CITY HALL SPACE & FINANCE PLAN - The Committee recommended Public Services remain in their area and RDA move to the 4th floor. Public Services will finance and coordinate the upgrading to match overall plan. The Committee further recommended a separate fund be established from rents received for future floor maintenance. 2. AUTO SALES ORDINANCE IN C-2 NEIGHBORHOOD - The Committee recommended approval of the Ordinance as changed. 3. ANIMAL CONTROL ORDINANCE Item continued to December 11th. Animal Control and City Attorney did not have the changes requested. 4&5. PUBLIC WORKS/BUILDING & SAFETY CONSTRUCTION FEES Item continued. 6. WAIVER OF CONDITIONS FOR PARCEL MAP 9939-JOHN DAY The Committee, after discussion with SCE and the City Engineer, recommended that Mr. Day be contacted and requested to pay an assessment of $35,000 for undergrounding of utili ties. Further, the Committee recommended the establishment of a separate trust fund. Funds would only be drawn down in the proportionate share that the project deposited. ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING TITLE 19 OF THE SAN BERNARDINO MUNICIPAL CODE TO PERMIT AUTOMOBILE SALES AGENCIES IN THE C-2 COMMUNITY COMMERCIAL DISTRICT AND OTHER DISTRICTS WHICH PERMIT C-2 USES SUBJECT TO CERTAIN PROVISIONS. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 6 i SECTION 1. section 19.26.020 Subsection B Paragraph 3 of 8 the San Bernardino Municipal Code is amended to read: 9 "3. Automobile Sales Agency, including sale of recrea- 10 tional vehicles, boats, motorcycles and trailers, with 11 incidental service and repairs shall be permitted subject tp': 12 the following provisions. < ,".' , .:,<"~ 13 a. Outdoor display areas of both new, and used " 14 automobiles, recreational vehicles, boats, motorcycles'or 15 trailers shall be permitted provided that no vehicles are 16 displayed in off-street parking spaces required by Chapter 17 19.56. 18 b. All repair and servicing of vehicles shall be 19 conducted entirely within an enclosed building." 20 SECTION 2. Section 19.28.020 Subsection B of the San 21 Bernardino Municipal Code is amended to read: 22 "B. Retail Stores. 23 1. Commercial greenhouses (retail only); 24 2. Secondhand goods sold entirely within an enclosed 25 building (no junkyards); 26 3. Vice President Equity Expansion, Inc. 803 East Broadway Glendale, CA 91205 RE: Undergrounding Utilities -- Arrowhead Avenue and Huff Street Dear Mr. Day: The Council Legislative Review Committee considered your request, for a waiver of the condition of undergrounding utilities, at their meeting of 11-20-86. Information provided to the Committee by staff indicated that the estimated cost for undergrounding the entire section, from Central Avenue to Mill Street, is $51 per foot. Applying this unit cost to the Arrowhead Avenue and Huff Street frontages results in an amount of about $35,000. The Committee indicated their willingness to recommend to the Mayor and Council that a payment of $35,000 be accepted as satisfaction of the condition for undergrounding. This payment would need to be made prior to recordation of the pa rce 1 map. Please advise if this settlement is acceptable. If your concurrence is received in time, it could be approved at the next meeting of the Mayor and Council on 12~08-86. In the event it is not acceptable, the issue will be considered again at the next meeting of the Legislative Review Committee on 12-11-86. Very truly yours, ROGER G.
