CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
On June 28, 1988, bids were opened for the construction
of a master planned 36-inch storm drain in Northpark Boulevard
between Mayfield and Electric Avenues. A total of 5 bids were
received ranging between a low of $117,916.00 and a high of
$159,950.00. The low bid was 26% under the highest bid and 22%
over the Engineer's Estimate.
After careful review of the bids, it appears that the
bids are valid. Listed below is the estimated project cost:

Funds have been allocated in an amount of $89,100.00 into
Account No. 248-368-57823. It is recommended that additional
funds in the amount of $45,900.00 be allocated from the Storm
Drain Construction Fund project 248-368-57882 - Master Plan Storm
Drain 6-22, North of Patton State Hospital, into this account to
insure funding. The sum of $750,000 has been appropriated, but
design is not yet started.
Staff recommends that the Resolution awarding the contract
to the low bidder, Brenton Lee Rhoades, be adopted; and further
that additional funds be transferred from the Storm Drain Con-
struction fund to Account No. 248-368-57823.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BRENTON LEE RHOADES FOR CONSTRUCTION OF A STORM DRAIN
3 IN NORTHPARK BOULEVARD BETWEEN MAYFIELD AVENUE AND ELECTRIC AVENUE
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Brenton Lee Rhoades is the lowest responsible
bidder for construction of a storm drain in Northpark Boulevard,
between Mayfield Avenue and Electric Avenue, in accordance with
Plan No. 7465, for the total amount of $117,916.00, and a
contract is awarded to said bidder accordingly, but such award

shall be effective only upon the contract being fully executed

by the parties; all other bids therefore are hereby rejected;
and the Mayor is hereby authorized and directed to execute said
13
contract on behalf of the City; a copy of the contract is attached
14

hereto, marked Exhibit "A" and incorporated herein by reference
as fully as though set forth at length.
SECTION 2. This contract and any amendments or
modifications thereto shall not take effect or become operative
18
until fully signed and executed by the parties and no party
19 hereunder until full execution
shall be obligated the time of such

No oral agreements, amendments, modifications or waivers are
21
intended or authorized and shall not be implied from any act or
22

course of conduct of any party.
