STAFF REPORT
Execution of the agreement with the State of California,
relating to construction of traffic signals at Second Street and
Route 1-215 Freeway, was authorized by adoption of Resolution
No. 88-74. A certified copy of this resolution, and copies of
the agreement were transmitted to Caltrans for signature.
Caltrans' legal staff has declined to accept our Resolu-
tion No. 88-74, since the agreement is referenced as Exhibit "A."
In the opinion of their legal staff, this subordinates the agree-
ment to the resolution, which is unacceptable.
The attached resolution authorizes execution of the agree-
ment, without incorporating it by reference as Exhibit "A."
We recommend that the resolution be approved.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE STATE OF CALIFORNIA RCLATING
3 TO THE INSTALLATION OF TRAFFIC SIGNALS AT SECOND STREET AND ROUTE
1-215 FREEWAY RAMPS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San BernRrdino is
7 hereby authorized and directed to execute, on behalf of sai~
8 City, District Agreement No. 8-603 with the State of California
9 relatin0 to the installation of Traffic Signals at Second Street
10 and Route 1-215 Free'^lay Ramps.

SECTION 2. The aqreement shall not take effect until
12 fully signed and executed by both parties. The City shall not be
13 obligated hereunder unless and until the agreement is fully
14 executed and no oral agreement relatinq thereto shall be implied
15 or authorized.

SECTION 3. Resolution No. 88-74 is hereby rescinded.
