1. SMOKING ORDINANCE The Committee had no recommendation
suggesting that the issue is one that must go to the people for a
vote. This rehearing had been requested so the Coalition could submit
a recommended ordinance for public government buildings. The group
was not prepared to make that recommendation. The Committee suggested
to the No Smoking Coalition that they approach the Chamber of Commerce
to get an idea as to what businesses would prefer. They recommended
that the coalition request a public hearing through the Office of the
City Clerk.
2. SCHOOL IMPACTION FEES - The Committee accepted a report from
the City Attorney's Office, recommended that all developers be noti-
fied of the procedure and that they be informed that the City has no
jurisdiction over the fees charged or the dates set by the State.
3. GAME OF AMUSEMENT PERMITS - The Committee recommended appro-
val of the amendment (attached).
4. ORDINANCE REGULATING THE LICENSING OF ESCORT BUREAUS - The
Committee recommended approval of the amendment (attached).
5. TRANSFER DENSITY AND FEE WAIVERS - The Committee recommended
continuance for further study after receiving a preliminary report
fro. the Planning Director. The issue is very complex and needs fur-
ther research.
6. ANIMAL CONTROL ORDINANCE - Item continued.
7. ARA MANAGEMENT Mr. Tom lug, from ARA Managed Logistic
Support, Des Moines, Iowa, briefed the Committee and Mayor on Manage-
ment Contract Services his company provides cities worldwide. Mr. lug
will look at the Central Garage information and provide a report on
what he can do for us (no cost to City). The Committee recommended
the ARA package to the Central Garage Committee for perusal along with
the present study.
8. THREE-LEVEL PARKING STRUCTURE - The Committee recommended
that the cost for painting the three-level parking structure at the
corner of 4th Street and "E" Street in the amount of $62,983.00 be
funded out of General Fund salary savings.

6 SECTION 1. Section 5.44.040 of the San Bernardino
7 Municipal Code is amended to read as follows:
8 w5.44.040 Investigation.
9 The City Clerk shall refer a copy of the application to the
10 Chief of Police who shall carefully investigate the applicant and
1] the facts and circumstances concerning the application submitted
]2 to him pursuant to Section 5.44.030."
13 SECTION 2. Section 5.44.050 of the San Bernardino
14 Municipal Code is amended to read as follows:
15 W5.44.050 Issuance of permits.
16 A. The Chief of Police shall either approve or deny the
17 issuance by the City Clerk of the permit to the applicant within
18 forty-five days of the date that the copy of the application is
19 submitted to him. The Chief of Police may deny a permit on any
20 of the following grounds:
21 1. The operation will not comport with the peace, health,
22 safety, convenience and general welfare of the public,
23 2. The application is not complete in that all requested
24 information is not supplied,
25 3. The operation has been or is a public nuisance,
26 4. The operation would be in violation of a City
27 ordinance, state law or federal law,

1 5. The applicant has a bad moral cbaracter,
2 6. Tbe applicant made a false, misleading or fraudulent
3 statement of fact in bis application for a permit,
4 7. The operation by the applicant will be carried on in a
5 building, structure and location which does not comply witb and
6 meet all of the health, zoning, fire and safety requirements and
7 standards of the laws of the state and ordinances of the City;
8 8. The applicant, his employee, agent, or any person
9 connected or associated with the applicant as a partner,
10 director, officer, stockholder, associate, or manager has allowed
11 or permitted acts of sexual misconduct or lewd conduct to be
12 committed within prior or present business operations;
13 9. The applicant has within the year prior to the
14 application date wilfully violated any provisions of this chapter
15 or of the City licensing provisions in Title 5.
16 B. The Police Chief shall notify the applicant of the
17 denial of his application for a permit and the reasons therefor.
18 Service of such notice shall be made personally or by certified
19 mail. The notice shall include or be accompanied by a statement
20 that the applicant may request a hearing before the Mayor and
21 Common Council by filing with the City Clerk a written request
22 thereof within ten days after service upon bim of tbe notice of

23 the denial of his application and tbat failure to do so will .
24 constitute a waiver of his rigbt to a bearing..
25 SECTION 3. Section 5.44.060 of the San Bernardino
26 Municipal Code is amended to read as followsl

1 Within ten days after service upon him of a written notice
2 of the Police Chief's denial of his application for a permit, the
3 applicant may file a request for hearing in writing and signed by
4 or on behalf of the applicant and shall state his mailing
5 address. It need not be verified or follow any particular form.
6 Failure to file such a request for a hearing shall constitute a
7 waiver of the applicant's right to a hearing. No further notice
8 other than notice of the date and place of hearing need be served
9 on the applicant. Hearings granted under this section shall
10 allow for the applicant to be represented by counsel. The

REGULATING THE LICENSING OF ESCORT BUREAUS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO HEREBY ORDAIN AS FOLLOWS.
SECTION 1. Section 5.52.010 of the San Bernardino
7 Municipal Code is amended to read as follows:

"5.52.010 Definition.
9 'Escort bureau' means any business or agency which, for a
10 fee, commission, hire, reward or profit, furnishes, or offers to
II furnish escorts or persons who, for hire or reward, accompany
12 others to or about social affairs, entertainments or places of
13 amusement, or who consort with others, for hire or reward, about
14 any place of public resort or within any private quarters.
15 The requirements of this chapter shall have no application
]6 and no effect upon and shall not be construed as applying to any
]7 business, agency or person which provides escort services for

elderly persons pursuant to California Welfare and Institutions
Code Sections 9400 et seq., when such services are provided as
part of a social welfare and health program for such older
persons.
SECTION 2. Section 5.52.100 of the San Bernardino

Direction was given by the Legislative Review Committee to contact
electrical contractors and obtain proposals for providing relamping and
circuit repair services for street lights.
Listed below are the contractors contacted and the terms under which
they would provide the requested services.
1. Hoffman Electric -- 825-1210
Circuit repair - $42 per hour, plus $40 to $50 per hour for
equ i pment.
Relamping - only on long term contract.
2. Rightway Power Electric -- 674-2626
Circuit repair - $45 per hour, plus $40 to $60 per hour for
equipment.
3. Sunset Electric -- 678-4183
Circuit repair - $45 per hour for a man crew, $60 per hour for
2 man crew.
4. Flemington Electric -- 793-0965
Circuit repair - $40 per hour, plus $40 per hour for equipment.
Relamping - $55 per hour, including equipment.
Note: Does street light work for City of Redlands.
5. Maison Electrical Service, Inc. -- 929-6221
Circuit Repair - $36 per hour, or $68 per hour for a 2-man crew
and 40' lift truck.
Relamping - $59 per light, including replacement lamp $36 per
light, City provides replacement lamp.
We estimate that a crew can replace 10 lamps per day, which equates
to 0.8 hours per lamp. Lamps cost between $16 - $25, with an average of about
$21. The average cost per lamp by Flemington Electric is:

There are about 5,000 City-owned street lights within the City Limits.

An inventory of the actual number of lights that need relamping and
repairing has not been done. Therefore, the above estimate must be considered
preliminary.
The proposal from Maison Electrical states that they believe all work
can be accomplished within 30 days. It was indicated that additional shifts
would be worked if necessary to meet this goal.
Wayne Overstreet and Bert Murphy have met with representatives of
Maison Electrical, and believe them to be experienced and reliable. It is
our recommendation that a contract be extended to Maison Electrical. A copy
of their proposal is attached for reference.

Re: STREET LIGHTING MAINTENANCE
Dear Mr. Hardgrave:
Yesterday, Mr. Jonathan Hurst of this firm and myself met with
Mssrs. Wayne Overstreetr Bert Murphy, and William Gravesto dis-
cuss the City's current street lighting maintenance needs. We
were asked to submit a proposal to restore to working order
approximately 500 units that are currently out.
There are several components involved in repairing the lights.
They are the lamps, the ballasts, the housings, the refractors
(lenses), and the circuitry.
It is fairly certain that the great majority of the lights will
be fixed simply by relamping. Therefore, we propose doing this
as a first phase of the total project. This will provide the
most progress for the smallest (and most predictable) expendi-
ture. Our billing to the city would be as follows:
Replacement lamps provided by MAISON.........$ 59.00 per unit
(Domestic high pressure sodium -- 70 through 400 watt.)
Replacement lamps provided by CITY...........$ 36.00 per unit
During the relamping, we will determine where and what additional
work or components are required. This information will be re-
corded at that time. After the lamp replacement is accomplished,
service crews will return to those units to complete the neces-
sary repairs. Following please note our prices for ballasts:

Labor charges for ballast replacement are billed to the City
at $ 68.00 per hour for a lift truck with two technicians, up
to 40 feet height.
with respect to the lensesr it is not possible to project a re-
placement cost, as there are so many different types used. For
informational value, the price that we have experienced in the
past for lenses for the most widely used "cobra head" style
fixture has been around $ 85.00 each.
As of this writing, we feel that the City very probably is bet-
ter situated to obtain the most competitive price on the various
fixture housings.
Lens replacement, or any rewiring work will be performed on a
time-and-material basis as follows;

MAISON will waive travel charges upon being awarded the pro-
ject, provided that all the work is allowed to be performed
start-to-finish without any avoidable delays.
It has been brought to our attention that your calendar for this
project begins on January 5, 1987, with completion in 30 days.
We believe that the relamping phase can certainly be accomplish-
ed within this time framer with the remaining work completed
shortly after.

To Whom It May Concern:
In response to the Legislative Review Committee's request of the
Commission for Disabled Persons for a review of the standards re-
garding level paths of travel across driveways for the City of San
Bernardino, the Commission has made a lengthy study of driveway
standards according to Title 24 of the California Administrative
Code.
The Commission for Disabled Persons received a copy of W. Jud
Boies', Manager of the Access Compliance Section of the Office of
the State Architect, answer to a request from Deputy City Attorney
Cynthia Grace regarding the State's access standards concerning
driveway approaches. A copy of these two letters is attached for
your review.
Also attached, are two driveway designs recommended by City Engineer
Roger Hardgrave, and three Standard Drawings used by the City of
Rancho Cucamonga.
After reviewing all of the above information, the Commission for
Disabled Persons recommends the following:

Driveway specifications read that the path of travel
is to be concrete - not a choice of asphalt or concrete

The recommendations of City Engineer Hardgrave are
plausible driveway standards for the City of San Bernardino,
with the amendment that the specification stating that the
slope shall be 1/2 inch per foot maximum, be amended to
read 1/4 inch per foot, plus or minus 1/4 inch per foot
The Standard Drawings of designs used by the City of Rancho
Cucamonga are plausible driveway standards with two inclu-
sions: that no cross slope exceed 1/4 inch per foot, plus
or minus 1/4 inch per foot; and that the sidewalk be a
minimum of four feet wide.

Greetings:
The Commission for Disabled Persons was charged to study the ever-
changing handicapped parking situation in the City of San Bernar-
dino. The scope of this study is so large, that this Commission
would like to make evaluations and recommendations according to
Title 24 of the California Administrative Code to the Mayor and
Common Council as significant study is completed, instead of waiting
until the report of the entire City is complete.
The Commission has completed a study of the Central City Mall park-
ing. There are currently 12 handicapped parking spaces at the mall,
two at each of the following locations: south side of mall at the
Harris' entrance, south side of mall near Second Street, lower level
near Montgomery Wards, west side near Montgomery Wards, north en-
trance near Penney's and in the parking structure on the lower
level.

The Commission recommends that the parking structure of the mall be
considered as three different lots: the north side of the mall at
Howard Johnson '. s, the south main entrance on Second Street and the
parking structure as another main entrance. By considering the mall
parking as three individual lots, the handicapped parking would be
computed as follows: the north lot has 1,000 spaces, therefore 10
handicapped would be required; the south main entrance lot on Second
Street contains 1,500 apacea, therefore 13 handicapped would be
required; the parking structure at the main entrance haa 1,170 park-
ing .paces, therefore 11 handicapped spaces would be required. The
mall would then have 34 handicapped parking spaces, making the mall
more accessible for persona with a disability.
If the Mayor and Common Council concur with thia recommendation, the
Commission would like to make a recommendation aa to the placement
of the handicapped spaces.

Dear Mr. Chinn:
A local organization representing handicapped persons has
approached the Mayor and Common Council of the City of San
Bernardino and demanded that the City's standard
specifications for driveway approaches be revised according to
the attached drawing labeled "Design Aid 2". The handicapped
organization contends that this change is mandated by Title
24, California Administrative Code Section 2-3325.
The City's present standard for driveway approaches does not
require a level turnout for handicapped access. Members of
City staff have contacted several surrounding jurisdictions;
all of them have specifications which are virtually identical
to those of this City and all believe that these standards
comply with the handicapped access provisions of Title 24.
Consequently, the City of San Bernardino would like your
opinion as to whether Title 24 mandates the configuration
shown in the attached "Design Aid 2-. I appreciate your
cooperation in this matter.

In response to your letter of June 17 regarding driveway ap-
proaches and the State's access standards, I have the following
comments.
Title 24 of the California Administrative Code requires private
walks and public sidewalks to be virtually free of cross slope in
order to provide useability by people with disabilities. It is
clear that Section 2-3325(a)3 would not allow any sidewalk cross
slope to exceed 1/2-inch per foot (4.2~). Since there are no
exceptions to this requirement, it is'evident to that a driveway
with a slope exceeding 4.2~ cannot encroach into the required
sidewalk area. The standard (Design Aid 2) submitted to you by a
local organization depicts one way of providing the required level
sidewalks. I believe there are several other methods that would
accomplish the same purpose.

In response to the legislative Review Committee's request of the
Commission for Disabled Persons for a review of the standards re-
garding level paths of travel across driveways for the City of San
Bernardino, the Commission has made a lengthy study of driveway
standards according to Title 24 of the California Administrative
Code.
The Commission for Disabled Persons received a copy of W. Jud
Boies', Manager of the Access Compliance Section of the Office of
the State Architect, answer to a request from Deputy City Attorney
Cynthia Grace regarding the State's access standards concerning
driveway approaches. A copy of these two letters is attached for
your review.
Also attached. are two driveway designs recommended by City Engineer
Roger Hardgrave, and three Standard Drawings used by the City of
Rancho Cucamonga.
After reviewing all of the above information, the Commission for
Disabled Persons recommends the following:

Driveway specifications read that the path of travel
is to be concrete - not a choice of asphalt or concrete

The recommendations of City Engineer Hardgrave are
plausible driveway standards for the City of San Bernardino,
with the amendment that the specification stating that the
slope shall be 1/2 inch per foot maximum, be amended to
read 1/4 inch per foot, plus or minus 1/4 inch per foot
The Standard Drawings of designs used by the City of Rancho
Cucamonga are plausible driveway standards with two inclu-
sionsl that no cross slope exceed 1/4 inch per foot, plus
or minus 1/4 inch per foot; and that the sidewalk be a
minimum of four feet wide.

Dear Mr. Chinn:
A local organization representing handicapped persons has
approached the Mayor and Common Council of the City of San
Bernardino and demanded that the City's standard
specifications for driveway approaches be revised according to
the attached drawing labeled -Design Aid 2-. The handicapped
organization contends that this change is mandated by Title
24, California Administrative Code Section 2-3325.
The City's present standard for driveway approaches does not
require a level turnout for handicapped access. Members of
City staff have contacted several surrounding jurisdictions;
all of them have specifications which are virtually identical
to those of this City and all believe that these standards
comply with the handicapped access provisions of Title 24.
Consequently, the City of San Bernardino would like your
opinion as to whether Title 24 mandates the configuration
shown in the attached -Design Aid 2-. I appreciate your
cooperation in this matter.

Submit a complete floor plan showing the "footprint" that the structure
will make. All changes of elevation must.be shown from the building
finish flooring through thresholds, down corridors and walkways, through
entrances to designated parking areas. Show' contour lines if level changes
exceed 6 inches.
PARKING:

a. Handicap parking spaces must be provided at a rate of 1 space per 40
regular spaces. The spaces shall be 14 feet wide or 9 feet with a
5-foot transfer/access or walkway adjoining. The handicap spaces shall
be set aside, clearly marked, and close to the accessible entrance.
b. If no parking is available at the facility for the public or employees,
a -blue curb" space should be available in front'of the facility.
WALKWAYS AND 51 DEWALK5:
Where sidewalks cross driveways, the driveway slope shall not hamper
pedestrian traffic by encroaching into a 48-inc~ sidewalk area, which shall
remain level and clear from obstructions. This' 4~-inch level may be
available at the top of the approach, but only ii a clear, unobstructed,
48-inc~ path is provided to this area.
a. Walkways shall be 36 inches wide, sidewalks adjacent to a street shall
be 48 inches wide. Walks shall be of a continuing common surface - no
steps or aburpt changes of level.
b. Sidewalks that cross driveways shall maintain a continuous 48-inch
level path. The slope of the driveway shall not encroach Into the path
of travel. . .
A clear, level path of travel shall be indicated from the parking areas
and/or adjacent public sidewa1ks and thoroughfares leading into the
accessible entrance. .
CURB RAMPS/CURB CUTS:
a. If the property borders a public street, all curbs. driveways,
sidewalks, and relativ~ elevations shall be shown.
b. All sidewalks shall conform to Office of State Architecture require-
ments of slope (rise, run) of less than 1:20. Cross. slopes shall be
kept to a minimum and shall not exceed one-quarter inch per foot.
