STAFF REPORT
This Resolution confirms the Assessment Roll and approves the
Assessment Diagram Map No. 966 for the improvement of Daley Canyon
Road, easterly of Chiquita Lane by the construction of curbs, gutters,
paving, driveway approaches and appurtenant facilities.
On February 3, 1986, Resolution of Intention No. 86-34 was adopted
which instituted formal proceedings to form an assessment district in
the Daley Canyon Road area for the improvement of the road Easterly of
Chiquita Lane.
All the requirements of Chapter 12.90 of the Municipal Code were
fulfilled and on April 21, 1986, the Resolution ordering work was
adopted. The charges for the establishment of the district, total
$73,962.46. However, pursuant to the Resolution of Intention, the
City is paying the incidental costs of $27,253.68, and the Federal
Government's assessment of $4,378.09 which leaves a total of
$42,330.69 to be assessed to the owners. The assessment will be
collected over a 10-year period at 10% interest per annum on the
unpaid balance.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO
CONFIRMING ASSESSMENT ROLL NO. 966 FOR THE IMPROVEMENT OF
PORTIONS OF DALEY CANYON ROAD, EASTERLY OF CHIQUITA LANE, IN
THE CITY OF SAN BERNARDINO, AND APPROVING ASSESSMENT DIAGRAM
MAP NO.966.
WHEREAS, the Mayor and Common Council of the City
of San Bernardino on January 6, 1986, adopted its Resolution of
Intention No. 86-34, to order the work described therein to be
done under the provisions of Chapter 12.90 of the San
Bernardino City Municipal Code; and
WHEREAS, the Mayor and Common Council on January 6,
1986, approved the Engineer's Report on the proposed asse~sment
district, which report includes a proposed assessment roll and
Assessment District Map relative to Assessment District No.
966; and
WHEREAS, pursuant to said Resolution of Intention
No. 86-34, a hearing was set for March 3, 1986, which was
continued to March 17, 1986, then to April 7, 1986, then to
April 21, 1986, at which time and place written objections and
protests to the proposed improvement, the extent of the
district, or to the assessment district itself were heard and
considered and overruled; and
WHEREAS, the construction has been completed and
total construction costs have been incurred of $46,708.78,
with incidental expenses of $27,253.68, totalling $73,962.46,
which total construction costs are hereby approved; of that
amount, the City has contributed $31,631.77, which leaves a
total of $42,330.69 in total construction costs to be spread

over the individual parcels in the district. The spread of
these to ta 1 construction costs by individual parcels is
established he re in on Exhibit "B II attached he re to and
i ncorpora ted herein by reference, which sets forth the
individual assessments to be levied on ea ch of the parcels of
land within Assessment District No. 966 and as shown on said
assessment diagram map to meet total construction costs; and
WHEREAS, recognizing that the total construction
cost will be collected over a period of ten years at. 10S
interest per annum on the unpaid balance, the Mayor and Common
Council do determine that $8,466.14 to cover one-tenth of total
construction costs including interest, must be spread to
individual parcels for 1987-88, and have been spread over the
individual parcels as set forth in Exhibit "A", attached
hereto, which together with Exhibit "B", is hereby declared to
be the Assessment District No. 966 Roll for 1987-88 for the
Daley Canyon Road Improvement District,
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO DO RESOLVE AS FOLLOWS:
SECTION 1. That the Mayor and Common Council do
hereby find and determine that the proportionate costs to be
levied against the parcels of land within Assessment District
No. 966 are correctly set forth on Assessment Roll No. 966 for
the fiscal year 1987-88, Daley Canyon Road Improvement District
designated as Exhibit "A" for total costs of one yearls
construction costs, including interest, and as Exhibit "B" for
the spreading of total construction costs, respectively, over

the individual parcels, which Exhibits are attached hereto
and are incorporated herein by reference, and the Mayor and
Common Coun~t1 do hereby confirm said assessments.
SECTION 2. That said Assessment Diagram Map No.
966 is hereby approved.
SECTION 3.
That the City Clerk is directed to
cause a copy of this Resolution and Exhibit "A" only to be
transmitted to the Office of the Auditor-Controller for the
County of San Bernardino with the request that the individual
assessments be placed on the subject 1987-88 property tax bills
for collection together with all other property taxes.
I HEREBY CERTIFY that the foregoing resolution was
duly adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof, held on the
