The proposed project represents a substantial new investment in a commercial area that is in very obvious need of improvements. The Travelodge Motel will provide a secure facility offering needed motel rooms for the traveling public and the community. Other. FINDINGS OF FACT 1. The proposed use conforms to the objectives of the Interim Policy Document adopted by the Mayor and Common Council on May 23, 1988, amended on June 6, 1988, and approved by the state Office of Planning and Research on June 9, 1988 in that the document and map designate this area for General Commercial uses which include motels. 2. The proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is to be located in that it is not compatible with the existing commercial development in the immed- iate vicinity primarily the adult movie arcade and a bar which has .been approved for reopening, and impacts to adjacent residential uses due to the probability of increased criminal activity. 3. The size and shape of the site proposed for the use are adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare in that the site can accommodate the proposed motel and satisfy all requirements for setbacks, landscaping, parking and access. 4. The granting of the Conditional Use Permit under the conditions imposed will be detrimental to the peace, health and safety and general welfare of the citizens of the city of San Bernardino in that there is a potential for cumulative negative affects to the adjacent residen- tial uses relative to increase in crime, the nature of the business (a motel) and the lengthy distance from a freeway coupled with the possible reopening of a bar approximately four parcels to the west. Highland Ave. San Bernardino, Cl Dear Councilman Maudsley: Upon returning from a summer vacation I have been confronted by my neighbors in the proposed out of town developer who is asking for approval to build a 64-unit',. motel on this site between Arrowhead and Mt. View. I am asking you to oppose this proposed motel unit in view of what could happen to this thriving business area, such as vice, narcotics and prostitution. Certainly it is not a desirable area for a motel. We have maintained our offices in the Highland Ave. area, primarily on Highland Ave. in the present location for some 41 years. I have been very pleased with the foresight in allowing permits along Highland Ave. such as the developments in recent years on the NW corner of Sepulveda and Highland Ave., the SE corner of D street and Highland Ave., the SW corner of E Street and Highland Ave., as well as numerous other stores and facilities who have improved their frontal property. Having been the original partner with the TraveLodge Corporation in developing the two downtown TraveLodges and operating them through the 50's and 60's, I know what goes on in the motel business and how hard it 1s to maintain a respectable and desirable clientele. With thi' and the above information, and knowing that 90~ of the people in a mile radius of this area are opposed to this motel, I would ask that you be very strongly opposed to it. I am opposed to the development of subject property for the following reasons: 1) Traffic would increase at intersection of Highland and Arrowhead Avenues. This corner is already extremly dangerous (see attached article from San Bernardino Sun) 2) I am fearful of the type of persons that a motel may attract to our neigh- borhood. We have an ongoing problem with prowlers. burglaries. vandalism, graffiti and murders within a few blocks of the site and feel that these incidents may increase if transients are encouraged. Many of the area residents are senior citizens and some are confined to wheelchairs. Much of their shopping and recreation is limited to the immediate area of this proposed project. Their saiety would be threatened if crime increases. 3) Property values would decline dramatic1y if "undesirables" patronized the motel. I have spent a great deal of time driving by motels in this city. With few exceptions. the surrounding neighborhoods have become decayed and pitiful. Surely we have enough blight already in our community I I am a lifetime resident of this area and was raised only a few blocks from my current residence. I own a home on Arrowhead Ave. and have two rental properties. all of which are maintained in excellent condition. All are only a few hundred feet from the site in question. consequently both my safety and income would be threatened if the area suffered from negative impact. During the last few months, I have spoken with Seargent Tull and Detective Cartony of San Bernardino Police Department Vice and Narcotics. as well as Irma Castellanos and Dan Hernandez with San Bernardino Crime Prevention Program. BACKGROUND The hearing on this application was originally scheduled for July 19, 1988. It has been continued to give the applicant time to meet with the surrounding property owners who have objected to the motel. That meeting was held Tuesday, September 27, 1988 in the Feldheym Library. ANALYSIS Nine people attended the meeting held in the main library. The issues they raised were: 1. Access to 23rd Street. 2. Crime in the area. 3. Distance from the freeway. . ' "- ',1 ( TO: PLANNING COMMISSION RE: CUP #88-2 PAGE 2 4. Maintenance of facility. 5. Future of the area. The site plans were on display and fully explained to the residents attending the meeting. The motel will have no access to 23rd Street. The rear of the building facing 23rd Street is well-lit and landscaped. The building has been designed to have no windows opening onto 23rd Street. However, the elevations show an architectural treatment to the wall. The citizens were very concerned that the police report said the area was a low crime area. One resident's home insurance was cancelled because of the number of burglaries in the neighborhood. The police report based the crime rate on a comparison of criminal activity city-wide. The area does have a relatively low rate of crime. It has the second lowest rate for burglaries in the City. The crime rate has fallen in the last several years with the Closing of a neighborhood bar and a teen dance studio. Many problems with nuisance crimes were mentioned. For example, Coast savings Bank was forced to close off an outdoor access because vagrants used the area for sleeping and as a urinal. Trash bins in the entire area are used for bedrooms. The applicant pointed out that those activities occur without a motel. These problems exist in many areas. The additional lighting and increased activity resulting from the new motel in the area will make the area less appealing to vagrants. Close cooperation with the local police will help prevent these problems from growing The project is conditioned to keep the premises clean and neat. An additional condition of approval will be added requiring the owner to remove any graffiti immediately should graffiti displays occur. The citizens wanted to know who would be using the motel as it is far from the freeway. The applicant stated that Travel Lodge is expanding its market into the local neighborhoods to serve the needs of residents with visiting family and friends. The motel would be the first motel for people going to several local hospitals from the freeway. Business travel with advance bookings and mountain traffic are also major markets. TO: pLANNING COMMISSION RE: CUP t88-2 PAGE 3 The neighbors were concerned that in a few years the upkeep of the motel would go downhill and create the same type of problems the city has in the downtown area. Maintenance of the Motel is included in the conditions of approval. The owner is required to keep the exterior and interior of the building clean and in good repair at all times. The police report was discussed concerning the identification required of guests and the fact that no hourly, weekly or monthly rentals would be allowed. These conditions were added by the police to prevent the motel from being used for other purposes. The residents were told that these requirements give the City the authority to review the Conditional Use Permit should it not be operated in accordance with the conditions of approval. CONCLUSION The questions raised by the residents are the concerns addressed by the police in their staff report and in the Planning Staff Report. The plans reflect that there is no access to 23rd Street. The conditions of approval address the issues of crime and maintenance of the facility. To help prevent misuse of the rooms the police added the requirement for identification of all guests. RECOMMENDATION Staff recommends the Planning Commission hearing and evaluate the project based on and information contained in the staff recommends that the Planning Commission: hold the public the public input report. To the west the Bank of America faces Highland Avenue and its parking lot extends back to 23rd Street. To the east is a duplex on 23rd Street and a Commercial develop- ment on Highland Avenue. Each item checked .maybe. or.yes. on the checklist is identified below and followed by a recommended mitigation measure. 6.a. Will the proposal result in a change in the land use as designated on the General Plan? '-' The proposal is consistent with the purpose of the updated general plan provisions in that the new plan will incorporate the existing Redevelop- ment Area plans. This project is consistent with the Uptown Redevelopment Area Plan. 9.a. Could the proposal result in an increase in traffic that is greater than the land use desig- nated on the General Plan? The change of zone could increase the traffic demand on the surrounding streets however, it is used presently by the business on Highland Avenue. The City Engineering Department stated that motels do not create peak hour traffic problems. The exit onto Highland Avenue will prevent traffic from interfering with the resi- dential area to the north. Highland Avenue is designed to carry the traffic in this commercial area. Any other project considered on this site would have to be evaluated for its traffic demand. The intended use is for a 64 unit motel complex. The City Council continued the matter for 30 days to fur.ther study the impacts on the area as it relates to crime. RecolTll1enda ti ons: A study should be conducted through the Crime Analysis Unit and the Vice Detail in order to determine the crime trends as they relate to the area in question, otherwise identified as Reporting District (RD) #690. The specific areas of concern should be crimes related to vice and narcotic offenses. Fi ndi ngs : When the matter first came before us our main concern was that the motel is planned for an area which does not have the typical transient traffic through the ci ty as does the freeways, therefore it waul d tend to serve a local clientele. This type of motel generally has proven to be a law enforcement problem because they will rent rooms by the hour, week or month. This type of motel generally draws problems associated with public drunks, prostitution and narcotic use/sales. Another initial concern is that less than one block away is a nightclub building which has been closed since 1987 and is pending a permit request to reopen as a nightclub which will sell alcohol. When the club originally opened as a teen night club we experienced an increase of crime in the immediate area even though the club did not sell alcoholic beverages. Most of the offenses were alcohol related and drug related. In 1986 the crime statistics showed a 22% increase in the average crime rate within the city for that Reportinq District. After the 1987 closing of the club the reporting district showed a -9% reduction in reported crimes. We found no prostitution activity in the reporting district during the same period. We certainly cannot precict that such activity will exist merely because of the close proximity between t~e motel and the proposed nightclub, however, if there is a laxity of enforcement in the area we can certainly project that the offenses related to vice activity will inCrease dramatically, Nemorandum 27-r.1ay-88 Change of Zone No. 88-1 At this point our concerns for the area and the impact of the placement of the 64 unit motel at the proposed site are as follows: * Increase of traffic related oroblems. * Increase of transient customers without permanent residency. * Increase of noise due to traffic and loiterers particularly at nighttime. * Additional problems due to the motel nightclub proximity. * Increase of demands for police service due to complaints from permanent residents about transient residents. I have submitted my concerns previously to the planning department through Ms. Debbie Shuker in our crime prevention bureau. I believe that if we can require certain items from the developers, we may be able to control the potential problems. Some of those requirements are listed: * Quality construction which would enhance the neighborhood. * Quality landscaping which is consistant with our city's beautification efforts. (This would include trees along the 23rd street parkway). * Adequate lighting on the north side of the complex near 23rd street. * No access from 23rd street into or out of the complex. * Keeping proper and accurate records of tenants' drivers license and vehicle license plate numbers. * No hourly, weekly or monthly rentals. * Quality maintenance of grounds, parkina lot, exterior and interior of the building. Currently there are no significant crime problems related to reporting district #690. Because the property in .question currently houses two vacant buildings there is little activity reported. The construction would certainly improve the lot which currently is stagnant and commercially non-productive. I would strongly recommend that during the construction phase, the developer provide for security during the nighttime hours to diminish crime related to construction site theft and vandalism.
