SUBJECT: LIGHTING IMPROVEMENTS AT FISCALINI FIELD

It is my opinion that we have significant exposure relative
to the improper lighting that currently exists at Fisca1ini
Field, in that we have been notified that it is inadequate
for baseball played at this level.
Should a ball player be injured, those injuries would be
covered automatically by the Spirit's Workers' Compensation
policy. However, since we have been placed on notice and we
are the property owners, then we would be subject to a
significant subrogation recovery from the workers' compen-
sation carrier.
In addition, it quite possible that we could be subject to
additional penalties resulting from the serious and willful
misconduct section of the California Labor Code. Therefore,
I strongly recommend that funds be appropriated to improve
the lighting at Fisca1ini Field.
