Synopsis of Previous Council action:
Previous Planning Commission action:
At the meeting of the Planning Commission on December 2, 1986, the
following recommendation was made:
The amendment to the San Bernardino Municipal Code, Section 19.12 -
Multiple Family Residential Zone, pertaining to the effective date
of the new R-3 Multiple Family Residential Zone requirements, was
unanimously recommended for approval.
The Negative Declaration for environmental impact was also recommended
for approval.
Recomme",-led motion:
To approve the responses to comments and to adopt the Negative
Declaration for environmental impact which has been reviewed and
considered.
To approve, modify or reject the findings and the recommendation
of the Planning Commission and to direct the City Attorney to
prepare the necessary amendments to the Municipal Code.

On October 22, 1986, the Mayor and Common Council approved the amend-
ments to Section 19.12 of the Municipal Code pertaining to multiple
family development requirements (R-3 requirements). At that time the
Mayor and Common Council added a section pertaining to the effective
date of the new R-3 requirements which states that the effective date
shall be November 21, 1986 and will apply to all projects which have
not been approved by the Development Review Committee prior to Novem-
ber 21, 1986. All projects pending approval and approved projects
requesting an extension of time shall be subject to the new R,3 re-
quirements which could result in a revision of plans to comply with
such.
The addition of the effective date to Section 19.12 of the Municipal
Code did not receive environmental clearance since it was added recent-
ly and is being considered at this time.
At its meeting of November 6, 1986, the Environmental Review COllUnlttee
recon~ended a Negative Declaration of Environmental Impact for the
effective date of the new R-3 requirements,
RECOMMENDATION
Adopt the Negative Declaration of Environmental Impact for the addition
of the November 20, 1986 effective date of the amendments to Section
19.12 of the Municipal Code.

EFFECTIVE DATE OF FINAL APPROVAL OF ?LANS FOR ALL PROJECTS
PERTAINING TO MULTIPLE-FA.MILY DEVELOPMENTS. AND DECLARING TRE
URGENCY THEREOF.
THE MAYOR AND COMMON COONCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 19.12.210 is hereby added to the San
.
Bernardino Municipal Code to read as follows:
"19.12.210 Effective date.
The provisions of Chapter 19.12 as amended by Ordinance No.
MC-550 shall apply to all projects for wbich plans have not been
approved by the Development Review Committee as of thirty days
foliowing date of adoption of this section."
SECTION 2. This ordinance Is an urgency measure. which
'shall take effect and become operative upon its adoption and
approval. The facts constituting such urgency are that
amendments to Chapter 19.12 of the San Bernardino Municipal Code
shall become effective on or about November 21. '1986. The
provisions of this ordinance, dealing wit~ the effective date of
final approval of plans pertaining to multiple family
developments, must become effective in conjunction with the
amendments to Chapter 19.12 in order that all developers will

have timely notice of the effective date of the amendments.
