Staff has notified the applicant as to the Plannin~ Commission's request that he appear at this meeting; he has indicated he would attend. Per the inquiry of the Planning Commission, Staff contaced the San Bernardino POlice Department for additional informa- tion concerning the level and type of crimes in the ale". The San Bernardino Police Department has submitted the followin9 data (see attached) for the Planniny Commiss.on's review regarding Clime in the project's reporting district. The applicant requests approval to conduct off-site alcoholic beverages at an existing within the C-4, Central Business District, 771 North nOn street. the sale of food store located at 2. The surrounding land uses include a dance studio tuxedo rental shop and other commercial activities to the immediate north. The area to the east is witness to multiple-family residential units, while to the south of the site a vacant field is apparent with other commer- cial activities beyond. To the west, across non Street, a large parking lot is evidenced. Zoning and th~ General Plan mirrors the land use in the vicinity with C-4, Central Business zoning to the north, south and west, with R-3, Multiple-Family Residential witnessed to the east. ~he General Plan designation, likewise, 1S General Commercial to the north, south and west with MUltiple-Family Residential to the east. 3. The store in question is an existing structure built in or before 1945 Isee attachment nAn from records obtained from the Building & Safety Department). The store consists of approximately l,580 total square feet including storage space, walk-in cooler, etc., with approximately l,040 square feet open to the general public Isee attachment nB"). The hours of store operation, as stated by the applicant, are from 7:00 a.m. to lO:OO p.m., Monday thru Saturday with Sunday hours being 9:30 a.m. to 8:00 p.m. 4 . l . Parking for the store is provided by a seventeen Il7) space parking lot, south of the store Inext to the auto- mobile body shop). Staff has been notified via letter, that the food store has eight (8) parking spaces assigned to the 7-10 store by lease agreement Isee Attachment nC"). The eight (8) parking spaces exceed parking requirements for a retail store of the above stated square feet. 5. The project site is not located near an established park or school. The nearest establishment to sell alcoholic beverages on-site is a mexican restaurant located in the mid. 600 block of North nOn Street. Staff did not view another off-site retail outlet near the site in question. Pioneer Park, located at the corner of 6th Street and "En Street, is approximately 1/2 a mile from .. ""'.' Lincoln Elementary School, located at the corner of l3th and Arrowhead Avenue is approximately 3/4 of a mile from the project site. 6. At the regularly scheduled meeting of the Environmental Review Committee held on September 11, 1986, a negative declaration was recommended for Conditional Use Permit No. 86-40. The site is presently zoned C-4, Central Business District and has a General Plan designation of General Commercial. The type of use being proposed is allowed by the current zoning and General Plan label with an approved conditional use permit. 2. The surrounding land uses include other store front type commercial uses, which exhibit circa mid-l940's construction. During that era, it was traditional not to place great emphasis on landscaping and parking (the store in question does, however, have parking 3. The project is not located near other retail outleLs selling alcoholic beverages. In addition, the store is l/2 mile plus from the closest park and school. A restaurant, which serves on-site alcoholic beverages is located approximately l,OOO feet south of the store. 4. The granting of Conditional Use Permit No. 86-40, with the attached condition and standard requirementss imposed, will not be detrimental to the general welfare, peace or safety to the citizens of the City of San Bernardino. . RECOHMENDATION Based upon the observations and findin9s of fact contained herein, and subject to the conditions and standard requirements attached hereto, Staff recommends adoption of the negative declaration and approval of Conditional Use Permit No. 86-37. No fence or wall located in the front setback shall obscure the required front setback landscaping. REfUSE ENCLOSURES: Whenever refuse bins are located within or adjacent to a parking area used by the public, they shall be enclosed by a decorative wall six feet in height alony the rear and sides and scrE~ned gatelsl six feet in height 3bng the front. The enclosure shall not be placed within the required front or street side yard setback area. All mechanical equipment located on the roof shall be screened and located away from adjoining residential uses. Screening design shall be approved by the Planning Department. Compliance with all recommendations of the Geology Report shall be required (if app 1 i cab 1 e) . Grading and revegetation shall be staged as required by the City Engineer in order to reduce the amount of bare soil exposed to precipitation. During construction, the City Engineer may require a fence around all or a porti on of the periphery of the si te to mi ni mi ze wi nd and debri s damage to adjacent properties. The type of fencing shall be approved by the City Engineer to assure adequate project site maintenance, clean-up and dust control. Within 75 feet of any single-family residential district, the maximum height of any building shall not exceed one-story or 20 feet unless the Commission determines that due to unusual topographical or other features, such restrictive height is not practical. All utility lines shall be installed underground subject to exceptions ap~roved by the Planning Department and the City Engineer. Date OCTOBER 15, 1986 Approved Date As per our conversation here is some information regarding C.U.P. #86-40. The area in question is in our reporting district 550. In checking the part 1 crimes back to 1984, this area is well above the city average for these types of crimes, especially for burglaries, thefts and assaults. You might be aware that historically alcohol has been linked to part crimes. The issuing of a permit for on site purchase for off site consumption of alcohol should be given considerable thought.
