STAFF REPORT
San Bernardino Municipal Code Section 2.56.040 provides that
nomination papers for the municipal primary election shall be
issued not later than twelve noon on the sixty-eighth day
before the election.
The sixty-eighth day falls on December 25, 1986. Both
December 25 and December 26, 1986 are holidays and City Hall
will be closed.
Therefore, the City Clerk recommends and the City Attorney
concurs that for the purpose of the primary election the
nomination period should close on December 24, 1986 at noon.
The attached ordinance will accomplish that purpose.

ORDINANCE OF THE CITY OF SAN BERNARDINO CHANGING THE
3 DEADLINE FOR THE OBTAINING OF SIGNATURES TO NOMINATION PAPERS
OF ANY CANDIDATE FOR THE MUNICIPAL PRIMARY ELECTION OF MARCH 3,
4 1987 FROM TWELVE NOON ON THE SIXTY-EIGHTH DAY TO TWELVE NOON ON
THE SIXTY-NINTH DAY BEFORE THE MUNICIPAL PRIMARY ELECTION AND
5 DECLARING THE URGENCY THEREOF.
6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Notwithstanding the provisions of San
Bernardino Municipal Code Section 2.56.040 to the contrary, for
the purposes of the municipal primary election of March 3,
1987, nomination papers shall be issued and verification
deputies appointed to obtain signatures to the nomination
papers of any candidate at any time not earlier than the
eighty-ninth day nor later than twelve noon on the sixty-ninth
day before the municipal primary election.
SECTION 2. This ordinance is enacted pursuant to the
authority of City of San Bernardino Charter Sections 10 and 14-
A which permit the Mayor and Common Council by ordinance to
provide for the holding of primary elections. The purpose of
this ordinance is to change the deadline for the filing of
nomination papers from twelve noon on the sixty-eighth day to
twelve noon on the sixty-ninth day before the municipal primary
election because the sixty-eighth day set by San Bernardino
Municipal Code Section 2.56.040 falls on Christmas, a holiday.
SECTION 3. This ordinance is an urgency and emergency
measure relating to elections and shall take effect immediately
upon its adoption and approval.
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
