RE: BLOCKAGE IN SEWER LATERAL
Dear Mr. Clemons:
As a fOllow-up to our meeting in my office yesterday and our
telephone conversation this afternoon, this letter confirms that
the responsibility to maintain and clear a sewer lateral pipeline
belongs to the resident or the owner of the property in question.
The City does clear the main line and will clear a lateral if the
roots of a tree in a City right-of-way have entered a lateral and
blocked it. Otherwise, it is not the responsibility of the City
of San Bernardino to maintain the lateral lines.
For your information, I have enclosed photocopies of previous
opinions of the City Attorney's office in respect to this issue.
Inspection of your lateral line and the adjacent main line by
City workers reveals that the blockage is in your lateral line,
not the main line.
I have informed the City Engineer and the Director of the Public
Services Department of our opinion in this matter.
You have the right to appeal this decision to the Mayor and
Common Council under Section 2.64 of the Municipal Code of the
City of San Bernardino. Pursuant to that code section, it will
be necessary for you to file a written appeal with the City
Clerk within 15 days of the date of this letter.
