Finding made of need for health and safety reasons.
Plans approved and authorization granted to advertise
for bids; and the transfer of $27,500 from Account No.
242-000-30405, approved.

STAFF REPORT
Bids for this project were opened at 2:00 p.m., on
Tuesday, 10-25-88.
A total of 6 bids were received, ranging from
$47,925.00 to $69,818.00. The low bid of $47,925.00 is
42.3% under the Engineer's Estimate of $83,000.00.
Listed below is an estimate of the total estimated
cost, based upon the actual low bid price:

Program Supplement No. 38 served to obligate the
amount of $61,200 in Federal-Aid Hazard Elimination Safety
(HES) Funds for this project. An amount of $6,800 has been
allocated, under Account No. 242~362-57360, to finance the 10%
local agency share, for a total available of $68,000. In
addi tion, supplemental funds in the amount of $ 27,500 were
provided to cover a possible shortfall.
At their meeting of 3-17-88, the Environmental Review
Committee found that this project is exempt from the
provisions of the California Environmental Quality Act.
Caltrans has reviewed and approved the bid results.
We recommend that a contract for be awarded to the low
bidder.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO MACADEE ELECTRICAL CONSTRUCTION FOR MODERNIZATION
3 OF TRAFFIC SIGNALS ON "I" STREET, AT RIALTO AVENUE AND SECOND
STREET, AND AT DEL ROSA AVENUE AND DATE STREET.

BE IN RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Macadee Electrical Construction Company is
7 the lowest responsible bidder for: Modernization of Traffic
8 Signals on "I" Street, at Ria1to Avenue and Second Street, and
9 at Del Rosa Avenue and Date Street, in accordance with Plan
10 No. 7351, for the total amount of $47,925.00, and a contract
11 is awarded to said bidder accordingly, but such award shall
12 be effective only upon the contract being fully executed by
13 the parties; all other bids therefor are hereby rejected; and
14 the Mayor is hereby authorized and directed to execute said
15 contract on behalf of the City; a copy of the contract is
16 attached hereto, marked Exhibit "A" and incorporated herein
17 by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or
19 modifications thereto shall not take effect or become operative
20 until fully signed and executed by the parties and no party shall
21 be obligated hereunder until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or
24 course of conduct of any party.
