STAFF REPORT
The Water Department is developing a new well for additional
capacity to meet demand. This project requires that an
additional electric service be obtained from Southern
California Edison for these facilities. Southern California
Edison's electric service is installed underground, termi-
nating at a pad mount transformer.
The Board of Water Commissioners, at their regular adjourned
meeting held November 15, 1988, unanimously voted to approve
the request for Grant of Easement to Southern California
Edison and authorized the Secretary to submit to the Mayor
and Common Council for approval.

A RESOLUTION OF THE MAYOR AND COMMON COUNCIL, CITY OF SAN
BERNARDINO, GRANTING AN EASEMENT TO SOUTHERN CALIFORNIA EDISON
COMPANY, A CORPORATION, FOR ELECTRIC SERVICE TO WATER DEPARTMENT
FACILITIES AT THE LYTLE CREEK PLANT, SAN BERNARDINO, CALIFORNIA.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE: That the City of San Bernardino execute a
Grant of Easement to Southern California Edison Company, a
corporation,
for
transmission
of
electrical
energy and
appurtenant facilities.
SECTION TWO: That the said Grant of Easement referred to
herein, a copy of which is attached hereto, marked Exhibit -A-,
and is hereby referred to and made a part hereof as fully as
though set forth at length herein, is hereby approved.
SECTION THREE: That the Mayor and City Clerk of the City
of San Bernardino are hereby authorized and directed to execute
said Grant of Easement on behalf of the City of San Bernardino.
I HEREBY CERTIFY that the foregoing Resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a ________________________ meeting thereof held on

CITY OF SAN BERNARDINO, a corporation (hereinafter referred to as "Grantor"), hereby grants to
SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, Its successors and assigns (hereinafter referred to as
"Grantee"). an easement and right of way to construct, use, maintain, operate, alter, add to, repair,
replace, reconstruct, inspect and remove at any time and from time to time underground electrical supply
systells and c_nication systems (hereinafter referred to as "systems"). consisting of wi res,
underground conduits, cables, vaults, lIanholes, handholes, and including above-ground enclosures, markers
and concrete pads and other appurtenant fhtures and equipment necessary or useful for distributing
electrical energy and for transmitting Intelligence by electrical lleans, in, on, over, under, across and
along that certain real prop.rty in the County of San Bernardino, State of California, described as
follows:
A strip of land, 12 feet in width, lying wi thin the Southeast quarter of Section 36, Township 1
North, Range 5 West, San Bernardino Meridian; the centerline of said strip being described as follows:
COMMENCING at the East quarter corner of said Section; thence Southl!rly along the Easterly line of
said Section, 859.9 feet; thence Westerly parallel to the Southerly line of $lid Section, 43 feet to
the TRUE POINT OF BEGINNING; thence South a distance of 25 feet.
It is understood and agreed that the above description is approxillate only, it being the intention of
the Grantor to grant an easement for $lid systems as constructed. The centerline of the easelllent shall
be coincidenhl with the centerline of said systems as constructed In, on, over, under, across and along
the Grantor's property.
The Grantor agrees for itself, its successors and assigns not to erect, place or mainhin, nor to
permit the erection, placement or maintenance of any building, planter boxes, earth fill or other
structures except walls and fences on the above described real property. The Grantee, and its
contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or
interfere with said systems and shall have free access to said systems and every part thereof, at all
times, for the purpose of exercising the rights herein granted; provided, however, that in lIaking any
excavation on said property of the Grantor, the Grantee shall lIake the ulle in such a lIanner as will
cause the least injury to the surface of the ground around such excavation, and shall replace the earth
so removed by it and res tore the surface of the ground to as near the same condition as it was pri or to
such excavation as is practicable.
