We have estimated the cost of improving the natural watercourse, known as Bailey Creek, with a concrete lined trapezodial channel and construction of a box culvert at Pine Avenue, at $l50,000. REQUEST FOR WAIVER OF STORM DRAIN FEES - TRACT NO. 10979, EAST OF PINE AVENUE AND NORTH OF IRVINGTON AVENUE The Committee received a report from Councilman Quiel and agreed that the Director of Public Works/City Engineer needs a policy guideline rather than an ordinance to permit instal- lation of storm drains over and above normal development by a developer. There would not be a waiver of fees but a par- ticipatory agreement to refund the developer a cost not to exceed the amount of storm drain fees paid. If there is a downstream requirement foreseen, the City would not make a refund. The Committee recommended that the City Engineer bring the policy guidelines to the Council for approval. CIT~')F SAN BERNARDI~ - REQUEr' FOR COUNCIL ACTI 'N STAFF REPORT One of the conditions of approval for Tract No. 10979 was that Bailey Creek be improved in accordance with the City's Comprehensive Storm Drain Master Plan. The Master Plan indicates a concrete lined trapezoidal channel, 10 feet wide at the bottom and 6.5 feet deep. Bonds posted for this tract included an amount of about $l50,000 for construction of this trapezoidal channel. . Storm drainage fees paid by the subdivider amount to about $35,000. These fees are required to help install downstream drainage facilities to handle increased runoff from developments. However, in this case, Bailey Creek discharges directly into the Flood Control District's Devil Creek Spreading Grounds. The subdivider has submitted an appeal for waiver of these fees, since the City has no responsibility for the downstream drainage system. A copy of the letter from the Forecast Corporation is attached for reference. Two previous appeals have been submitted on this same basis. Both were denied by the Mayor and Council. Bailey Creek is to be improved as each tract that it traverses is developed. This arrangement has resulted in protests from these subdividers, because of having to bear an inordinate cost for the improvement of this channel. There is also the extended exposure to potential flooding due to the fact that Bailey Creek is being built as the various tracts are developed. The improvement of Bailey Creek will not be completed until all of the tracts that it traverses are completed. One property owner has expressed an interest in having an assessment district established to improve Bailey Creek. The advantages to the sub- dividers impacted are that the cost would be borne by a larger number of properties and they wouldn't have to upfront the funds.
