June, 1986--An additional allocation of $80,000 approved in 1986-87 Budget.
10-06-86 -- Plans approved and authorization granted to advertise for bids.

STAFF REPORT
On January 6, 1987, bids were opened for the proposed project. A total of
seven bids were received and ranged from a low bid of $126,173.00 to a
high of $189,362.50. The engineer's estimate for this project was $132,440.
The low bid is 4.7% under the Engineer's Estimate.
Construction will consist of a 24' x 441 concrete block building with rest-
rooms, concession stands, storage for Park Division and user organizations
and utilities. Plans have been reviewed and approved by the State Architect.
Listed below is the estimated cost of the total project; based upon the
actual low bid price:

A total amount of $165,000 has been allocated, under Account No. 243-363-57521
to finance the cost. Supplemental funds may be needed to cover any unusual

We recommend that the resolution awarding the contract to the low bidder be
adopted.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO
DUNCAN CONSTRUCTION, INC. FOR CONSTRUCTION OF RESTROOM/CONCESSION BUILDING
AT DEL VALLEJO JUNIOR HIGH SCHOOL.
BElT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. Duncan Construction, Inc. is the lowest responsible

bidder for construction of Restroom/Concession Building at Del Vallejo
7
Junior High School, in accordance with Plan No. 6865, for the total amount of
8
$126,173.00, a contract is awarded to said bidder accordingly, but such award
9
shall be effective only upon the contract being fully executed by the parties;
10
all other bids therefor are hereby rejected; and the Mayor is hereby authorized
11
and directed to execute said contract on behalf of the City; a copy of the
12
contract is attached hereto, marked Exhibit "A" and incorporated herein by
13
reference as fully as though set forth at length.

SECTION 2. Execution and Amendments. This contract and any
15
amendments or modifications thereto shall not take effect or become operative
16
until fully signed and executed by the parties and no party shall be
17
obligated hereunder until the time of such full execution. No oral agreements,
18
amendments, modifications or waivers are intended or authorized and shall not
19 be implied from any act or course of conduct of any party.

I HEREBY CERTIFY that the foregoing resolution was duly adopted by
21 the Mayor and Common Council of the City of San Bernardino at a
