ACTION STAFF REPORT At the June 20, 1988, meeting of the Mayor and Common Council, John Lightburn represented Steve Hall, applicant for Conditional Use Permit 88-4, to establish a liquor store in a multi-tenant commercial center located at Highland and Palm Avenues. Mr. Lightburn presented a letter dated June 15, 1988, to the Mayor and Common Council, which listed additional proposed conditions regarding the operation of the proposed liquor store. The conditions partially read: "1. Operational Hours...Friday - 7AM - lPM Saturday - 8AM - lPM..." During his presentation to the Mayor and Common Council, Mr. Lightburn read this letter aloud. The Council approved CUP 88-4 subject to Findings of Fact and conditions of approval and standard requirements; additionally, that it be subject to the conditions set forth by the applicant. In a letter dated June 24, 1988, the City Clerk's Office notified Mr. Lightburn of the Council's action. On July 5th, Mr. Lightburn notified the City Clerk's Office that his letter dated June 15th had contained a typographical error. On July 6th, Mr. Lightburn delivered a letter to the City Clerk's Office, requesting that the action taken at the June 20th Council Meeting be amended to correct the store's operational hours on Fridays and Saturdays to be open until 1 a.m., not 1 p.m. If it is the intent of the Mayor and Common Council that the store be permitted to be open on Fridays and Saturdays until 1:00 a.m., a motion needs to be made to reconsider the action taken concerning CUP 88-4, and then to amend the Operational Hours of the liquor store. 75-0264 Light~urrltcr- \. &ASSOclates,c~ ,'.\\' -,) t. ..) -- ,~. . , . ~ I,', (~ '..~j PoSt Office Box 1622 San Bernardino. The approved is subject to the following conditions set forth by the applicant: 1. Operational Hours: Monday thru Thursday - 7am to llprn Friday - 7am to lprn Saturday - 8am to lprn Sunday - Sam to 10prn 2. On-site Security (1 security guard) Monday thru Thursday - ~ to llprn Friday and Saturday - 5prn to lam Sunday - 6prn to lOpm 3. At all times the business will be operated in a manner which does not produce obnoxious noise, vibration, odor, dust, smoke, glare, or other nu- siance. The owner and applicant further agree to participate in forming a voluntary security assess- ment district with other businesses located at Highland and Palm Avenues. The subject property is located on the north side of Highland Avenue, 235 feet east of the center line of Palm Avenue.
