On February 12, 2009, the Mayor and Common Council amended Resolution No. 2007- 345, Section 2, B, Compensation; Section 2, Q, Vacation Leave; and Section 2, Y, Holidays; between the City and Management/Confidential Non-safety employees. Recommended Motions: Authorize the Director of Finance to reinstate Management/Confidential concession hours that were eliminated on December 31, 2009. Description) Finance: Council Notes: Agenda Item No.�� CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect• Concession Hours Clarification between the City and Management/Confidential Non-Safety Employees. Backeround: The City Negotiation Team and members of the Advisory Committee from San Bernardino Confidential/Management Association (SBCMA) met to discuss ways the non-safety members could continue to assist with the City's financial deficit for the 2008-2009 and 2009-2010 fiscal years' budgets. On August 1, 2008, non-Safety SBCMA members agreed to take a five (5%) reduction to help with the City's budget deficit in exchange for eighty-eight (88) hours of time off. The City approached the SBCMA membership in January 2009 and as a result of the SBCMA's continuing commitment to help the City during this financial crisis, they had agreed to take an additional five percent (5 1/o) reduction in pay, effective March 1, 2009, through June 30, 2010. As part of the negotiations, and later agreed to by both parties, the additional five (5%) pay reduction would eliminate the expiration date of December 31,2009 tied to the concession hours usage. The subsequent staff report taken to Council on December 31, 2009 outlining the terms of agreement did not explicitly state that the concession hours would no longer have an expiration date of December 31, 2009. The Finance Department then deleted any remaining hours employees held. We are requesting the reinstatement of these hours. As agreed upon previously, these hours have no expiration date and no cash value upon separation. The purpose of this staff report is to clarify the language pertaining to the concession hours and to reinstate any remaining hours lost by members on December 31, 2009, per agreement between the City and non-safety members of SBCMA.
