PATEL/TERRACE MOTEL Olte: December 16, 1986 Synopsis of Previous Councilsction: On September 27, 1984, the Community Development Commission adopted a "Downtown Beautification Program. The-Mayor and Common Council and Community Development Commission have subse- quently approved approximately six l6) revisions amending said Program. On August 18, 1986, the Community Development Commission approved Mr. Harivadan P. Patel's Beautification loan, in the amount of $10,000. Upon further review, staff determined that this loan did not meet the Program underwriting crtieria. This matter was referred to the Redevelop- .ent Committee. On September 8, 1986, the Community Development Commission and the Mayor and Common Council approved the transfer of Beautification Program and assumption of responsibilities for implemen- tation of same to the City Community Development Department. On December 11, 1986, the Redevelopment Committee recommended approval of a Beautification Grant of $999.00 and a loan of $9,001 for Harividan P. Patel, and that the item be brought be brought forward to the Mayor and Common Council for final approval. 12/16/86 : .- ... CI"'Y OF SAN BERNARDI~O - REQU~$T FOR COUNCIL ACT~ON STAFF REPORT On August 18, 1986, the Mayor and Common Council approved a Beautification loan in the amount of $10,000 for Harividan P. Patel, owner of the Terrace Motel. Before approval and during Redevelopment Agency staff's review of this particular loan appli- cation, there was no information presented by the applicant or TRW Credit Bureau that would show cause for disapproval of loan. Redevelopment Agency staff did observe a conflict on the initial Property Profile with the Assessor's Parcel Number and the listed vesting. However, there were no outstanding Trust Deeds submitted in the Property Profile. Staff was assured by the title company that Mr. Patel was owner of property in question and advised staff that the clerical discrepancy would be revised and forwarded to the Redevelopment Agency. Receipt of the aforementioned documents revealed a Trust Deed in the amount of $142,000 against the owner's property, originally unknown to staff and not disclosed by applicant. The note of $142,000 included an additional monthly payment of $1,200.00 to the existing monthly expenses. On August 28, 1986, staff notified Mr. Patel they would recommend to the Redevelopment Committee that his Beautification Loan be denied, due to over obligation based on their recent findings. A copy of this letter is attached. On September 15, 1986, the Community Development Department assumed administrative responsibility of the Beautification Program. Community Development staff has received and reviewed a financial package from Mr. Patel indicating that the applicant's monthly debt ratio is well within the allowable amount. Because the applicant and his family live in and operate the motel, their monthly ex- penses (including the $1,200.00 note payment) are paid through their business and should not be charged against his monthly income. Attached is a cost estimate for $36,174.00 which shows the work and costs that are eligible under the City's Beautification Program. Also attached for information purposes, is a copy of the Construc- tion Agreement dated August 18, 1986, indicating the total cost ($110,000) of improvements the Patel's have contracted for comple- tion.
