Prince Subject: Residential Property Nuisances Dept: Ci ty Attorney Date: January 23, 1987 Synopsis of Previous Council action: 9/8/86 Council directed City Attorney to prepare for their consideration a standard of maintenance provision which may be incorporated in the proposed R-3 Multiple Family Residential District ordinance for all multi-family development. Also, enforcement provisions were to be included. 10/6/86 Council continued to October 20, 1986, the proposed ordinance entitled "Ordinance. . . amending Chapter 19.12 . . . providing for the maintenance and enforcement of on-site landscaping in the R-3 Residential District", and directed the City Attorney and Planning Director to prepare an ordinance for Council consideration which would establish minimum standards and enforcement of the same on landscape maintenance standards for parcels throughout the City regardless of {Continued} Recommenl'jed motion: waive further first reading of ordinance and layover for final adoption. In addition to and in accordance with the determination made and the authority granted by the state under Sections 22660 through 22664 of the Vehicle Code to remove abandoned, ---r--- -~ lac;;1 ':,' /:. f€f",., ". ..' 475 (San Bernardino 9-85) It , 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 8.33.100 AND ADDING SECTION 8.36.160 TO THE SAN BERNARDINO 3 MUNICIPAL CODE TO PROVIDE THAT VIOLATIONS THEREOF SHALL BE INFRACTIONS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 5 ORDAIN AS FOLLOWS: 6 SECTION 1. Section 8.33.100 of the San Bernardino Municipal 7 code is amended to read: 8 "8.33.100 Violation - Penalty. 9 Any person, partnership, firm or corporation, whether as 10 principal, agent, employee, or otherwise, violating any provision 11 of this chapter .or interfering, obstructing or preventing or 12 causing the interference, obstruction or prevention, of or with 13 the enforcement or performance of any of the provisions of this 14 chapter by the Director of Public Services or other authorized 15 person is guilty of an infraction which upon conviction thereof is 16 punishable in accordance with the provisions of Section 1.12.010 17 of this Code." 18 SECTION 2. Section 8.36.160 is hereby added to Chapter 8.36 19 of the San Bernardino Municipal Code as follows: 20 "8.36.160 Violation - Penalty. 21 Any person, partnership, firm or corporation whether as 22 principal, agent, employee or otherwise violating any provision of 23 this chapter is guilty of an infraction which upon conviction 24 thereof is punishable in accordance with the provisions of Section 25 1.12.010 of this Code." 26 I HEREBY CERTIFY that the foregoing ordinance was duly 27 adopted by the Mayor and Common Council of the City of San 28 Bernardino at a meeting thereof, held 1 on the ~ day of , 1987, by the following 2 vote, to wi t: 3 4 AYES: Council Members 5 NAYS: 6 ABSENT: 7 8 9 10 11 12 13 14 City Clerk The foregoing ordinance is hereby approved this day of , 1987.
