STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Monday, 11-10-86.
A total of 2 bids were received, in the amounts of $100,091.04 and
$109,664.40. The low bid of $100,091.04 is 11.7% under the Engineer's Estimate
of $113,375.00.
Listed below is an estimate of the total project cost, based upon the
actual low bid price:

An amount of $226,700 was originally budgeted to finance the City's share
of the total project cost. The transfer of $75,000, to the widening of 40th Street,-
from Electric Avenue to Kendall Avenue, was approved at the Council Meeting of
10-06-86. This action leaves a balance of $151,700, from SB 300 funds, to finance
the City's share of the total cost of this project.
We recommend that a contract be awarded for the low bid price.
URGENCY CLAUSE:
This contract will have to be awarded at the Council Meeting of 11-17-86, in
order to have the project completed by the end of the year. There is the possi-
bility that bad weather could be encountered in January, which could delay com-
pletion. Awarding a contract on 11-17-86 will allow the street to be in good
repair for the Christmas shopping season.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO
INDUSTRIAL ASPHALT FOR PAVEMENT REHABILITATION OF FORTIETH STREET, BETWEEN
KENDALL DRIVE AND ELECTRIC AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. Industrial Asphalt is the lowest responsible bidder
for: Pavement Rehabilitation of Fortieth Street, between Kendall Drive
and Electric Avenue, in accordance with Plan No. 7047, for the total amount
of $100,091.04; a contract is awarded to said bidder accordingly, but such
award shall be effective only upon the contract being fully executed by the
parties; all other bids therefor are hereby rejected; and the Mayor is hereby
authorized and directed to execute said contract on behalf of the City; a
copy of the contract is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
SECTION 2. Execution and Amendments. This contract and any
amendments or modifications thereto shall not take effect or become operative
until fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No oral agreements,
amendments, modifications or waivers are intended or authorized and shall not
be implied from any act or course of conduct of any party.
I HEREBY CERTIFY that the foregoing resolution was duly adopted
by the Mayor and Common Council of the City of San Bernardino at a
meeting thereof, held on the
