Proclamations & Presentations Mayor Morris presented a proclamation declaring Saturday, May 1, 2010, as the American Cancer Society's Relay for Life Day to Tina Gardy of the American Cancer Society and Event Co-Chairs Cheryl Robinson and Debbie Robbins. Council Member Marquez presented the Student of the Month award to Bertha Valerio, a senior at Casa Ramona Academy. 6 04/19/2010 Rabbi Hillel Cohn, Chairman of the Bicentennial Committee, accompanied by Jane Sneddon, chair of the parade sub-committee; Carlotta Mellon, Executive Director of the San Bernardino Symphony; and Jean Bachensky with the beautification sub-committee, announced several of the upcoming bicentennial activities including auditions for the San Bernardino's Got Talent event; the beautification contest; a special performance by the Symphony-Celebrate America-a musical tribute to San Bernardino's bicentennial and Community Hospital's centennial on May 1; Railroad Days on May 8 and 9 with steam engine locomotive 3751; a bicentennial parade on May 22; and the bicentennial gala scheduled for May 15. Waive Full Reading of Resolutions & Ordinances Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that full reading of the resolutions and ordinances on the regular agenda of the Mayor and Common Council and Community Development Commission, be waived. The motion carried unanimously. 7 04/19/2010 6. Claims & Payroll Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that the claims and payroll and the authorization to issue warrants as listed in the memorandum dated April 7, 2010, from Barbara Pachon, Director of Finance, be approved. The motion carried unanimously. 7. Personnel Actions Staff distributed the Unclassified Actions to the Council Members at the dais. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that the matter of the Unclassified Actions arose subsequent to the posting of the agenda. The motion carried with Brinker voting "no." Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that the personnel actions, as submitted by the Chief Examiner, dated April 14, 2010, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, and the unclassified actions dated April 19, 2010, be approved and ratified. The motion carried unanimously. 8. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing a License Agreement by and between the City of San Bernardino and William R. Gallagher, LLC, for the placement and operation of a food and beverage cart in the lobby of City Hall. Council Member/Commissioner McCammack stated that she had not received the staff report until she arrived at the meeting today and she had several questions. Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Johnson, that the matter be continued to the Council/Commission meeting of May 3, 2010. The motion carried with Kelley absent. 9. RES. 2010-69 - Resolution of the Mayor and Common Council of the City of San Bernardino amending the Annual Statement of Investment Policy for Fiscal Year 2009/2010 to add Section 8.10 thereto to permit investment in bonds, notes, warrants, or other indebtedness of the City. 8 04/19/2010 Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Authorize the Director of Development Services to execute Contract Change Order No. Two with Weka, Inc. for the Sanitary Sewer Improvement Relocations for 1-215 Freeway Widening, Segments 1, 2 and 5 (SW09-03), per Project Plan No. 12574 Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that the Director of Development Services be authorized to execute Contract Change Order No. Two with Weka, Inc. for the Sanitary Sewer Improvement Relocations for 1-215 Freeway Widening, Segments 1, 2 and 5 (SW09-03), per Project Plan No. 12574. The motion carried unanimously. 12. RES. 2010-76 - Resolution of the City of San Bernardino approving an Agreement for Services with Willdan for design of a traffic signal at Route 210 westbound Waterman Avenue off-ramp at 30th Street (TC08-09). Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Brinker, that said resolution be adopted. Resolution No. 2010-76 was adopted unanimously. 13. RES. 2010-70 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the City Manager to execute an Agreement for Professional Services with Lilburn Corporation for preparation of an Environmental Impact Report for the Shandin Ranch Specific Plan. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-70 was adopted unanimously. 14. RES. 2010-71 - Resolution of the City of San Bernardino authorizing and directing the execution of a Quitclaim Deed to Inland Valley Development Agency and a Quitclaim Deed to Westgate No.1, L.P., for those certain easements granted to the City by the same for a water pipeline located on the northwest corner of Tippecanoe Avenue and Mill Street. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-71 was adopted unanimously. 9 04/19/2010 15. RES. 2010-77 - Resolution of the City of San Bernardino approving an Agreement for Services with Transtech Engineers, Inc. for design of traffic signal upgrade at the intersection of California Street and Baseline Street (TC09-04). Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Brinker, that said resolution be adopted. Resolution No. 2010-77 was adopted with Kelley absent. 16. RES. 2010-72 - Resolution of the Mayor and Common Council of the City of San Bernardino repealing Resolution No. 2006-58 and Resolution No. 2007-476 and authorizing the City Manager to execute an Agreement with GFR Enterprises, Inc. for the dedication and improvement of a 4-acre park at the southwest corner of Irvington Avenue and Chestnut Avenue, now known as President Ronald Reagan Park. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-72 was adopted unanimously. 17. Refund of $713,278.70 in pre-paid Development Impact Fees to GFR Enterprises, Inc. d.b.a. Little League LLC Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that the Director of Finance be authorized to amend the FY 2009/10 Capital Improvement Program budget as outlined in the staff report from Valerie Ross, Director of Development Services, dated April 8, 2010; and that $713,278.70 in pre-paid Development Impact Fees be refunded to Little League LLC. The motion carried unanimously. 18. RES. 2010-73 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of agreements and purchase orders for the provision of photocopier equipment, supplies and maintenance with the following vendors: Advanced Copy Systems; Canon Business Solutions; Cook Arthur Inc; Ikon Office Solutions; Konica-Minolta Business Solutions; MWB Business Systems; Ricoh Business Systems; Toshiba Business Solutions and Xerox Corporation. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-73 was adopted unanimously. 19. ORD. MC-1322 - Ordinance of the City of San Bernardino amending City of San Bernardino Municipal Code Title 2, Chapters 2.14 and 2.15. FINAL READING (Continued from April 5, 2010.) 10 04/19/2010 Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said ordinance be adopted. Ordinance No. MC-1322 was adopted unanimously. 20. Organizational Restructuring Council Member/Commissioner Desjardins stated that he thought some of the salary amounts were excessive and did not demonstrate a responsible management of funds; therefore, he would be voting "no." Public Comments Jay Lindberg, San Bernardino, CA. Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Brinker, that the Mayor and Common Council reclassify the position of Director of Development Services (U), Range 4660, $11,937 - $14,509, to Director of Public Works (U), Range 4680, $13,189 - $16,031; reclassify the position of Director of Public Services (U), Range 4640, $10,804 - $13,132, to Director of Community Development (U), Range 4650, $11,356 - $13,804; reinstate the position of Director of Information Technology (U), with a salary adjustment from Range 4630, $10,278 - $12,493, to Range 4640, $10,804 - $13,132; delete the position of Director of Facilities Management (U), Range 4630, $10,278 - $12,493; and reclassify the position of Deputy Director of Code Compliance (U), Range 4600, $8,850 - $10,757, to Code Enforcement Division Manager, Range 4540, $6,561 - $7,975; and That the Mayor and Common Council approve the job descriptions for the positions of Director of Public Works; Director of Community Development; Director of Information Technology; and Code Enforcement Division Manager; that the Human Resources Department be authorized to update Resolution Nos. 97-244 and 2008-033: and that the Director of Finance be authorized to incorporate these changes into the FY 2010/11 budget. The motion carried with Desjardins and Kelley voting "no." 21. Concession hours clarification between the City and Management/ Confidential Non-Safety employees Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that the Director of Finance be authorized to reinstate Management/Confidential concession hours that were eliminated on December 31, 2009. RES. 2010-78 - Resolution of the City of San Bernardino amending Resolution No. 6429, entitled in part "A resolution ... establishing a basic compensation plan for officers and/or employees of the Police and Fire Departments of the City of San Bernardino. Council Member/Commissioner Brinker made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-78 was adopted unanimously. 23. RES. 2010-74 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of an agreement and increase to annual Purchase Order Number 210103 by $6,100 with three (3) one-year extensions at the City's option to Turf Star Inc., for the purchase of specialized Toro commercial equipment parts and supplies. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-74 was adopted unanimously. 27. RES. 2010-75 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of an agreement and increase to annual Purchase Order Number 210060 by $10,100 with three (3) one- year extensions at the City's option to Los Angeles FreightIiner for the purchase of refuse vehicle equipment parts and supplies. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Johnson, that said resolution be adopted. Resolution No. 2010-75 was adopted unanimously. 28. RES. 2010-79 - Resolution of the Mayor and Common Council of the City of San Bernardino amending Resolution No. 2007-230 to establish financial policies and procedures in support of the celebration of the City's bicentennial. Council Member/Commissioner McCammack stated that usually they are given a list of what money has been spent thus far. 12 04/19/2010 Council Member/Commissioner Kelley suggested using some of the funds for the Railroad Days. It was agreed that in the future staff would submit a list of those agencies/programs that have received funds thus far for the current fiscal year and also those organizations usually funded annually by the Council that have not yet received their funding for the year. Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Brinker, that said resolution be adopted; and that the request for indirect funding in the amount of $50,514.20 to be transferred from the 2009/10 Civic and Promotion Fund to various City departmental accounts, as listed in the staff report from Catherine Pritchett, Management Analyst II, dated April 8, 2010, be approved. The motion carried and Resolution No. 2010-79 was adopted unanimously. 29B. RES. 2010-80 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of an agreement and issuance of a Purchase Order in the amount of $39,850 to Sky Productions for staging equipment for the Bicentennial/Independence Day Extravaganza. Council Member/Commissioner Johnson made a motion, seconded by Council Member/Commissioner Brinker, that said resolution be adopted. Resolution No. 2010-80 was adopted unanimously. 30. RES. 2010-81 - Resolution of Mayor and Common Council of the City of San Bernardino authorizing the execution of an agreement with San Manuel Band of Mission Indians to use the City of San Bernardino Police Department's firing range. (Continued from April 5, 2010.) Council Member/Commissioner McCammack stated she would abstain because San Manuel is a business client. She left the Council Chambers, returning after the vote was taken. Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner Brinker, that said resolution be adopted; and that the Director of Finance be authorized to increase Police Revenue Account No. 001- 000-4740 by $25,000 and increase Police Expenditure Account No. 001-224- 5706 by $25,000. The motion carried and Resolution No. 2010-81 was adopted with McCammack abstaining. 13 04/19/2010 32. An Ordinance of the City of San Bernardino amending the defmition of "Roll-off Bin" contained in Section 8.24.060(W), of Chapter 8.24 of the San Bernardino Municipal Code. FIRST READING (Continued from April 5, 2010.) Council Member/Commissioner Shorett made a motion, seconded by Council Member/Commissioner Kelley, that the matter be continued to the Council/ Commission meeting of May 3, 2010. CDC/2010-19 - Resolution of the Community Development Commission of the City of San Bernardino approving and authorizing the Interim Executive Director of the Redevelopment Agency of the City of San Bernardino ("Agency") to execute an Agreement for Professional Services by and between the Agency and Westbound Communications, for the preparation of an economic development and branding campaign for the Downtown Core Vision and Action Plan Area in furtherance of the Economic Development Agency revitalization efforts. (Continued from April 5, 2010.) Council Member/Commissioner Shorett made a motion, seconded by Council Member/Commissioner Brinker, that said resolution be adopted. (R36F) Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner McCammack, that the matter be continued to the Council/Commission meeting of May 3, 2010. The motion carried unanimously. R37. San Bernardino Redevelopment Project Area Merger: Area A - Preliminary Report and Draft Amended and Restated Redevelopment Plan (Central City North, Southeast Industrial Park, Tri-City, South Valle, Meadowbrook/ Central City, Central City South, and Central City East Redevelopment Project Areas) RES. CDC/2010-21 - Resolution of the Community Development Commission of the City of San Bernardino: 1) approving the Preliminary Report for the Amended and Restated Redevelopment Plan and authorize its transmission to each affected taxing entity; and 2) refer the draft Amended and Restated Redevelopment Plan to the Planning Commission of the City of San Bernardino for its report and recommendation (Central City North, Southeast Industrial Park, Tri-City, South Valle, Meadowbrook/ Central City, Central City South and Central City East Redevelopment Project Areas). 16 04/19/2010 Council Member/Commissioner Kelley made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted. Resolution No. CDC/2010-21 was adopted unanimously. R38. RES. CDC/2010-22 - Resolution of the Community Development Commission of the City of San Bernardino, California, adopting the Economic Development Agency's Annual Statement of Investment Policy for the year 2010. Council Member/Commissioner Brinker made a motion, seconded by Council Member/Commissioner Desjardins, that said resolution be adopted. Council Member/Commissioner McCammack asked that this item be continued to the next meeting since the Council had just received it and she had some concerns. Interim Executive Director Marzullo stated he was hesitant to recommend a continuance on the total policy; however, the resolution could be approved with the understanding that some amendments could be brought back in the next couple of weeks. Council Member/Commissioner Brinker amended his motion, seconded by Council Member/Commissioner Desjardins, that said resolution be adopted contingent upon making some suggestions for possible amendments within the next couple of weeks. The motion carried and Resolution No. CDC/2010-22 was adopted unanimously. 39. Public Comments Reverend Robin Hyde, San Bernardino, CA, commented on the noise from the recent RAVE event at the National Orange Show and asked the Council not to allow RAVE concerts to take place that last until 4 a.m. Thalen Fluckes, Highland, CA, voiced a complaint against the Internal Affairs Unit of the Police Department, stating that he was trying to get help from them in his quest to file a complaint for misconduct of officers regarding another matter, but he was unable to get cooperation from Internal Affairs. Mayor Morris directed him to speak with Assistant City Manager Kurita so they could seek resolution of the problem. Charlie Brown, principal of the San Bernardino Adult School, advised that they had celebrated their 90th birthday on April 5, distributed a brochure listing classes offered by the school, and invited everyone to join them in celebrating their 90th birthday at a reception to be held Friday, May 14. 17 04/19/2010 Karen Serrano from the office of Congressman Joe Baca, San Bernardino, CA, advised that Congressman Baca would like to encourage the City of San Bernardino to apply for American Recovery and Reinvestment Act (ARRA) funds and federal grants that are available. She stated that Congressman Baca is willing to provide a letter of support for cities in his district pursuing these grant opportunities, and can reach the congressman's office by calling 909/885-2222. Jay Lindberg, San Bernardino, CA, spoke regarding the post oil civilization, stating that we should expect real shortages in the next few years. Rose Loya, San Bernardino, CA, representing the Latina Art Association, invited everyone to an art exhibit to be held on May 8, from 12 noon to 3 p.m. at the Feldheym Library at 555 West Sixth Street. 40.
