STAFF REPORT
Agency etaff and Redevelopment Committee recommend the execution of a Grant Deed
conveying that portion of Dillon Alley and Lugo Avenue that was inadvertently
omitted from the land transfer under the City/County Exchange Agreement.
BACKGROUND
In 1981 the Agency entered into an agreement referred to as the City/County
Exchange Agreement, wherein certain properties were conveyed to the Agency by
the City and the County. These properties were then conveyed by the Agency to
the State of California for the Seccombe Lake Project. Portions of Dillon Alley
and Lugo Avenue were vacated.
The City has received correepondence from the State Department of Parks and
Recreation requesting conveyance by deed to these alleys. The purpose of the
execution of the Grant Deed ie to clear any "cloud on the title" that may have
been caused when the streets were vacated. Agency Counsel concurs in the
procedure of supplying the State with a Grant Deed.

STATE OF CALIFORNIA TO INCLUDE LAND UNINTENTIONALLY OMITTED FROM
ORIGINAL GRANT DEED.
BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
7 A. The Redevelopment Agency of the City of San Bernardino

has previously conveyed to the State of California certain
property adjacent to and bordering Lugo Avenue and Dillon Alley
located between Fifth Street and Sixth Street in the City of San
Bernardino.
12 B. Prior to the execution and delivery of the Grant Deed by
13 the Agency to the State of California, the City of San Bernardino
14 took action to formally vacate portions of Lugo Avenue and Dillon
15 Alley between Fifth Street and Sixth Street. The Grant Deed
16 issued by the Redevelopment Agency to the State of California did
17 not specifically include the vacated portions of Dillon Alley and
18 Lugo Avenue adjacent to the property heretofore granted to the
19 State. The State now requests a Grant Deed specifically
20 conveying the underlying fee to those portions of Lugo Avenue and
2] Dillon Alley.
22 C. A public hearing on the proposed sale of the entire
23 parcel of land heretofore conveyed by the Redevelopment Agency to
24 the State of California has previously been held, pursuant to
25 Health and Safety Code Section 33433; relying upon the advice of
26 Counsel, the Commission determines that no further public hearing
27 under the provisions of Health and Safety Code Section 33433 Is
28 required at this time.

SECTION 2. Implementation. The Chairman and Secretary of
2 the Redevelopment Agency of the City of San Bernardino are hereby

authorized and directed to execute and deliver to the State of
California a grant deed conveying the underlying fee to portions
5 of Dillon Alley and Lugo Avenue, to the State of California. A
6 copy of the Deed to be executed is attached hereto as Exhibit "A"
7 and incorporated herein by reference.

I have enclosed a copy of deed No. 85-093569, recorded April 22, 1985,
that conveys portions of Lugo Avenue and Dillon Alley from the Redevelop-
ment Agency to the State. It is now necessary for the Agency to convey
the additional portions delineated in red on the attached drawing.
Please submit the attached original deed and four copies to the Redevel-
opment Agency for approval and signature. Upon execution please return
all documents, together with a certified copy of the resolution authorizin~
the conveyance, to me for further processing.
