DescriPtion) Finance: Council Notes: 75-0262 Agenda Item No. '-/7 ell -f OF SAN BERNARDl.40 - REQUEta..J FOR COUNCIL ACT,~N STAFF REPORT The proposed formation of the Waterman Underground Utility District No. 19, was approved by the City's Underground Utilitly District Committee at their meeting of 11-10-88. util ity companies are required by Rule 20 of the Public Util i ties Commission to set aside a certain portion of their revenues to finance the cost of undergrounding overhead facilities within districts established by local agencies. Each agency is allocated d certain amount of funds based upon the total number of overhead services within the agency's boundaries. The Underground Utility Committee of that agency reviews and designates areas proposed for the establishment of a district. A portion of this district lies within the jurisdiction of the County of San Bernardino. The County, is in the process of concurrently establishing this district, and will use a portion of their Rule 20 allocations for the district, based on a pro-rated basis. Property owners within the district will be required to complete undergounding from their property lines to the service points at their own No City funds will be required. the cost. Underground Utilities improve the appearance of a street by removing visual clutter. Improving the streetscape promotes the mental well-being of persons driving or walking along such a street. Undergrounding eliminates the hazard from broken wires wh:ich result from violent windstorms or earthquakes, both of which are frequent uccurences in the area. It is recommended that the Director of Public Works/City Engineer and City Clerk be authorized to proceed with the establishment of the proposed District, and that the attached Resolution, Noticing a public hearing for January 3, 1989, be approved. 10-28-88 75-0264 ~ ~ < ~'". . I I .- ~n II____~ =----- ~~ 5'."' ..- ~ IO..2e~BB 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COl~NCIL OF THE CITY OF SAt-: HERNARDINO NOTICING A PUBLIC HBARING CONCERNING THE FORMATION OF UNDERGROUND 3 UTILITY DISTRICT NO. 19, GENERALLY LOCATED ALONG WATERMAN AVENUE, BETWEEN THEN SOUTH LINE OF THE SANTA ANA RIVER AND THE NORTH LINE OF 9TH STREET. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, Chapter 13.36 of the San Bernardino Municipal Code of the City of San Bernardino provides for the establishment" of cln lmderground utility district within said City upon a finding by the Mayor and Common Council after a public hearing that the necessity, health, safety or welfare requires the underground installation of utilities within said district; and WHEREAS, the Underground Utilities Committee of said City hdS recommended the formation of an underground utility district to include the real property dehcribed below. NOW, THEREFORE, BE IT RESOLVED by the Mayor a.nd Common Council of the City of San Bernardino as follows: SECTION 1. NOTICE IS HEREBY GIVEN that the public hearing will be held before the Mayor and Common Council of the City of San Bernardino on January 3, 19R9, at the hour of 10:00 a.m., at the Council Chambers, 300 North "D" street, San Bernardino, California, to determine whether the public necessity, health, safety or welfare require the formation of Underground III i li ty District No. 19, the boundaries which are the East lines of the those parcels ]ocated on the East side of Waterman Avenue, dnd the West lines of those p.ircels located along the West side uf Waterman Avenue, all between the South 1 tne of the Santa. Ana River' and the North 1 inp of 9th street, more particularly shown on Plan No. 7600, OD file in the office of the City Clerk, dnd which is Plan is hereby appnr."ed. SEr.TION 2.
