1 ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS
5.52.010 AND 5.52.100 OF THE SAN BERNARDINO MUNICIPAL CODE
3 REGULATING THE LICENSING OF ESCORT BUREAUS.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO HEREBY ORDAIN AS FOLLOWS.

SECTION 1. Section 5.52.010 of the San Bernardino
7 Municipal Code is amended to read as follows:

"5.52.010 Definition.
9 'Escort bureau' means any business or agency which, for a
10 fee, commission, hire, reward or profit, furnishes, or offers to
11 furnish escorts or persons who, for hire or reward, accompany
12 others to or about social affairs, entertainments or places of
13 amusement, or who consort with others, for hire or reward, about
14 any place of public resort or within any private quarters.
15 The requirements of this chapter shall have no application
16 and no effect upon and shall not be construed as applying to any
17 business, agency or person which provides escort services for
18 elderly persons pursuant to California Welfare and Institutions
19 Code Sections 9400 et seq., when such services are provided as
20 part of a social welfare and health program for such older
21

persons.
SECTION 2. Section 5.52.100 of the San Bernardino
23 Municipal Code is amended to read as follows:

"5.52.100 Furnishing escort to persons under eighteen
25 -parental request required.

No permitee shall furnish any escort to, or accept
27 employment from, any patron, customer, or person to be escorted

1 who is under eighteen years of age, except at the special
2 instance and request of the parent, guardian or other person in
3 lawful custody of the person upon whose behalf the escort service
4 is engaged."
