STAFF REPORT
By direction of the Mayor and the Council on October 3, 1988,
I have prepared a report regarding the sale of animals for
research by our Animal Control Division. This report covers
a number of different aspects of the issue, history, staff
policy, Animal Advisory Commission position, present
conditions, and alternatives for resolution.
The sale of animals for research has been an issue for some
time. To many, the culmination of the issue was the ballot
Measure HH June 3, 1986. The question was, "Shall the City
continue to sell or give away impounded and unclaimed animals
for research? ..." (Attachment A). The measure did pass by
a 1.4% majority of voters casting votes on the issue.
Four months prior to the election, the Mayor and Common
Council passed Resolution No. 86-58, stating their intent to
comply with the election results. A specific policy was not
set until August of 1987 by the Acting Director of Animal
Control, Deborah L. Biggs. This policy set forth hours of
availability and defined animals which would not be
considered available for sale for research (Attachment B).
The sale of animals, in 1987, for research did not occur. The
adoption of animals increased significantly during this same
period. Research employees have not been to the shelter or
attempted to purchase animals during the past year.
City staff has consistently applied the policy set forth of
August 11, 1987 and separated out "pets". The staff, in
order to make sure people could designate how their animal
was to be treated, included in the intake card the question,
"Do you want this animal to go to research?" Records to date
indicate approximately .4% have been marked "yes". Because
the research organizations have not come forward to purchase,
these animals have been put down.
Division emp~yees were asked their feelings regarding the
sale of animals. Their responses were noted in the
Director's staff report of September 23, 1988 (Attachment C).
Some employees - feel strongly on the issue. It remains the
responsibility and duty of all employees to carry out the
policy directed by Mayor and Common Council.

There is, in the House of Representatives, a bill --
S 2353 -- which will provide, where local ordinance does not
prohibit, that animals be held for seven days for possible
sale. This additional time will add approximately double the
food budget to $22,000. This will also require additional
buildings for keeping both dogs and cats due to the doubling
of time the animals are retained. According to the
Director's staff report, the Animal Health Technician (AHT)
must accompany research personnel. Currently, we have one
technician and whatever time is spent with Research Personnel
is lost to care of other animals. At current rates it would
require the sale of 250 to 300 animals to cover the cost of
an additional AHT. This is also addressed in the staff
report of September 23, 1988.
As noted in the staff report of September 23, 1988, only two
cities still sell animals, San Bernardino and Hollister. In
1981, the City of Los Angeles took action to prohibit the
sale of animals. The report reflects their experience and
the rational for not selling animals. The report is provided
for information (Attachment D).
Some of the alternatives that should be considered by the
Mayor and Common Council include:

SCOPE: ALL ANIMAL CONTROL DEPARTMENT PERSONNEL
PURPOSE: TO ESTABLISH A UNIFORM PROCEDURE FOR THE SALE OF
ANIMALS FOR RESEARCH.
This policy supercedes all previous policies relative to the avail-
ability of dogs and cats to research institutions.
Research personnel will only be permitted to make selections on
Wednesday only from 10:30 a.m. to Noon.

Research personnel must be accompanied by a shelter staff member
for purposes of enforcing this policy.
Dogs and cats which qualify under one of the following character-
istics will not be made available for research:
1. Dogs or cats with identification tags, licenses (to include
expired or untraceable tags).
2. Dogs or cats with any type of collar; flea collar, harness,
rope, chain, string or ribbons in hair, docked tails, cropped ears
and dewclaws, even painted toenails. (Something obviously placed
attached by a human).
3. Any dog or cat which h~s notations on the impound ticket
indicating t~~wner or ~nterested party has inquired about the
animal.
4. No current or former Homefinder animals.
5. No owner release animals unless specifically requested in
writing by the former owner.
6. Unless an animal's kennel card indicates said animal shall
be made available for research, said ani~al shall not be released
to a research institution. .

The attached proposed policy is provided for your review. I
did not review the Minutes of the October 3 meeting; hence,
my staff report did not meet the intent of the motion.
The proposed policy is at variance with Theresa Overcast's
letter in the following areas:
1. The hours of availability.
2. The placing of animals for adoption.
These two items go together. If all animals are to be
considered for adoption, time must be identified. Two days
is within the three day hold presently in place. By being
open Monday, Wednesday and Friday, animals would always be
available on the third day following anyone of these days.
3. Three working days rather than 72 hours. Sunday is
an inaccessible day. In order to insure all owners
have the same time, three working days insures that
consistency.
4. Homefinder provision. There is a difference
between "current" and "current and former" so the
term "in homefinder programs" is used.
