2 ORDINANCE OF THE CITY OF SAN BERNARDINO REQUIRING A REVIEW
OF PLANS FOR TWO-STORY SINGLE-FAMILY DWELLINGS WITHIN THE
3 FOOTHILL AREA.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Review of Plans - Two-Story Single-Family
Residence.
A. The Planning Department shall establish and utilize
procedures pursuant to San Bernardino Municipal Code Chapter
19.77 for the review and approval of plans to expedi.-
processing of applications for development and improvement of
any two-story single-family structure on vacant exi.~lnq lot.

in the foothill area which have been recorded for a period of
three years; the foothill area is described as that a~.
beginning on the east side of the City Limits at Boulder Avenue
and Highland Avenue; thence northwesterly along the extension
of Piedmont Drive to Victoria Avenue; thence northerly up to
the extension of Piedmont Drive westerly to Foothill Drive;
thence along Foothill Drive west to Del Rosa Avenue; thence
north to the extension of Fortieth Street; thence west along
Fortieth Street to Waterman Avenue; thence north to the P.E.
Railroad riqht-of-way; thence west along the P.E. Railroad
right-of-way to the Northpark Boulevard; thence west along
Northpark Boulevard extending to the Muscupiabe Rancho line;
thence west to the City Limits, more particularly described as
shown on a map labeled Exhibit A on file in the Planning
Department.

1 B. The purposes of the review of plans are to ensure:
2 I. The compatibility of such development and
3 improvements with existing surrounding single-family residences;
4 2. The preservation of mountain and valley views for
5 existing and future residences as can reasonably be obtained by
6 the development; and
7 3. The protection of the values of such residences.
8 C. In no event shall this ordinance be deemed to authorize
9 the denial of the right to a building permit for any legal lot of
10 record.
1] D. Every owner within five hundred feet of property subject
12 to this review of plans procedures shall receive notice of any
13 such review of plans application.
14 SECTION 2. Applications - View Criteria.
15 A. All pending applications and applications filed hereafter
16 for foothill area development permits shall be subject to design
17 criteria for the preservation of mountain and valley views in the
18 foothill area. Such design standards shall be promulgated by the
19 Mayor and Common Council. Any projects submitted to the Building
20 and Safety Department prior to the effective date of this
21 ordinance shall be exempt from the provisions of this ordinance.
22 B. Pending development applications for the foothill area
23 shall not receive final approval until it has been determined that
24 such plans meet said design standards for the preservation of
25 mountain and valley views.
26 I HEREBY CERTIFY that the foregoing ordinance was duly
27 adopted by the Mayor and Common Counc il of the Ci ty of San
28 Bernardino at a meeting thereof, held on

10/6/86 Continued to 10/20/86.
10/20/86 Continued to 11/3/86; ordinance to be amended to provide a
notice to adjoining property owners within 500 feet and
provide provisions whereby a review of plans is triggered
for two story structures within the entire Foothill Area
from Boulder Avenue to the western City limits.
11/3/86 Referred to the Legislative Review Committee with a report
back on 11/17/86.
11/17/86 Ordinance amended by interlineation, given first reading
and lain over for final anoption.
