Schuma From: Planning Director Subject: Renewal of Contract - City Consulting Geologist Dept: Planning Mayor and Council Meeting of February 2, 1987, 2:00 p.m. Da~: January 26, 1987 Synopsis of Previous Council action: Each year the Mayor and Common Council have extended an agreement with Dr. Floyd Williams, City Consulting Geologist, to review geological and liquefaction reports and development studies, as required by the Alquist- Priolo Geologic Hazard Act. Previously approved amendments extending the contract were Resolution No. 82~292, Resolution No. 83-141, Reso- lution No. 84-261 and Resolution No. 85-244. The attached resolution extends the contract to December 31, 1987 and deletes the requirement for maintenance of liability insurance on the recommendation of the City Attorney. Recommended motion: That the Mayor and Council adopt a resolution authorizing the execu- tion of an amendment to the agreement with Dr. Floyd Williams, extending the term of the agreement relating to evaluation of geo- logical reports and liquefaction studies until December 31, 1987. ~ Signature Frank A. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF THE FIFTH AMENDMENT TO AGREEMENT WITH FLOYD J. WILLIAMS EFFECTIVE JULY 1, 1986 TO EXTEND THE TERM OF THE AGREEMENT RELATING TO EVALUATION OF GEOLOGIC REPORTS AND LIQUEFACTION REPORTS. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL FOR THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said city a Fifth Amendment to Agreement with Floyd J. Williams effective July 1, 1986 to extend the term of the Agreement relating to evaluation of geologic reports and liquefaction reports, at an hourly rate of $60.00 and deleting the requirement that the consultant maintain liability insurance; a copy of the Agreement is attached hereto, marked Exhibit UN' and incorporated herein by reference as fully as though set forth at length. Mayor of the City of San Bernardino Approved as to form: 1 /1 {11* z!I;-J ~ City A torney 1/22/87 2 1 FIFTH AMENDMENT TO AGREEMENT 2 (Evaluation of Geologic Reports) 3 THIS FIFTH AMENDMENT to Agreement is entered into 4 effective July 1, 1986, between the CITY OF SAN BERNARDINO, a 5 municipal corporation, referred to as "City", and FLOYD J. 6 WILLIAMS, California Registered Geologist No. 2143, referred 7 to as "Consultant." 8 City and Consultant agree as follows: 9 1. Recitals. 10 (a) City and Consultant entered into an Agreement 11 on July 1, 1981, and various amendments thereto dated July 12 13, 1982, June 6, 1983, July 24, 1983, and July 16, 1984 13 (collectively "the Agreement"), relating to evaluation of 14 geologic reports and liquefaction reports. 15 (b) The parties now desire to amend the Agreement 16 to provide for an additional 18-month extension of its term, 17 and to eliminate the provision requiring Consultant to 18 provide professional liability insurance. 19 2.~. The term of the Agreement is extended for an 20 additional 18-month period commencing July 1, 1986 and 21 terminating December 31, 1987. 22 3. Insurance. Paragraph 7 of the Agreement, relating 23 to Consultant providing professional liability insurance, is 24 hereby deleted from said Agreement. 25 4. Other Provisions. All other terms, conditions, and 26 covenants of the Agreement, as amended, shall remain the same 27 and shall be in full force and effect. 28 1/22/87 1
