Backaround: On July 2, 2007 the Mayor and Common Council adopted Resolution No. 2007-230 establishing the San Bernardino Bicentennial Ad Hoc Committee. The purpose of the committee was to organize and plan events to celebrate the City's 200th Anniversary on May 20, 2010. Since the inception of the Committee, over 20 events have been organized to take place over the upcoming months (Exhibit A), with six (6) requiring the use of City services or personnel. The Bicentennial Committee is requesting that the City assist with defraying the costs associated with the events through indirect funding listed in the diagram below. A cost breakdown per event by department is attached as Exhibit B. Event Date Cost Clean Up Event Aril 24, 2010 $18,566.74 Railroad Days May 8-9, 2010 $2,957.63 Mayor's Run May 16, 2010 $5,635.49 Monument Dedication May 20, 2010 $816.56 Bi-Centennial Parade (Map Attached) May 22, 2010 $16,492.71 Bicentennial/Independence Day July 4, 2010 Extravaganza $6,045.07 2009/2010 Total $50,514.20 The 2010 July Fourth event, held annually at the Arrowhead Credit Union Park and customarily organized by the Parks, Recreation and Community Services Department, is being replaced by the Bicentennial/Independence Day Extravaganza and planned by the Committee. The 66er's baseball team is on the road on July 4t; therefore, the team will not be sharing in the cost for the 2010 fireworks display. Pyro Spectacular will be providing the pyrotechnics for the event; the cost for this show is attached as Exhibit C. The cost is less than the amount required for Council approval, and will be funded from the 2010/2011 Civic and Promotional Account. Please note, that the traditional 0 of July parade is not included on the Bicentennial event agenda. The parade is a separate function planned by an independent committee. Beginning in mid-April, the Public Services Department will be placing bicentennial event flags on street light poles throughout the City. The Department has confirmed that the placement of these flags can be done during the course of daily operations, and that no additional cost will be incurred. At the conclusion of the events, the Bicentennial Committee will be donating all of the hardware used to hang the flags to the City; an estimated value of$6,000. 1 Bi-Centennial Funding Request 2010—WCC 4119/2010 Bicentennial Ad Hoc Trust Account The Bicentennial Committee has been fundraising over the past three years in preparation for the celebration. In order to monitor these funds, the City's Finance department created a Bicentennial Trust Account. To date, approximately $148,000 has been collected. At the conclusion of the Bicentennial events, the trust account will be closed and any remaining balance will be transferred to the General Fund. Staff will not know what the total amount is until the financials for the events have been reconciled. At the March 29th meeting of the Ways and Means Committee, a Senior City Attorney determined that when the Bicentennial Committee was created it was not vested with the authority to receive or expend donations. This oversight was never mentioned during regular staffed committee meetings; therefore, action must now be taken. The attached Resolution creates a formal structure allowing the Committee to accept, account for and expend funds placed in the Bicentennial Trust Account. The Resolution also ratifies all expenditures made to date by the committee. A detailed sponsorship list is attached as Exhibit D. CC O Py 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 2 SAN BERNARDINO AMENDING RESOLUTION NO. 2007-230 TO ESTABLISH FINANCIAL POLICIES AND PROCEDURES IN SUPPORT OF THE 3 CELEBRATION OF THE CITY'S BICENTENNIAL. 4 WHEREAS, by adoption of Resolution No. 2007-230, the Mayor and Common Council established The San Bernardino Bicentennial Ad Hoc Committee ("Committee") for the 5 purpose of planning events ("Purpose") to celebrate the 200th anniversary of the founding of 6 San Bernardino ("City"); and 7 WHEREAS, after the effective date of Resolution No. 2007-230, the Committee has received gifts in the form of monetary contributions, services provided, and in other forms, in support 8 of the Committee's Purpose; and 9 WHEREAS, the Committee has received and made use of the gifts in support of its Purpose; 10 and 11 WHEREAS, it is the finding of the Mayor and Common Council that gifts granted to the City for the Purpose of the Bicentennial, and any money committed by the City for that Purpose, 12 shall be used only for that Purpose and it is in the best interest of the community that such 13 money not be used to pay the assessment of fees; and 14 WHEREAS, it is the desire of the Mayor and Common Council to establish policies and procedures for the receipt and use of gifts by the Committee. 15 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 16 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 17 SECTION 1. Section 10 is added to Resolution No. 2007-230 to read as follows: 18 Section 10. Accounting for Gifts 19 A. There is hereby established a fund, entitled the San Bernardino Bicentennial Trust 20 Fund (the "Fund"), in which all monetary gifts, bequests, and devises (sometimes collectively 21 referred to as "gifts") made to or for the City, or to or for any of its officers in their official capacity, including monetary gifts, bequests, or devises made to the Committee, for the 22 purpose of celebrating the 200`' anniversary of the founding of San Bernardino, shall be deposited. 23 24 B. All monetary gifts received by the City of San Bernardino, or any of its officers, employees, or committees shall, after formal acceptance by the Mayor and Common Council, 25 be placed in the in the Fund for accounting and expenditure as provided herein. 26 ``'� 27 i RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF 2 SAN BERNARDINO AMENDING RESOLUTION NO. 2007-230 TO ESTABLISH FINANCIAL POLICIES AND PROCEDURES IN SUPPORT OF THE 3 CELEBRATION OF THE CITY'S BICENTENNIAL. 4 SECTION 2. Section I 1 is added to Resolution No. 2007-230 to read as follows: 5 6 Section 11. Acceptance of Gifts 7 A. Pursuant to Government Code Section 37354, the Mayor and Common Council do hereby accept and do hereby ratify the acceptance of every gift, bequest, or devise made to or 8 for the City, or to or for any of its officers in their official capacity or in trust for any public 9 purpose, including such gift, bequest or devise as have been made to or for the Committee, for the Purpose. 10 B. After the effective date hereof, the Committee shall, at the time of its monthly 11 report required by Section 8, present to the Mayor and Common Council for their acceptance a list of monetary gifts, bequests or devises received for the Purpose. The Committee shall 12 otherwise present all non-monetary gifts, bequests, and devises for acceptance by the Mayor 13 and Common Council. 14 C. The Committee is hereby,authorized to accept and utilize such gifts of service, for the Purpose, on behalf of the City; as the Committee shall deem appropriate. 15 16 Section 3. Section 12 is hereby added to Resolution No. 2007-230 to read as follows: 17 Section 12. Committee Expenditures 18 A. The Mayor and Common Council do hereby ratify the expenditure by the Committee, to date hereof, of monetary gifts that fall within the definition of gifts to be placed 19 in the Fund pursuant to Section 10. 20 B. The Committee is hereby authorized to hereafter make expenditures from the Fund 21 consistent with the procedures set forth for departmental expenditures in the Purchasing policies of the City. 22 C. The activities of the Committee shall not be subject to the assessment of any City 23 fees. 24 D.
