Dear Sir,
In July, 1985, the United States Air Force requested permission to remove
~ (~) Chinaberry trees located in the City right-of-way on the west
side of Tippecanoe in the 600-700 Block. The removal was requested to
enable the construction of a li.ght tower for the safety of aircraft uti-
lizing Norton Air Force Base. Permission was granted based on the safety
factor.
Since the permit had expired prior to approval from Congress, a new one
was requested and approved for the same reasons. Work was scheduled to
start Saturday, May 28, 1988. The Department of Public Services has re-
quested the start time be delayed to enable you to file a protest against
the removal.
Attached are copies of City of San Bernardino Municipal Codes 2.64, Ap-
peals to Common Council, and 12.40, Street Trees. Information on filing
a protest will be found in these codes. Please note that you will have
ten (10) days from the date of this letter in which to file the protest,
in writing, to the City Clerk.

I contacted the resident of 714 South Tippecanoe Avenue regarding the removal
of 7 Chinaberry trees from the City right-of-way by the United Stated Air
Force to alleviate a sight obstruction.
The resident, Ms. Betty Williams, stated that she was the sister of Don Lam-
berth, the property administrator of 696 South Tippecanoe Avenue, and that he
objected to the removals. I told her that he had a right to file a protest
against the removals and gave her the information to mail to her brother who
lives in Orange County.
At approximately 10:00 A.M., I telephoned Helen Wilson, with. the Army Corp
of Engineers at March Air Force Base and is coordinator for this project, to
notify her we were cancelling approval to start the removals and allowing
the property owner at 696 South Tippecanoe Avenue sufficient time to file a
protest.
I again checked with Les Fogassy, Real Property Specialist, to verify the
City right-of-way and confirmed that the trees are located within the City
right-of-way which extends 9 feet from the edge of the street. The distance
to the back of the trees is 8 feet. Overall right-of-way is 82.5 feet.

the west side of Tippecanoe at the old Sullivan Street intersection,
San Bernardino, California, to eliminate a visual navigation hazard.
The removal shall be completed at the United States Air Force expense
without compensation from the City. The United States Air Force will
be responsible for damages occurring on the public right-of-way during
the removal.
This permit will become effective when signed by the Director of Public
Services, City of San Bernardino, and will be valid for no more than
three (3) months. The Director of Public Services shall be notified
eighteen (18) hours prior to start of work.
Failure to comply with the conditions of this permit could result in
being charged with an infraction of City of San Bernardino Municipal
Clde 12.40 and fined accordingly.

1. We had received a permit (Permit No. 3-85) to remove 8 Chinaberry Trees on the
city right-of-way, the west side of Tippecanoe at the intersection of Sullivan Street
(now abandoned) and Tippecanoe back in July of 1985. Your office has now informed
us that this permit is invalid.
2. These trees present a visual navigation hazard and must be removed. We request
that you issue us another tree removal permit. We have attached a sample permit
similar to the one issued to us back in July of 1985 that would be acceptable to
the Air Force.

Subject: Protest of Tree Removal at 696 S. Tippecanoe Avenue.
I, William O. Lamberth, administrator of the Estate of Bessie R. Lamberth, do
hereby formerly confirm my protest of the removal of the eight (8) trees noted
in the attached copies of IICity of San Bernardino Street Tree Removal Permit
No. 1-8811, and lIi~otification of Tree Removalll form.
My reasons for protesting this action are noted below:
* An on site, and more importantly, a IIfrom the airll inspection of the
properties in question will, given proper altitude in flight approach,
reveal little if any, IIvisual navigational hazardll for incoming aircraft
to Norton Air Base. On the other hand, removal of subject trees will,
if anything, increase the hazard to the properties and present/future
occupants of the properties located immediately below the incoming
fl i ght pattern.
* A careful examination of the area will reveal that removal of subject
trees could increase the possibility of an aircraft hitting the power
lines that are in close proximity of the trees, unless of course, there
are plans to simultaneously relocate subject power lines underground.
Also, night traffic on Tippecanoe could be at increased risk given the
proximity of the navigational lights to Tippecanoe Avenue, if the point
of removal of the trees is to reduce the approach (or angle of desent)
to Norton Air Base. What other reason can there be for removing them?
* At ground level, the trees currently serve as somewhat of a buffer to
the considerable brightness emitted by the navigational lights due east
of the properties in question (God knows, the existing noise factor is
sufficient mental and physical agitation for one caught up in this
situation. )
*
In reviewing the title policy to this property, I find no recorded
easements or IIpublic right-of-wayll footage noted on the eastern boundary
of subject property where the trees currently stand.
*
Finally, after reviewing the map covering this and the surrounding area,
the CZ zones, decibel factors and zoning restrictions - the value of the
property for which I have a fiduciary responsibility, has already been
sufficiently deminished - given the fact that subject property is situated
immediately under the incoming flight pattern and at considerably more
risk than some other properties i.e., properties to the southeast of this

tITY OF SAN BERNARDINO STREET TREE REMOVAL PERMIT ~O. 1-88
Permission is hereby granted for the removal of eight (8) Chinaberry
trees from the City of San Bernardino public right-of-way located on
the west side of Tippecanoe at the old Sullivan Street intersection.
San Bernardino. California. to eliminate a visual navigation hazard.
The removal shall be completed at the United States Air Force expense
without compensation from the City. The United States Air'Force will
be responsible fo~ damages occurring on the public right-of-way during
the removal.
This permit will become effective when signed by the Director of Public
Services. City of San Bernard1no, and will be valid for no more than
three (3) months. The Director.bf Public Services shall be notified
eighteen (18) hours prior to start of work.
Failure to comply with the conditions of this permit could result in
being charged with an infraction of City of San Bernardino Municipal
Clde 12.40 and fined accordingly.
