SMOKING ORDINANCE The Committee had no recommendation sugsesting that the issue is one that must go to the people for a vote. This rehearing had been requested so the Coalition could submit a recommended ordinance for public government buildings. The group was not prepared to make that recommendation. The Committee suggested to the No Smoking Coalition that they approach the Chamber of Commerce to set an idea as to what businesses would prefer. They recommended that the coalition request a public hearing through the Office of the City Clerk. 2. SCHOOL IMPACTION FEES - The Committee accepted a report from the City Attorney's Office, recommended that all developers be noti- ~ fied of the procedure and that they be informed that the City has no jurisdiction over the fees charged or the dates set by the State. 3. GAME OF AMUSEMENT PERMITS - The Committee recommended appro- . val of the amendment (attached). 4. ORDINANCE REGULATING THE LICENSING OP BSCORT BUREAUS - The Committee recommended approval of the amendment (attached). 5. TRANSPER DENSITY AND PEB WAIVERS - The Committee recommended con~lnuance for further study after receiVing a preliminary report fro. the Planning Director. The issue is very co~lez and needs fur- ther research. 6. ANIMAL CONTROL ORDINANCE - Item continued. CITY HALL SPACE & FINANCE PLAN - The Committee recommended Public Services remain in their area and RDA move to the 4th floor. PUblic Services will finance and coordinate the upgrading to match overall plan. The Committee further recommended a separate fund be established from rents received for future floor maintenance. 2. AUTO SALES ORDINANCE IN C-2 NEIGHBORHOOD - The Committee recommended approval of the Ordinance as changed. 3. ANIMAL CONTROL ORDINANCE Item continued to December 11th. Animal Control and City Attorney did not have the changes requested. 4&5. PUBLIC WORKS/BUILDING & SAFETY CONSTRUCTION FEES Item continued. 6. WAIVER OF CONDITIONS FOR PARCEL MAP 9939-JOHN DAY The Committee, after discussion with SCE and the City Engineer, recommended that Mr. Day be contacted and requested to pay an assessment of $35,000 for undergrounding of utili ties. Further, the Committee r.ecommended the establishment of a separate trust fund. Funds would only be drawn down in the proportionate share that the project deposited. Meeting adjourned. Chapter 6.08, Section 6.08.020, Paragraph B, Page 4, concerning unattended animals at commercial establish- ments, was deleted. 2. Chapter 6.08, Section 6.08.020, Paragraph H, Page 5, was deleted. 3. Chapter 6.08, Section 6.08.020, Paragraph I, Page 5, was deleted. 4. Chapter 6.08, Section 6.08.020, Paragraph J, Page 5, concerning the removal and proper disposal of feces deposited by dogs or horses, was deleted. 5. Chapter 6.12, Section 6.12.090, Paragraph A, Page 12, concerning permit requirements for animals, was removed. 6. The original Page 12 was replaced with the optional Page 12 and the words "dangerous, non-domestic", was deleted from Line 4 of Paragraph A, Chapter 6.12, Section 6.12.090. 7. Chapter 6.12, Section 6.12.110, Paragraph A, Page 14, regarding animal permit and license revocation, was deleted. 8. Chapter 6.12, Section 6.12.130, Page 16 was amended to read, " by filing a timely written l5-day notice of appeal. The ordinance was laid over with amendments and corrections with recommenda- tions from the Legislative Review Committee at the time of the final reading of the ordinance. This resolution is also to be sent to SANBAG for their submittal. and to the County and sur- rounding cities requesting their support of the legislation.
