The building is to be moved from its present location at 264 East 40th Street to an approximately .17 acre site located on the south side of Ward Street, approximately 200 feet east of the centerline of Waterman Avenue. The applicants request approval to move a single-story, frame and stucco commercial building from 264 East 40th Street in San Bernardino to a .17 acre site located on the south side of Ward street, approximately 200 feet east of the centerline of Waterman Avenue, in the C-M, Commercial-Manufacturing zone. 2. The site is currently vacant. Surrounding properties are predominantly developed as retail commercial, with the exception of the property adjacent to the east, an older single-family residence, interspersed with vacant land. It should be noted the properties located to the north, south, and east are located outside the incorporated limits of the City of San Bernardino., A copy of the proposal was submitted to the San Bernardino County Planning Department for review; no comments have been received in response. 3. The structure is intended for use as the sales office for a proposed automobile sales lot. The San Bernardino Municipal Code does not specify a minimum square footage requirement for commercial buildings, but the structure is determined to be adequate for the proposed use. The automobile sales lot will be located on the three parcels adjacent to the west of the subject lot, and will consist of approximately 20,440 square feet of automobile sales and display. Adequate parking shall be provided on site pursuant to Municipal Code Section 19.56.040. Street dedications and improvements on Waterman Avenue and Ward Street, as required by the City Engineer (see attached Engineering conditions), shall be made prior to the issuance of the appropriate building permits. 4. The 7,500 square foot lot is adequate in size and shape to accommodate the proposed structure. The submitted site plan indicates a front setback of approximately 67 feet, with a side yard setback of 5 feet from the east property line, and a rear setback of approximately 58 feet. All proposed setbacks will meet or exceed minimum setback requirements for the C-M zone. 5. The automobile sales lot, shown on the 3 parcels adjacent to the east, will be developed concurrently with the proposed building move on. Staff recommends that a lot line adjustment to combine the four existing parcels (approximately .52 acres total) into one parcel be required as a condition of approval. 7. A recent amendment to the City of San Bernardino Municipal Code Chapter 19.68 requires that a Conditional Use Permit be obtained prior to moving any building wi thin the City'. Condi tions to use, set forth in the amended section, include a requirement that construction be completed within 120 days from the date of issuance of the Building Permit. A bonding requirement is also established in order to ensure timely project completion (Section 19.68.100). '--" 8. Per the submitted site plan, there is no structure available on site for automobile repair. Section 19.28.020(B.l) requires that all automobile repairs shall take place within a building. The proposed commercial use of the building conforms with the goals and objectives established within the East San Bernardino-Highland General Plan, which designates the site as Commercial-Industrial. The use also conforms to allowed uses in the C-M, Commercial- Manufacturing zone, as established by the Municipal Code. 2. The proposed use could not adversely impact the community, existing uses, or the continued development of the area in which it is proposed. 3. However, if no development has been initiated at the end of the 12-month period, the application shall expire. This development shall be required to maintain a minimum of 10 stan- dard off-street parking spaces. b. All parking and driving aisles shall be surfaced with two inches of AC over a suitable base or equivalent as approved by the City Engineer. Parking spaces shall be striped and have wheel stops installed at least three feet from any building, wall, fence, property line, or walkway. c. Whenever an off-street parking area is adjacent to or across an alley from property zoned residential, a solid decorative wall six feet in height shall be p.rected and maintained along the property line so as to separate the parking area physically from the residentially zoned pro- p~rty provided such wall shall be three feet in height when located within the required front or street side yard setback. All required setbacks abutting a public right-of-way shall be landscaped (except for walks and driveways which bisect or encroach upon the required landscape area). c. Air conditioning and vent ducts shall be directed away from any adja- cent residential uses. b. All mechanical equipment located on the roof shall be screened and located away from adjoining residential uses. Screening design shall be approved by the Planning Department. Compliance with all recommendations of the Geology Report shall be required (if applicable). Grading and revegetation shall be staged as required by the City Engineer in order to reduce the amount of bare soil exposed to precipitation. ---1- During construction, the City Engineer may require a fence around all or a portion of the periphery of the site to minimize wind and debris damage to adjacent properties. The type of fencing shall be approved by the City Engineer to assure adequate project site maintenance, clean-up and dust control. Within 75 feet of any single-family residential district, the maximum height of any building shall not exceed one-story or 20 feet unless the Commission determines that due to unusual topographical or other features, such restrictive height is not practical.
